Quality Goals. Solectron will be responsible for meeting or exceeding all quality goals as defined in Exhibit C2 and / or the Quality Plan. On a product by product basis or by product families, NCR and Solectron will jointly develop goals for Out-Of-Box defect rate, Committed Ship Date, First Pass Yield, Field Reliability, Early Life Failures, and other quality based metrics as defined in Exhibit C2.

Quality Goals. SELCOM GROUP and Supplier’s goal is to achieve and maintain a zero-defect level. Where the zero-fault objective cannot be achieved in the short term, SELCOM GROUP may define temporary upper limits with the Supplier for failure rates as intermediate targets (e.g. separate product tailored “ppm agreement”). If the Supplier realizes that the defined targets will not be achieved, he is obliged to submit concrete action plans to SELCOM GROUP. Obtaining levels lower than the agreed upper limits do not release the Supplier from his obligation to deal with all complaints and to continue with the process of continuous improvement.
Quality Goals. The Supplier is obligated to follow a zero error goal towards Xxxxxx + Xxxxxx, as Xxxxxx + Xxxxxx does towards its own customers. If it is not possible to achieve the zero error goal in the near term, the Supplier will be given a limited term error rate as an interim goal, and provided time to suggest measures and have these approved by Xxxxxx + Xxxxxx. Xxxxxx + Xxxxxx reserves the right to conclude target agreements with the Supplier for this purpose. Failure to meet agreed upper limits does not release the Supplier from its obligation to deal with all complaints and strive for continuous improvement. The Supplier's liability for defects or claims for damages due to incorrect deliveries remains unaffected.
Quality Goals. Supplier will use reasonable commercial efforts to meet or exceed the quality goals as defined in Sections 7.0 and 8.0 of this Exhibit C.
Quality Goals. Quality is a material term of this Agreement. Quantum will maintain objective quality programs for all Products and will achieve or exceed agreed quality goals as outlined in Attachment A (the "Quality Goals"). In addition, Quantum will develop a comprehensive quality plan for all Products as specified in Attachment A. Quantum will maintain accurate and legible records of all Product manufacturing methods and specifications. If Quantum fails to achieve the Quality Goals, Quantum will promptly put into place a corrective action plan, as agreed to in writing by Dell, designed to bring Quantum's quality performance back into conformity with the Quality Goals. Notwithstanding any other provision in this Agreement, if Quantum fails to meet the Quality Goals, within forty-five (45) Days after written notice to Quantum, Dell may cancel any outstanding Orders without any liability whatsoever. If Quantum fails to meet the Quality Goals, then Quantum shall refund, repair or replace Products that fail to meet Quality Goals; provided, however, that nothing in this Section 3.4 shall in any way limit the warranty provisions stated in Section 8 or the epidemic failure and Product Hazards provisions set forth in Section 10 and Attachment A. During the term of this Agreement, Quantum will grant Dell reasonable access to and Dell may audit any information reasonably requested by Dell with respect to Quantum's quality performance under this Agreement (see Section 23.1 of this Agreement).

During the term of this Agreement, Company will grant Avocent reasonable access to and Avocent may audit any information reasonably requested by Avocent with respect to Company’s quality performance under this Agreement (see Section 10.1 of this Agreement).
Quality Goals. Pharmacy Benefit Manager will credential each pharmacy or network of pharmacies which becomes a Participating Pharmacy under this Agreement, and will re-credential such Participating Pharmacies every two (2) years. All such credentialing will comply with the requirements of the URAC. Pharmacy Benefit Manager will also take commercially reasonable steps to respond to any quality issues that come to its attention regarding any Participating Pharmacy.

The Trust and State Street have developed mutually acceptable performance goals dated March 1, 2011 , and as may be amended from time to time, regarding the manner in which they expect to deliver and receive the services under this Agreement (hereinafter referred to as “Service Level Agreement”).   • Milestones Subject to the provisions of the SGIP, the Parties shall agree on milestones for which each Party is responsible and list them in Attachment 4 of this Agreement. A Party’s obligations under this provision may be extended by agreement.
