Qualified Operator. Seller or an Affiliate of Seller shall operate and maintain the Facility or cause the Facility to be operated and maintained by an entity that has at least two (2) years of experience in the operation and maintenance of similar facilities of comparable size and characteristics to the Facility. Seller must provide PacifiCorp thirty (30) days prior notice of any change in the operator of the Facility.
Qualified Operator. It is the Operator that has been declared as such, on the grounds that it has proved that it complies with the technical requirements of the Tender Qualification or whoever happens to succeed it, according to the Agreement. It is the holder of the Minimum Share.
Qualified Operator. From and after the Commercial Operation Date, Seller or an Affiliate of Seller shall itself operate the Facility or cause the Facility to be operated by an entity that has at least two years of experience in operation of solar energy facilities of comparable size to the Facility. Seller shall provide PacifiCorp 30 days prior written notice of any change in operator.
Qualified Operator. From and after the Commercial Operation Date, Seller or an Affiliate of Seller shall itself operate and maintain the Facility or cause the Facility to be operated and maintained by an entity, approved by PacifiCorp (such approval not to be unreasonably withheld, conditioned or delayed), that has at least two years of experience in operation and maintenance of wind energy facilities of comparable size to the Facility. Seller shall provide PacifiCorp thirty (30) days prior written notice of any proposed change in the operator of the Facility.
Qualified Operator. Legal person that complies with the technical Tender qualification requirements. In the CONCESSIONAIRE’s shareholding structure, the Qualified Operator shall have and maintain the ownership of the Minimum Participation.
Qualified Operator. From and after the Commercial Operation Date, Seller or an Affiliate of Seller shall itself operate the Facility or cause the Facility to be operated by an third party entity. Seller shall provide PacifiCorp 30 days prior written notice of any change in operator.
Qualified Operator. Operator is qualified to obtain any Permits and Environmental Permits necessary for Operator to operate the Facilities as of the Turnover Date. Without limiting the foregoing, Operator is not aware of any reason or circumstance that would prevent Operator from procuring the Operator Required Regulatory Approvals.
Qualified Operator. On or before March 30'", 2012 Farmee must obtain approval to hold EUB Licences ("Operator Status") from the Alberta Energy and Utilities Board. Farmee shall provide the Farmor with documentation supporting the operator status prior to the spud date of the Test Well. If the Fannee has not obtained Operator Status, this Agreement will terminate and the non performance penalty as set out in Clause 6 will be in effect.
