Thus, it is ultimately a guarantee of the student’s freedom to learn. Nothing in this procedure should be construed as an attempt to alter the contractual relationship between the professor and the university or to alter the nature of tenure as traditionally conceived and legally defined in the American academic community. Nor is this procedure intended as a mechanism for reevaluating or revalidating tenure. Thus, a tenured professor cannot be required to remake his or her case for tenure or otherwise to reassume the burden of proof that he or she bore in the original tenure proceedings. Purpose and Principles. The purpose of this Article is to provide a mutually acceptable method for prompt and equitable settlement of grievances. Employee(s) and their representatives will be free from restraint, interference, coercion, discrimination, or reprisal in airing a grievance and seeking its adjudication. The Employer and the Union recognize the importance of settling grievances promptly, fairly, and in a manner that will maintain the self-respect of the employee(s) and be consistent with the principles of management. To accomplish this, and because most grievances arise from misunderstandings or disputes that can be settled promptly and satisfactorily on an informal basis at the immediate supervisory level, every effort will be made to settle grievances expeditiously and at the lowest level of supervision.
