Public Space. The Licensor reserves the right to use dining areas and other public spaces at other than serving periods, for meetings of Licensor employees or other assemblies. After each use, the Licensor will clean and rearrange the space without expense to the Licensee.

Project Support: Participants will state that that they support the ZC Case and the Project, as indicated by filing a letter with Advisory Neighborhood Commission 1B. Also, Participants will state that they support the ZC Case and the Project, as indicated by filing a letter with the Zoning Commission on or before December 10, 2015 and/or testifying at the Zoning Commission public hearing on December 10, 2015. No Interference: Participants will not directly or indirectly oppose or appeal any of the Project’s entitlements. ZONING COMMISSION District of Columbia CASE NO.15-03 EXHIBIT NO.54 Agreement Effect: Except for Project Support, the agreement will be effective after Advisory Neighborhood Commission 1B recommendation of approval and Zoning Commission approval of the ZC Case and after all appeal periods for the Zoning Commission Order have expired. If the Zoning Commission denies or does not approve the ZC Case, then the agreement shall be null and void. Similarly, if the D.C. Court of Appeals reverses, remands, overturns, or vacates the Order on appeal such that Aria cannot construct the Project as proposed, then the agreement shall be null and void.
Public Space. (a) There shall be a public deck at the rear of the building, which shall be in reasonable accordance with the area and location as shown on Schedule B.
Public Space. In the event MATCH reserves and uses Hotel's public space, the Hotel shall provide free of charge to MATCH the furnishings, accessories, space and services that are customarily available at no cost to the Hotel guests. All other services associated with the use of public space shall be charged at rates not to exceed the rates customarily applied to the same services charges in June 2009.
