Public Safety and Convenience. The safety of the public and the convenience of traffic are of prime importance under this agreement. Unless otherwise provided, the Provider’s performance of this agreement shall not interfere with traffic on the roadway. Unless coordinated with the state, the Provider shall work only during daylight hours and no work will be performed on Sundays or State observed holidays.

Public Safety and Convenience. The Contractor shall at all times so conduct their work as to insure the least possible obstruction to traffic and inconvenience to the general public and the residents in the vicinity of the work, and to insure the protection of persons and property in a manner satisfactory to the Engineer. No road or street shall be closed to the public except with the permission of the Engineer and proper governmental authority. Fire hydrants on or adjacent to work shall be kept accessible to fire fighting equipment at all times. Temporary provisions shall be made by the Contractor to insure the use of sidewalks and the proper functioning of all gutters, sewer inlets, drainage ditches, and irrigation ditches, which shall not be obstructed except as approved by the Engineer.

Contractor shall conduct its operations so as not to close or obstruct any portion of any highway, road, or other property without a permit or permission from the appropriate authorities or owners. If any highway, road or other property is required to be kept open or is rendered unsafe by Contractor’s operations, Contractor shall at its own expense make repairs and provide temporary barricades, guards, bridges, flaggers, lights, and other signals as shall be acceptable to the authorities having jurisdiction.

This requirement shall include, but is not limited to, the maintenance of traffic, access to fire hydrants, use of sidewalks and public and private driveways, and the proper functioning of existing private and public facilities such as gutters, drains, ditches, natural water courses and the like. Where construction consists of replacement of, or modification to, existing facilities such as existing sewer or water lines, pumping facility or treatment works, the Owner shall provide for the normal maintenance and operation of such facilities during construction. The Owner shall obtain prior approval from the Association, the affected owners and the proper governmental authority to obstruct traffic or to disturb any existing private or public facility.

When the project involves use of public ways, the Design- Builder shall provide certified Flaggers when directed, a temporary traffic control plan approved by the Engineer, and shall install and maintain means of free access to all property. Private residential driveways shall be closed only with approval of the Engineer or specific permission of the property owner. The Design-Builder shall not interfere with normal operation of public transit vehicles unless otherwise authorized. The Design-Builder shall not obstruct or interfere with travel over any public street or sidewalk without approval. Where detours are necessary, they shall be maintained with good surface and shall be clearly marked. The Design-Builder shall provide open trenches and excavations with adequate barricades of an approved type that can be seen from a reasonable distance. At night, the Design-Builder shall backfill all open work and mark areas with signs and lighted barricades (Type A Low Intensity Flashing Warning Light on a Type I or II barricade, typical) in accordance with the Manual of Uniform Traffic Control Devices (MUTCD). The Design-Builder shall install and maintain all necessary signs, lights, flares, barricades, railings, runways, stairs, bridges, and facilities. The Design-Builder shall observe all safety instructions received from the Engineer or governmental authorities, but following of instructions shall not relieve the Design-Builder from the responsibility or liability for accidents to workers or damage or injury to persons or property. Emergency traffic such as police, fire, and disaster units shall be provided reasonable access to the work area at all times. The Design-Builder shall be liable for any damages that may result from failure to provide reasonable access or failure to notify the appropriate authority. Public Safety and Convenience. The Contractor is solely responsible for ensuring that all work performed under this agreement is conducted in a safe manner and that all employees performing work for the contractor have received safety training on a regular and consistent basis and is in compliance with OSHA and other regulatory provisions. Damages to public or private property. Any damage of public or private property caused by the Contractor's operations shall be resolved with the property owner within ten (10) days after damage occurs to the satisfaction of the Village. The Contractor shall inform the Village of any damage caused by the Contractor's operation on the day such damage occurs. Should the damage not be rectified within the time frame agreed upon or to the satisfaction of the Village, the Village reserves the right to repair or replace that which was damaged or assess the Contractor such cost as may be reasonable and related to damaged caused by the Contractor, and deduct these costs from any payment due the Contractor.

Temporary provisions shall be made by the contractor to insure the usability of sidewalks and the proper functioning of all gutters, sewer inlets and drainage ditches.
