Common use of Public Improvements Clause in Contracts

Public Improvements. Required public improvements shall be designed and constructed to City standards by Owner at Owner’s expense. Owner further agrees to provide financial guarantees for construction of all required improvements as set forth in each phase of the development, and to dedicate to the City any or all of the improvements as required by City ordinances. The public improvements and financial guarantee shall be set forth in a Development Agreement between the City and Owner.

Owner further agrees to provide financial guarantees for construction of all required improvements as set forth in each phase of the development, and to dedicate to the City any or all of the improvements as required by City ordinances. The public improvements and financial guarantee shall be set forth in a the Development Agreement between the City and Owner.

Public Improvements. Required All public improvements required to serve the Project shall be designed and constructed to City Town standards by Owner and at Owner’s ’s, or a developer’s, expense. Owner further agrees to provide financial guarantees in the form of a bond, letter or credit or similar for construction of all required improvements as set forth in each phase of the development, amount required by the Town and to dedicate to the City Town any or all of the improvements as required by City ordinancesTown ordinances or as otherwise agreed. The public improvements and financial guarantee guarantees shall be set forth in a Development Agreement subsequent agreement for each filing between the City Town and Owner. All overhead utility lines shall be undergrounded.
