Prudent and Reasonable Shipper a Shipper acting in good faith with the intention of executing its contractual obligations and who, for this purpose, applies the skills, attentiveness, prudence and foresight that are reasonably and usually applied by a competent and experienced professional acting in accordance with the laws and regulations in similar circumstances and conditions. R Recipient: legal entity or individual to which/whom the Gas is delivered by GRTgaz at a Delivery Point or at a Title Transfer Point pursuant to the Contract. For a given Delivery Point, a Recipient is a party to a Connection Contract or an Interconnection Contract with GRTgaz. For a Title Transfer Point, the Recipient is the shipper to which the Gas is delivered. Reduced Daily Imbalance: quantity of energy, expressed in MWh (GCV 25°C), as defined in the Clause entitled “Calculating Daily Imbalances” in Section D2.

  • Fair and Reasonable The Contractor has carefully examined and analyzed the Site, the Contract Documents, and all known factors related to his ability to complete this project within the Contract Time stipulated. By submitting his bid for this project, the Contractor agrees that the stipulated Contract Time is fair and reasonable.

  • Clear and Reasonable Warning As of the Effective Date, and continuing thereafter, a clear and reasonable exposure warning as set forth in this §§ 2.3 and 2.4 must be provided for all Products that Xxxxxxx manufacturers, imports, distributes, sells, or offers for sale in California that is not a Reformulated Product. There shall be no obligation for Xxxxxxx to provide an exposure warning for Products that entered the stream of commerce prior to the Effective Date. The warning shall consist of either the Warning or Alternative Warning described in §§ 2.3(a) or (b), respectively:

  • Industrial Accident and Illness Leave shall be granted for illness or injury incurred within the course and scope of an employee's assigned duties. These facts or inferences would lead the reasonable person to suspect that the employee is or has been using drugs while on or off duty.

  • Reasonable Suspicion Testing The Employer may, but does not have a legal duty to, request or require an employee to undergo drug and alcohol testing if the Employer or any supervisor of the employee has a reasonable suspicion (a belief based on specific facts and rational inferences drawn from those facts) related to the performance of the job that the employee:

  • Requirement to Work Reasonable Overtime The Employer may require any Employee to work reasonable overtime at overtime rates and such an Employee shall work overtime in accordance with the requirement.
