Common use of PROVISIONS SURVIVING TERMINATION Clause in Contracts

PROVISIONS SURVIVING TERMINATION. It is expressly agreed that notwithstanding termination of Employee's employment with and by the Company for any reason or cause or in any circumstances whatsoever, such termination shall be without prejudice to the rights and obligations of Employee and the Company, respectively, in relation to or arising up to the time of and including the date of termination, and the provisions of Sections 8, 9, 10, 11, 12, 16, 17, 19, 20, 21 and 22 of this Agreement, all of which shall remain and continue in full force and effect unless and until the board of directors of the Company at its absolute discretion resolves otherwise and so notifies Employee in writing.

It is expressly agreed that notwithstanding termination of Employeethe Executive's employment with and by the Company Corporation for any reason or cause or in any circumstances whatsoever, such termination shall be without prejudice to the rights and obligations of Employee the Executive and the CompanyCorporation, respectively, in relation to or arising up to the time of up to and including the date of termination, ; and the provisions of Sections 88(c) and (d), 9, 10, 11, 12, 1615, 17, 19, 20, 21 17 and 22 18 of this Employment Agreement, all of which shall remain and continue in full force and effect unless and until the board of directors of the Company Corporation at its absolute discretion resolves otherwise and so notifies Employee the Executive in writing.

It is expressly agreed that notwithstanding termination of Employee's employment engagement of the Contractor with and by the Company for any reason or cause or in any circumstances whatsoever, such termination shall be without prejudice to the rights and obligations of Employee the Contractor and the Company, respectively, in relation to or arising up to the time of and including the date of termination, and the provisions of Sections 8, 9, 10, 11, 12, 16, 17, 19, 20, 21 20 and 22 of this Agreement, all of which shall remain and continue in full force and effect unless and until the board of directors of the Company at its absolute discretion resolves otherwise and so notifies Employee the Contractor in writing.
