Provision of Application of Programming Interfaces. Where applicable, FOMO Pay shall provide the application programming interfaces (“API”) and other software to enable the Merchant to use the Service. FOMO Pay reserves the right to require the Merchant to install or update any and all software to continue using the Service. Our Service also may include software to help the Merchant manage recurring and subscription billing charges for the Merchant’s products and services. It is the Merchant’s responsibility to obtain the Merchant’s customers’ consent to be billed on a recurring basis in compliance with applicable legal requirements.
