Protection of people and property. 18.1 The Developer is to ensure to the fullest extent reasonably practicable in relation to the carrying out of any Work that: 18.1.1 all necessary measures are taken to protect people and property, and 18.1.2 unnecessary interference with the passage of people and vehicles is avoided, and 18.1.3 nuisances and unreasonable noise and disturbances are prevented.

Protection of people and property a. Insofar as compliance with the Sub-Contract permits, the Sub-Contractor must take measures necessary to protect people and property. b. If the Sub-Contractor damages property, the Sub-Contractor must immediately rectify the damage and pay any compensation which a Legislative Requirement requires the Sub-Contractor to pay. c. Protection of people and property. In the performance of the work under a Purchase Order Contract the Contractor must take all measures and provide all things necessary to protect people and property. If the Contractor or its subcontractors, employees or agents damage any property, including property on or adjacent to the Site, the Contractor shall promptly make good the damage and pay any compensation which the Contractor is required by law to pay.

Protection of people and property. (a) Without limiting any other obligation of the Participants under this Agreement, the Participants are committed to protecting both people and property when carrying out the Works, and must take all action to ensure this commitment is met including: (i) providing all Materials, procedures and training and taking all measures necessary to protect people and property; (ii) avoiding unnecessary interference with the passage of people and vehicles; (iii) except to the extent necessary in relocating, replacing or protecting any Utility Service, avoiding damage, obstruction or other interference with any Utility Service or other similar services to the Site; (iv) minimising the effect of the Works on the aesthetic qualities of the Environment and social activities of local community members; (v) eliminating nuisance including implementing appropriate dust control measures and avoiding unnecessary noise and disturbance; and (vi) preventing unlawful environmental damage or Pollution. (b) The Participants' responsibilities include the provision of barricades, guards, fencing, temporary roads, warning signs, lighting, traffic flagging, safety helmets, training of personnel and clothing, removal of obstructions and protection of Utility Services of the kind referred to in paragraph (a).

Protection of people and property. The Contractor will operate and maintain a health and safety management system for all Works which specifies the specific health and safety processes, practices and procedures for the Works. The contractor health and safety management system will include:

(b) The Participants' responsibilities include the provision of barricades, guards, fencing, temporary roads, warning signs, lighting, traffic flagging, safety helmets, training of personnel and clothing, removal of obstructions and protection of services of the kind referred to in clause 19.5(a). (c) The Participants must ensure that an independent audit (being an audit undertaken by a suitably qualified and experienced auditor who is not, , an Associate of a Participant or any Subcontractors) is undertaken in respect of: (1) the Health and Safety Management Plan to be included as part of the Project Management System to ensure that when implemented, the plan will: (A) comply with the requirements of the Safety Legislation and this Agreement; and (B) control the health and safety risks associated with the Works, prior to the Participants submitting it for approval in accordance with clause 19.10(a)(2); and (2) compliance with the Health and Safety Management Plan included as part of the Project Management System, within 3 months of commencement of the Works and at intervals not exceeding 6 months thereafter.

Protection of people and property. (a) The Developer must use all reasonable endeavours to ensure that, in relation to the performance of its obligations under this Agreement: (i) all necessary measures are taken to protect people and property; (ii) unnecessary interference with the passage of people and vehicles is avoided; and (iii) nuisances and unreasonable noise and disturbances are prevented. (b) In relation to those Items of Work located on Designated Lands, the Developer is responsible for care of those Works until the Designated Lands are dedicated to Council in accordance with clause 4.3 or clause 13, after which those Items of Work will vest in Council.

Without limiting the generality of the Contractor’s obligations, they include the provision of barricades, guards, fencing, temporary roads, footpaths, warning signs, lighting, watching, traffic flagging, safety helmets and clothing, removal of obstructions and protection of services. If the Contractor fails to comply with an obligation under Clause 15 the Principal may, in addition to any other remedy, perform the obligation on the Contractor’s behalf and the cost incurred by the Principal shall be a debt due from the Contractor to the Principal.
