Protection and Safety. The Subcontractor shall (a) take necessary precautions to protect properly the Work of other subcontractors from damage caused by operations under this Subcontract; (b) take reasonable safety precautions with respect to performance of this Subcontract; (c) comply with safety measures initiated by the Contractor and with applicable laws, ordinances, rules, regulations and orders of public authorities for the safety of persons or property in accordance with the requirements of the General Contract; and (d) immediately report to the Contractor any injury to an employee or agent of the Subcontractor which occurs at the site.

(a) Prior to the Substantial Completion Date, Contractor shall be responsible for the security, protection and safety of all Persons (including members of the public and the employees, agents, contractors, consultants and representatives of Company, Contractor and its Subcontractors and Vendors, and other contractors and subcontractors) and all public and private property (including structures, sewers and service facilities above and below ground, along, beneath, above, across or near the Job Site) that are at or near the Job Site or that are in any manner affected by the performance of the Work. Upon successful achievement of Substantial Completion and notwithstanding the foregoing, Contractor shall remain responsible for the security, protection and safety of all Persons performing any portion of the Work at the direction of Contractor.

Protection and Safety. 3.15.1 Prior to the Provisional Acceptance Date, Contractor shall be responsible for the security, protection and safety of all Persons (including members of the public and the employees, agents, contractors, consultants and representatives of FPL, the Financing Parties, Contractor and its Subcontractors and Vendors, and other contractors and subcontractors) and all public and private property (including structures, sewers and service facilities above and below ground, along, beneath, above, across or near the Job Site) that are at or near the Job Site or that are in any manner affected by the performance of the Work. As of the Provisional Acceptance Date, FPL shall have operational control over the Project. Notwithstanding the foregoing, Contractor shall remain responsible for the security, protection and safety of all Persons performing any portion of the Work at the direction of Contractor as well as any damage to property caused directly or indirectly by Contractor’s negligent acts or omissions and/or failure to comply with the provisions of the Contract Documents while on the Job Site.

Developer shall take such reasonable actions as are necessary to maintain adequate protection of the Improvements and other property at the site or adjacent thereto from damage, injury or loss, and shall coordinate with the Contractor in taking all reasonable precautions for the safety of persons performing work on the Improvements or visiting the construction site for any purpose in connection with the development of the Improvements. Developer shall require the Contractor and all subcontractors to comply with all applicable provisions of federal, state and local safety laws and building codes and standards.
