Where the label for the product is not printed using the color yellow, the symbol may be printed in black and white. The symbol shall be placed to the left of the text of the warning, in a size no smaller than the height of the word “WARNING”. Additionally, if the Product contains consumer information in a foreign language, the warning must be proVided in the foreign language. The Products shall carry said warning directly on each unit, label, or package, with such conspicuousness as compared with other words, statements or designs as to render it likely to be read and understood by an ordinary consumer prior to sale. A Product that is sold by Duelle on the internet to persons located in California shall also proVide the warning message by a clearly marked hyperlink on the product display page, or otherwise prominently displayed to the purchaser before the purchaser completes his or her purchase of the Product. For Products that Duelle proVides for a downstream entity to sell on the internet, Duelle shall include an instruction that the entity comply with the warning requirements of this section.
Proposition 65 Warnings. A Clear and Reasonable Warning under this Consent Judgment shall state either: WARNING: This product contains a chemical known to the State of California to cause birth defects or other reproductive harm. Or WARNING: This product contains a chemical known to the State of California to cause cancer and birth defects or other reproductive harm. A Clear and Reasonable Warning shall not be preceded by, surrounded by, or include any additional words or phrases that contradict, obfuscate or otherwise undermine the warning. For internet, catalog or any other sale where the consumer is not physically present and cannot see a warning displayed on the Covered Product or the packaging of the Covered Product prior to purchase or payment, the warning statement shall be displayed in such a manner that it is likely to be read and understood prior to the authorization of or actual payment. For internet sales, the warning statement shall: (a) be displayed before a consumer commits to purchasing the Covered Product and without the need for the consumer to follow any additional hyperlinks beyond those required as part of the ordinary purchasing process; (b) be set out in a text, box on a separate line or in a separate paragraph; (c) be displayed in a font size in which the smallest character is no less than the equivalent of the height of the equivalent characters in 12 point arial font; and (d) be displayed with such conspicuousness, as compared with other words, statements, or designs as to render it likely to be read and understood by an ordinary individual. The warning statement shall not be preceded, followed, or surrounded by words, symbols, or other matter that reduces its conspicuousness to an ordinary individual, or that qualifies or interprets the required text, such as “legal notice required by law.”

Where the label for the product is not printed using the color yellow, the symbol may be printed in black and white. The symbol shall be placed to the left of the text of the warning, in a size no smaller than the height of the word “WARNING”. The Products shall carry said warning directly on each unit, label, or package with such conspicuousness as compared with other words, statements or designs as to render it likely to be read and understood by an ordinary consumer prior to sale. A Product that is sold by MSC on the internet to persons located in California shall also provide the warning message by a clearly marked hyperlink on the product display page, or otherwise prominently displayed to the purchaser before the purchaser completes his or her purchase of the Product.

Where the label for the Non-Reformulated Product is not printed using the color yellow, the symbol may be printed in black and white. The symbol shall be placed to the left of the text of the warning, in a size no smaller than the height of the word “WARNING”. If IG Design has reason to believe the Non-Reformulated Products may expose consumers to additional chemicals listed under Proposition 65, then it may replace “Lead which is” with “chemicals, including Lead, which are” in the warning statement. The Non-Reformulated Products shall carry said warning directly on each unit, label, or package, with such conspicuousness as compared with other words, statements or designs as to render it likely to be read and understood by an ordinary consumer prior to sale.

Proposition 65 Warnings. 2.2.1 Subject to Section 2.1.2 and commencing as of the Compliance Date, for any Product that is not a Reformulated Product, such Product shall be accompanied by a clear and reasonable warning. Such warning shall be prominently placed in relation to the Product with such conspicuousness when compared to other words, statements, designs, or devices as to render it likely to be read and understood by an ordinary individual under customary conditions of purchase. World and Main shall provide the following warning statements (or other warnings consistent with applicable regulations governing such warnings) on the unit packaging of such Product, on the Labeling (as defined in 27 Cal. Code Regs., section 25600.1, operative Aug. 30, 2018) of such Product, shelf tag, or affixed to the Product, as applicable. Any Product sold by World and Main on the internet shall also provide the warning message by a clearly marked hyperlink on the product display page, or otherwise prominently displayed to the purchaser before the purchaser completes his or her purchase of the Product. For Products manufactured before August 30, 2018: WARNING: This product contains chemicals known to the State of California to cause cancer and birth defects or other reproductive harm. For Products manufactured on or after August 30, 2018: WARNING: This product can expose you to chemicals, including [lead and/or DEHP and/or DBP]1, which are known to the State of California to cause cancer and birth defects or other reproductive harm. For more information go to xxx.X00Xxxxxxxx.xx.xxx. The warning for Products manufactured on or after August 30, 2018 shall be accompanied by a symbol consisting of a black exclamation point in a yellow equilateral triangle with a bold black outline, provided, however, that where the label or shelf tag for the product is not printed using the color yellow, the symbol may be printed in black and white. The symbol shall be placed to the left of the text of the warning, in a size no smaller than the height of the word “WARNING”. Notwithstanding the foregoing, the warning required for Products manufactured on or after August 30, 2018 may be used by World and Main on any Products manufactured before that date.
Proposition 65 Warnings. 2.2.1 For any Products sold or offered for sale directly to California consumers via the xxxx.xxx website for which Xxxx has received written notification from a Third-Party Seller, or for which it has Actual Knowledge, as that term is defined in 27 CCR § 25600.2(f), that the Product may cause a consumer exposure to Lead, Temu shall provide an Internet warning for such Products by including the warning set forth below, prominently displayed to the California purchaser, on one or more of the following: (a) on the Product display page; or (b) on one or more web pages displayed to a purchaser during the checkout process. The internet warning described above can also be delivered through a clearly marked hyperlink prominently displayed to the California purchaser using the words “California Prop 65 WARNING” which then takes the user to a display of the warning as follows:

Proposition 65 Warnings. A Clear and Reasonable Warning under this Agreement shall state: WARNING: This product contains a chemical known to the State of California to cause cancer. A Clear and Reasonable Warning shall not be preceded by, surrounded by, or include any additional words or phrases that contradict, obfuscate, or otherwise undermine the warning. The warning statement shall be prominently displayed on the Covered Product or the packaging of the Covered Product with such conspicuousness, as compared with other words, statements, or designs, as to render it likely to be read and understood by an ordinary individual prior to sale. For internet, catalog, or any other sale where the consumer is not physically present and cannot see a warning displayed on the Covered Product or the packaging of the Covered Product prior to purchase or payment, the warning statement shall be displayed in such a manner that it is likely to be read and understood prior to the authorization of or actual payment. For such sales, Giga shall secure compliance with this provision by, on or before the Effective Date, notifying any internet or catalog sellers for which it drop-ships Covered Products of the need to provide a Clear and Reasonable Warning to California residents prior to purchase of Covered Products in which the fabric has been Treated with any Listed Chemical Flame Retardant. Giga shall be deemed to comply if such notification is given to internet or catalog sellers, even if such internet or catalog sellers do not subsequently provide warning prior to purchase or payment.
