Promotion Rights. For the avoidance of doubt, Astellas and its Affiliates shall have the right to co-promote the Products with any other Person(s) (in addition to Ambit), or to appoint one or more Third Parties to promote the Products without Astellas, (a) in all or any part of the Territory outside the U.S., or (b) in the U.S. with respect to any Product for which the Required Exercise Date has occurred and Ambit has not exercised the Co-Promotion Option or the applicable Co-Promotion Term has expired or terminated.

Promotion Rights. It is understood and agreed that seniority in promotions shall apply to departments as follows: Residence Life/food service employees; Residence Life/custodians; Strand Union/food service employees; and Facilities Services/maintenance employees and seniority shall not be transferable between departments except as follows.
Promotion Rights. Subject to the prior written permission of Client in each instance, the parties agree that upon the transfer of the Work Product to Client as described in subsection (ii) above, Agency is hereby granted a non-exclusive, perpetual, worldwide, revocable right to display and incorporate portions of the Work Product in, or as part of, Agency's professional portfolio, as that portfolio may be offered or displayed by Agency in any medium, media or format desired by Agency (<Right of Promotion=). This Right of Promotion shall also include the right (a) to submit the Work Product on Agency's behalf to various industry competitions relevant to Agency's business and/or the digital marketing / advertising industry in general; provided, however, that Client is referenced in any submission as the current owner of the Work Product, and (b) to use Client's name, trademark, and biographical information for purposes of inclusion in Agency's professional portfolio as described herein. Other than the Right of Promotion described herein, Agency shall not use the Work Product (post-transfer to Client) for any other purpose.

Promotion Rights. For the avoidance of doubt, (i) Roche and its Affiliates shall have the right to co-promote the Licensed Products with any other Person(s) or to appoint one or more Third Parties to promote the Licensed Products without Roche, in all or any part of the Roche Territory, and (ii) each Party and its Affiliates shall have the right to (A) co-promote the Licensed Products with any other Person(s) (in addition to the other Party), or (B) appoint one (1) or more Third Parties to promote the Licensed Products in the Shared Territory, provided in the case of either (A) or (B) it is in accordance with the Joint Commercialization Plan or as otherwise approved by the JCC or JSC.
Promotion Rights. Subject to this Section 5.1 (and any restrictions on Launch set forth therein), both Parties shall have the right to Promote the Combination Product in each country in the Territory (other than any Third Party Distributor Country, in which country neither Party shall Promote the Combination Product without the written consent of the other Party); provided, that the non-Sole Promoting Party shall have the right to Promote the Combination Product in the other Party’s Sole-Promote Countries pursuant to this Section 5.1(c) only. With respect to any Sole-Promote Country, the non-Sole Promoting Party shall have the right to commence co-Promotion of Territory Combination Product in such country upon ninety (90) days’ written notice to the Sole Promoting Party, which notice shall specify the date on which such non-Sole Promoting Party intends to commence such Promotion; provided, that such non-Sole Promoting Party shall not have the right to commence such co-Promotion until the date on which such non-Sole Promoting Party has established an HIV sales force in such country. Upon such notice, the Parties shall negotiate in good faith and, prior to the anticipated date on which such non-Sole Promoting Party (or any of its Affiliates) will commence co-Promotion of the Combination Product in such country, enter into (i) a Co-Promotion Agreement (as defined below) with respect to such country, and (ii) any appropriate amendments to this Agreement and any other applicable Covered Agreement then in effect, including the Financial Agreement, to reflect such non-Sole Promoting Party’s co-Promotion of the Combination Product in such country, including any updates to the Commercialization Plan and the Commercialization Budget, if applicable, for such country commencing as of the date on which such non-Sole Promoting Party commences co-Promotion of the Combination Product in such country.
Promotion Rights. Client and GlobalLogic acknowledge GlobalLogic, with the prior written consent of Client’s Chief Marketing Officer may publicize its consulting relationship with Client for the purpose of marketing and promotion, including by issuing a press release indicating the relationship or by mentioning such relationship on the GlobalLogic website (in each case by disclosing Client’s name, general information and/or a link to Client’s website).
