Promotion Out of Bargaining Unit. An employee promoted permanently to an excluded position shall cease to be covered by the terms of this Agreement. The employee may within two (2) years return to a position of equal classification and pay rate without loss of their rights and privileges under this Agreement. However, after an absence of one (1) year, the regular continuing employee's position shall be considered to be vacant and shall be posted as a regular continuing position. Except as provided in this article, excluded employees shall have no placement rights within the bargaining unit.

Promotion Out of Bargaining Unit. If an employee is promoted to a position in the department not included in the bargaining unit and is thereafter returned to a position within the bargaining unit, he or she shall have accumulated departmental and classification seniority while working in the position to which he or she was promoted except as provided in (i) and (ii) below.
Promotion Out of Bargaining Unit. In the event of an employee being promoted from a position for which the Union either had bargaining authority at the time of the promotion or subsequently obtained bargaining authority, to a position whether included in or excluded from the Union contract, and such employee being subsequently laid off or demoted to a position for which the Union has bargaining authority, the Employer shall have the right to place such employee in the position previously held by the employee or in any vacant position for which such employee is considered qualified. The employee, if so placed as the result of being laid off or demoted, shall suffer no loss of seniority and such seniority shall be the employee's total length of service with the Employer.
Promotion Out of Bargaining Unit. An employee who is promoted to a position outside the bargaining unit shall be entitled to a trial period of ninety (90) days. At the end of this trial period, they shall either return to the position held prior to the promotion or lose their seniority. An employee may invoke this right only one (1) time per Agreement. An employee who is promoted outside the bargaining unit to replace an employee who is pregnant shall have this period extended to nine (9) months. The total period shall not exceed twelve (12) months. As long as the employee retains their right to return to the bargaining unit, they shall continue to pay Union dues. An employee shall have the right to waive such entitlement, following which the employee will automatically lose their seniority and shall not pay Union Dues. An employee (that has not waived his seniority) who decided to return to the position, shall be reinstated in their original position, and the Employer shall be authorized to demote or lay-off the less senior employee.
Promotion Out of Bargaining Unit. For promotions out of the bargaining unit, first consideration shall be given to the highest-ranking member of the bargaining unit.
