Common use of Project Design Clause in Contracts

Project Design. Seller shall determine the proposed location, design, and configuration of the Facility as it deems appropriate, subject to the Requirements and the requirements of the Ancillary Documents, including the characteristics and other requirements for the Facility set forth in Appendix B-1, and also subject to any conditions imposed by the lead agency or any responsible agency as part of the CEQA review of the Facility and which Seller deems acceptable.

Project Design. Seller shall determine the proposed location, design, and configuration of the Facility as it deems appropriate, subject to the Requirements and the requirements of the Ancillary DocumentsRequirements, including the characteristics and other requirements for the Facility set forth in Appendix B-1, and also subject to any conditions imposed by the lead agency or any responsible agency as part of the CEQA review of the Facility and which Seller deems acceptableFacility.

Project Design. Seller shall determine the proposed location, design, and configuration of the Facility as it deems appropriate, subject to the Requirements and the requirements of the Ancillary DocumentsRequirements, including the characteristics and other requirements for the Facility set forth in Appendix B-1, and also subject to any conditions imposed by the lead agency or any responsible agency as part of the CEQA review of the Facility and which Seller deems acceptable. The Facility shall accommodate grid charging of the XXXX.

Seller shall determine the proposed location, design, and configuration of the Facility as it deems appropriate, subject to the Requirements and the requirements of the Ancillary Documents, including the characteristics and other requirements for the Facility set forth in Appendix B-1B-1A or Appendix B-2A, as applicable, and also subject to any conditions imposed by the lead agency or any responsible agency as part of the CEQA review or NEPA review, if applicable, of the Facility and which Seller deems acceptable.

Seller shall determine the proposed location, design, and configuration of the Facility as it deems appropriate, subject to the Requirements and the requirements of the Ancillary DocumentsRequirements, including the characteristics and other requirements for the Facility set forth in Appendix B-1B, and also subject to any conditions imposed by the lead agency or any responsible agency as part of the CEQA review of the Facility and which Seller deems acceptableFacility.

Project Design. Seller shall determine the proposed location, design, configuration and configuration capacities of the Facility as it deems appropriate, subject only to the Requirements and the requirements of the Ancillary DocumentsRequirements, including the characteristics and other requirements for the Facility set forth in Appendix B-1B, and also subject to any conditions which are imposed by the lead agency or any responsible agency Governmental Authority as part of the CEQA environmental review of the Facility required under applicable federal and which Seller deems acceptableNevada law.

Project Design. Seller shall determine the proposed location, design, configuration, and configuration capacity of the Facility as it deems appropriate, subject only to the Requirements and the requirements of the Ancillary Documentsthe‌ Requirements, including the characteristics and other requirements for the Facility set forth in Appendix B-1B, and also subject to any conditions which are imposed by the lead agency or any responsible agency Governmental Authority as part of the CEQA environmental review of the Facility required under applicable Federal and which Seller deems acceptableNevada law.
