Program Overview. A. Goals of the Choice Neighborhoods Program. The Choice Neighborhoods Program employs a comprehensive approach to neighborhood transformation. The program transforms neighborhoods of concentrated poverty into mixed-income neighborhoods of long-term viability by revitalizing severely distressed public and/or assisted housing; improving access to economic opportunities; and investing and leveraging investments in well-functioning services, effective schools and education programs, public assets, public transportation, and improved access to jobs. Choice Neighborhoods ensures that current residents benefit from this transformation by preserving affordable housing in the neighborhood or providing the choice to move to affordable housing in another neighborhood of opportunity. The purpose of this grant is to implement a Transformation Plan that has been developed through a local planning process and furthers the goals of the Choice Neighborhoods Program. Program Overview. Section 70.1 prescribes the “Program Overview” of a Title V (Part 70) program, while Section 70.2 provides definitions. According to Section 70.1 (b), “All sources subject to these regulations shall have a permit to operate that assures compliance by the source with all applicable requirements.” According to 40 CFR §70.1 (c), “No permit, however, can be less stringent than necessary to meet all applicable requirements.” “Applicable Requirement” is defined within 40 CFR §70.2 and includes several specific requirements. One such requirement is “Any standard or other requirement provided for in the applicable implementation plan approved or promulgated by EPA through rulemaking under Title I of the Act that implements the relevant requirements of the Act, including any revisions to that plan promulgated in part 52 of this chapter.” An additional requirement within the definition of Applicable Requirement is “Any term or condition of any preconstruction permits issued pursuant to regulations approved or promulgated through rulemaking under title I, including parts C or D, of the Act.” On information and belief, the source has never received a permit that complied with the EPA approved SIP or that was issued pursuant to an EPA approved SIP. Clearly, the current ATC would have been based upon the less stringent, shadow regulations of Section 12 in use by the DAQM at the time of issuance. Petitioners object to every condition in the proposed permit that cites the source’s August 19, 1997 ATC or the December 13, 2000 OP as the legal authority for the condition. These objections cover virtually every condition in “Part III Special Conditions” of the instant part 70 permit. When the APCD management removed the offending NOX monitor(s) from service prior to the source’s construction, the opportunity to review the stricter non-attainment area requirements were forever concealed. The non-attainment requirements would have included LAER as well as federally enforceable emission reduction offsets. While we do not object to the emission concentration limits for this source, we do object to the deal that was struck regarding offsets. Rather than comply with legitimate, real, quantifiable, and enforceable emission reduction offsets, a special tree-planting caper was dreamed up by the masters of deceit. Program Overview. The International Academy of English (IAE) is an intensive English program that offers five levels of instruction and a TOEFL Preparation course. Each level is taught throughout an 18-week term which is subdivided into two 9-week sessions (Sessions A and B). Completion of all five levels takes 18 months. If students fail, they can go through the term in the same level one more time provided they are making academic progress. The main objective of the Intensive English Program is to help students read, write, listen and speak in increasing levels of proficiency so that they can fulfill their academic and professional goals. Most of our students have the objective of being admitted to undergraduate or graduate courses in public colleges or universities. Students also want to learn English for professional reasons, such as getting a job or being promoted. Our primary instructional approach is skill-based as we place students according to their skill level in which we offer specific classes to help students enhance their reading, writing, listening and speaking skills. Our methodological approach is communicative since students learn the target language through interaction with their peers, teachers, and the outside community. As for our TOEFL program, the main objective of the course is to prepare students to be successful in the TOEFL test and to be admitted to the college or university program they apply to. The TOEFL Preparation course is also offered throughout an 18-week term and students can choose to repeat the TOEFL Preparation course if they have not attained their goal on the TOEFL exam by the end of the class. The SDP will be a three-phase progressive program for inmates serving a minimum of 9 months of SHU confinement (including consecutive sanctions that total at least 9 months) who would likely benefit from structured programming, including programming based on principles of cognitive behavioral therapy, to improve behavior and reduce future disciplinary infractions. Suitability and selection for the program will be determined in DOCCS’ discretion. Inmates will progress through the stages of the SDP, earning fewer restrictions and increased incentives, as they meet benchmarks and individual goals. Inmates will receive the incentives specified below for each phase of the Program, subject to the possibility of losing them for negative behavior. On successful program completion, inmates will be returned to general population, following a review for general population placement and programming to meet individually identified needs and behavioral plans by the Superintendent, who will forward his or her recommendations to the DOCCS Central Office for a final placement decision.

The Lakeview Substance Abuse SHU- Alternative Program will provide a six-month intensive alcohol and substance abuse treatment (“I-ASAT”) program for inmates at high risk for continued drug and alcohol abuse who have received individual or combined confinement sanctions of more than 120 days related to substance abuse-related offenses. Suitability for placement in the program will be determined in DOCCS’ discretion, however, only inmates who have a substance dependency condition as determined by a comprehensive substance dependency assessment conducted by qualified personnel shall be eligible for the program. Inmates who have displayed satisfactory program participation and have completed their confinement sanctions in the unit before completing the six-month I-ASAT program will receive expedited placement into ASAT at their next general confinement facility
