Professional Skill. It is mutually agreed by the parties that City is relying upon the professional skill of the consultant as a specialist in the work, and Consultant represents to the City that its work shall conform to the normal professional standards of the profession. Acceptance of the Consultant's work by the City does not operate as a release of Consultant's representations. It is intended that Consultant's work shall conform to normal standards of accuracy, completeness and coordination.
Professional Skill. It is further mutually understood and agreed by and between the parties hereto that inasmuch as CONSULTANT represents to CITY that CONSULTANT and its subcontractors, if any, are skilled in the profession and shall perform in accordance with the standards of said profession necessary to perform the services agreed to be done by it under this Agreement, CITY relies upon the skill of CONSULTANT and any subcontractors to do and perform such services in a skillful manner and CONSULTANT agrees to thus perform the services and require the same of any subcontractors. Therefore, any acceptance of such services by CITY shall not operate as a release of CONSULTANT or any subcontractors from said professional standards.

It is further mutually understood and agreed by and between the parties hereto that the Consultant is skilled in the professional calling necessary to perform the work agreed to be done by it under this Contract, and that the City, not being skilled in such matters, relies upon the skill of the Consultant to do and perform its work in the most skillful manner in accordance with generally-accepted professional practice and the Consultant agrees to thus perform its work, and the acceptance of its work by the City shall not operate as a release of the Consultant from said Contract.

It is further mutually understood and agreed by and between the parties hereto that inasmuch as COLLECTION AGENCY represents to CITY that COLLECTION AGENCY and its subcontractors, if any, are skilled in the profession and shall perform in accordance with the standards of said profession necessary to perform the services agreed to be done by it under this Agreement, CITY relies upon the skill of COLLECTION AGENCY and any subcontractors to do and perform such services in a skillful manner and COLLECTION AGENCY agrees to thus perform the services and require the same of any subcontractors. Therefore, any acceptance of such services by CITY shall not operate as a release of COLLECTION AGENCY or any subcontractors from said professional standards.

The Parties mutually agree that District is relying upon the professional skill of the Consultant/Professional as a specialist in the work as described in Exhibit A, and Consultant/Professional represents to District that its work as described in Exhibit A shall conform to professional standards. Acceptance of the Consultant/Professional’s work by District does not operate as a release of Consultant/Professional’s representations. Professional Skill. CONSULTANT represents that it is skilled in the professional calling necessary to perform the work agreed to be done by it under this Agreement. CONSULTANT represents and warrants to DISTRICT that it has all licenses, permits, qualifications that are legally required for CONSULTANT to practice its profession and that CONSULTANT shall, at its sole cost and expense, keep all such licenses, permits, and approvals which are legally required for CONSULTANT to practice its profession in effect. DISTRICT relies upon the skill of CONSULTANT to do and perform its work in a skillful manner, and CONSULTANT agrees to thus perform its work, and the acceptance of its work by DISTRICT shall not operate as a release of CONSULTANT from said Agreement. For purposes of this Agreement, “skillful manner” shall mean the standard of care prevailing in the industry in the San Francisco Bay Area during the term of this Agreement.

It is further mutually understood and agreed by and between the parties hereto that inasmuch as Yamabe & Horn represents to City that Yamabe & Horn is skilled in the profession and shall perform in accordance with the standards of said profession necessary to perform the services agreed to be done by it under this Agreement, City relies upon the skill of Yamabe & Horn to do and perform such services in a skillful manner and Yamabe & Xxxx agrees to thus perform the services. Therefore, any acceptance of such services by City shall not operate as a release of Yamabe & Xxxx from said professional standards.

It Is further mutually understood and agreed by and between the parties hereto that inasmuch as GRANTEE represents to the City that GRANTEE and its subcontractors, if any. are skilled In the profession and shall pertorm in accordance with the standards of said profession necessary to perform the services agreed to be done by it under this Agreement, the City relies upon the skill of the GRANTEE and any subcontractors to do and pertorm such services in a skillful manner and the GRANTEE agrees to thus perform the services and require the same of any subcontractors. Therefore, any acceptance of such services by the City shall not operate as a release of GRANTEE or any subcontractors from said professional standards.
Professional Skill. AUDITOR represents that it is skilled in the professional calling necessary to perform the work agreed to be done by it under this Agreement. CITY relies upon the skill of AUDITOR to do and perform its work in the most skillful manner, and AUDITOR agrees to thus perform its work, and the acceptance of its work by CITY shall not operate as a release of AUDITOR from said Agreement.
