PROFESSIONAL COUNSELING. 14.01 The County agrees to provide professional counseling services, such as the current Employee Assistance Program ("EAP"), to bargaining unit members and their families. When the employee seeks counseling, all matters relating to counseling shall remain confidential and shall not be released to the County unless approved by the employee. However, in cases of supervisory referrals or other requests by the County that the employee seek professional counseling, whether through the EAP or otherwise, including drug and alcohol counseling, counseling information shall be provided to the County, upon its request to the counselor or the employee. This information, however, is limited to program attendance records, program compliance issues, and completion reports. In addition, all counseling records will be subject to disclosure in the event of arbitration involving the employee, if the records are relevant to the issue(s) being arbitrated.

When the employee voluntarily seeks counseling, all matters relating to counseling shall remain confidential and shall not be released to the County unless approved by the employee or as required by law. However, the results and reports may be disclosed in any arbitration or litigation involving the employee.
