Products Prices. Distributor shall pay OMP the Prices for Products in accordance with the Prices set forth in Exhibit A. Distributor, in its sole discretion, shall set resale prices for sale of the Products to Customers in the Territory. Subject to Section 6 hereof, OMP may change the Prices in Exhibit A at any time, in its sole discretion.
Products Prices a. The products and services covered by this Agreement ("Products") are those listed on Schedule B hereto and updates, enhancements and new versions which are substantially similar thereto and which are marketed under the same model number and product nomenclature. Schedule B shall also include the prices and terms of sale for the Products, which may be updated from time to time by VERISITY.

The products purchased and delivered in accordance with these General Terms (“Products”) shall be specified in the delivery agreement, Seller’s respective offer, written order confirmation or other Seller’s technical documentation. Technical features of the Products shall be described in the Product’s technical documentation. All prices are excluding value added tax, which shall be added to the price and will be invoiced from the Purchaser in accordance with then valid applicable legislation.

If you wish to take delivery of any Appliance or have IBM provide Appliance-related services to you in any other country, you need to enter into a separate TD and base agreement with the relevant IBM Affiliate in that country. Prices paid by Home Shopping to Hydron for Products will be negotiated in good faith by Hydron and Home Shopping and will be as mutually agreed by Hydron and Home Shopping, provided that Hydron will provide Products at a cost to Home Shopping that will allow Home Shopping to achieve an average Initial Xxxx-Up on all Products of at least ___________1 (the "Margin Standard") when Products are priced by Home Shopping to provide value to its customers at historically successful price points for similar items. "Initial Xxxx-Up" means ___________1 Home Shopping will consider excluding certain Products with low Initial Xxxx-Ups from the calculation of the average Initial Xxxx-Up on a case-by-case basis.
Products Prices a. Xxxxx agrees to sell and Transmation agrees to buy Products at the net price stated on the price schedules referenced in each Product Exhibit A attached.
Products Prices. The prices to be paid by Uroplasty to SI.EM for the Products purchased hereunder initially shall be as set forth on Exhibit H and do not include applicable taxes. SI.EM may change at its own discretion and from time to time the Products Prices and increases shall be effective upon ninety (90) days written notice to Uroplasty and decreases will be effective immediately upon written notice to Uroplasty. Notwithstanding the foregoing, SI.EM may not increase Products Prices by more than five (5%) in any twelve month period, unless exceptional circumstances occur which can be documented and which justify a price increase. It is anticipated that Uroplasty will work with SI.EM in an effort to reduce the cost of producing the Products. SI.EM agrees to pass through to Uroplasty, or provide Uroplasty with an immediate credit against purchases of Products, any manufacturing or distribution cost savings achieved from these efforts. or otherwise achieved by SI.EM.
