Product Samples. VTrans reserves the right to visit and take samples from stockpile(s), transfer points or from shipments for gradation and moisture, storage conditions, etc. prior to award of Contract and at any time during the term of the contract. If the stockpile or stockpile site does not meet the specifications set forth in this document, VTrans reserves the right to reject the award of the contract.
Product Samples. When required by the solicitation, product samples shall be submitted at or prior to the time specified for receipt of offers. Unless otherwise specified in this solicitation, these samples shall be submitted at no expense to the Government, and returned at the sender’s request and expense, unless they are destroyed during preaward testing.
Product Samples. If Spacelabs provides Customer with supplies and accessories Product samples, Customer agrees to use such Product samples only for purposes of patient care, and to ensure the samples are used within 90 days after delivery to Customer.
Product Samples. For purposes of taping the Commercial, Product Owner will provide Hawthorne with six (6) complete Product units at no charge to Hawthorne.
Product Samples. If representative lot samples of production batches of Product are requested by Customer in order to satisfy its obligations under applicable Law, including any regulatory requirements, or to any Governmental Authority, then Manufacturer shall provide Customer (or any such Third Party as Customer shall designate) with representative lot samples of each production batch of Product promptly upon Customer’s request. Customer shall be entitled to review, upon reasonable prior written notice, all manufacturing Records relating to such samples, including all analytical procedures and cleaning validation relating to the equipment used in connection with the manufacture of the samples. Such Product samples shall be Delivered to Customer (or such Third Party as Customer shall designate) in accordance with the provisions set forth in Section 2.6(a) and at the Price as determined in accordance with the terms of Section 3. Customer shall pay for such samples when invoiced in accordance with Section 3.5.
Product Samples. From time to time throughout the term of this Agreement, as reasonable, but no more frequently than every other calendar year after the Distribution Date, each Licensee shall, upon Licensor’s request, furnish to Licensor for approval, up to two (2) samples of each different Licensed Product within each Product Category that are manufactured under this Agreement, together with product packaging, so that Licensor can ensure that proper trademark usage is being made by such Licensee. Each Licensee agrees to make available at no charge such additional samples (not to exceed ten (10)) of each Licensed Product as Licensor may from time to time reasonably request for the purpose of comparison with earlier samples to maintain consistent trademark usage. All submissions by a Licensee pursuant to this Section 6.3 shall be at such Licensee’s cost.
Product Samples. It is not the policy of the Company to provide or loan Product Samples to its Distributors. However, in the exceptional case where a Product Sample is provided or loaned to a Distributor, the following language shall apply: Any Product Samples of the Products provided by Company to Distributor shall remain the property of Company. Distributor shall have full responsibility of keeping each Product Sample in proper operating condition during the entire time the Product Sample is in the possession of Distributor. Upon written notice from Company, Distributor shall, within thirty (30) days, arrange for return of each Product Sample to Company in good condition less reasonable wear and tear.
Product Samples. At the time Amylin delivers Product Samples to Xxxxx'x carrier as described in Section 3.2, Amylin represents and warrants to Xxxxx that such Samples:
Product Samples. Unless otherwise agreed, Sprint Spectrum agrees to provide a minimum of seven (7) samples of all Products with written specifications for evaluation to RadioShack's Quality Control Department at no charge to RadioShack. RadioShack may dispose of all samples in the exercise of its sole discretion and without any obligation to return same to Sprint Spectrum or to compensate Sprint Spectrum in any way therefor. Sprint Spectrum understands that the submission of any software samples will also include the rights to a full non-exclusive revocable site license for use within RadioShack headquarters.
Product Samples. (a) Manufacturer shall provide Company, promptly upon request, with a reasonable number samples of the Products of any current production run, not to exceed […***…] percent ([…***…]%) of such production run, for testing purposes. Such Product samples shall be shipped to Company in accordance with the provisions set forth in Section 3.8, and Company shall pay the price for such Products in the manner described in Section 3.7.
