Product Reformulation Commitment. 3.1.1 No later than the Effective Date, AIRE shall provide the Phthalate Free phthalate concentration standards of Section 2.2 to its then-current manufacturers of any Covered Product and inquire as to such manufacturers whether component materials that meet the Phthalate Free concentration standards of Section 2.2 can be incorporated into each Covered Product without compromising product performance. AIRE shall maintain copies of all manufacturer correspondence relating to the Phthalate Free concentration standards for two (2) years after the Effective Date and shall produce such copies to Davia within fifteen (15) days of receipt of reasonable request made in writing from Davia, as long as such request is made within two (2) years after the Effective Date.
Product Reformulation Commitment. 3.2.1 No later than the Effective Date, Beadsmith shall provide the Phthalate Free concentration standards of Section 2.2 to its then-current vendors or manufacturers of any Phthalate Covered Product and to its vendors of any vinyl material for any Phthalate Covered Product, and instruct such entities not to incorporate any raw or component materials that do not meet the Phthalate Free concentration standards of Section 2.2 into any Phthalate Covered Product or to supply any Phthalate Covered Product to Beadsmith that is not Phthalate Free. Beadsmith shall maintain copies of all vendor correspondence relating to the Phthalate Free concentration standards and shall produce such copies to Davia within fifteen (15) days of receipt of written request from Davia.
Product Reformulation Commitment. 4 3.2.1 As XXXXXX is only the retailer of the Covered Product, and is supplied with such 5 product by Xxxxxxxx who manufactures or distributes the Product, XXXXXX shall have no 6 reformulation obligations under this agreement.
Product Reformulation Commitment. 12 3.1.1 No later than the Effective Date, Xxxxxxxxx shall provide the Lead Free and Phthalate 13 Free concentration standards of Section 2.2 to any then-current vendor of any Covered Product and 14 advise such entities of Xxxxxxxxx’x preference that they supply Lead Free and Phthalate Free
Product Reformulation Commitment. 3.1.1 J. Queen represents that, in 2012, it provided Phthalate Free phthalate concentration standards that are commensurate with Section 2.2 to its then-current vendors of the Covered Products, and instructed such entities not to incorporate any raw or component materials that do not meet the Phthalate Free concentration standards of Section 2.2 into any Covered Product. J. Queen has provided an exemplar(s) of said correspondence. No later than the Effective Date, J. Queen shall provide the Phthalate Free phthalate concentration standards of Section 2.2 its current vendors of the Covered Products and remind such entities not to incorporate any raw or component materials that do not meet the Phthalate Free concentration standards of Section 2.2 into any Covered Product. J. Queen shall maintain copies of all vendor correspondence relating to the Phthalate Free concentration standards for two (2) years after the Effective Date and shall produce such copies to Davia within fifteen (15) days of receipt of reasonable request made in writing from Davia.
Product Reformulation Commitment. 3.2.1 No later than 10 business days after the Effective Date, Town & Country shall provide the Phthalate Free concentration standards of Section 2.2 to its then-current vendors or manufacturers of any Covered Product and instruct such entities not to incorporate any raw or component materials that do not meet or exceed the Phthalate Free concentration standards of Section 2.2 into any Covered Product. Town & Country shall maintain copies of all vendor correspondence relating to the Phthalate Free concentration standards and shall produce such copies to Davia within fifteen (15) days of receipt of written request from Xxxxx.
Product Reformulation Commitment. 3.1.1 No later than the Effective Date, Geneva Home shall provide the Phthalate Free phthalate concentration standards of Section 2.2 to its then-current vendors of any Covered Product that is sold in Covered Packaging, and any direct vendor of Covered Packaging, and instruct such entities not to provide any Covered Packaging that does not meet the Phthalate Free concentration standards of Section 2.2. For two (2) years after the Effective Date, Geneva Home shall maintain copies of all vendor correspondence relating to the Phthalate Free concentration standards and shall produce such copies to Davia within thirty (30) days of receipt of reasonable request made in writing from Davia.
Product Reformulation Commitment. After the Effective Date, Trademark shall provide the Phthalate Free standards of Section 2.2 to any existing or new vendor of Covered Products and request they only utilize vinyl materials for Covered Products that meet the Phthalate Free standards. Trademark shall maintain copies of all vendor correspondence relating to the Phthalate Free concentration standards for two years after the Effective Date and shall produce such copies to Davia within fifteen (15) days of receipt of Davia’s reasonable written request.
Product Reformulation Commitment. 3.1.1 SEB agrees, promises, and represents that after the Effective Date of this Settlement Agreement SEB shall reformulate any Covered Products manufactured after the Effective Date that are offered for sale in the State of California to a point where the level of DINP in the Covered Products does not exceed 0.1%.
Product Reformulation Commitment. 3.1.1 GBG and Homestead represent as a material term of this Agreement that as of May 16, 2018, the assets, goodwill and liabilities of their business relating to sale and distribution of Covered Products was sold to third party Himatsingka America, Inc. This sale included the transfer from GBG/Homestead to Himatsingka America Inc. of most of the remaining inventory and records relating to such business. Should GBG or Homestead resume distribution of Covered Products after the Effective Date, then GBG and Homestead shall provide the Phthalate Free phthalate concentration standards of Section 2.2 to any vendor of any Covered Product or direct vendors of Covered Packaging and instruct such entities not to provide any Covered Packaging that does not meet the Phthalate Free concentration standards of Section 2.2. Prior to purchase and acquisition of any Covered Product or Covered Packaging from any vendor after the Effective Date, GBG and Homestead shall obtain written confirmation and laboratory test results from the vendor demonstrating compliance with the Phthalate Free phthalate concentration standard for any Covered Packaging. For every Covered Product sold in Covered Packaging or Covered Packaging GBG or Homestead manufactures, causes to be manufactured, orders, causes to be ordered or otherwise obtains from a vendor after the Effective Date, GBG shall maintain, for a period of not less than two (2) years, copies of all testing of such products demonstrating compliance with this section, shall maintain copies of all vendor correspondence relating to the Phthalate Free concentration standards and shall produce such copies to Davia within fifteen (15) days of receipt of reasonable request made in writing from Davia.
