Product Inspection. The Contractor shall be subject to continuous inspection by the District to insure compliance with all specifications required by this Agreement and all regulations of the District. In any instance where the products do not conform to the specifications contained herein or to the samples provided with the bid, the District reserves the right to reject the products as a non-conforming good, to declare the Contractor to be in breach of this Agreement, and to exercise any and all of its remedies for breach of contract provided in this Agreement, up to and including termination of this Agreement. All products provided by Contractor pursuant to this Agreement are to be re-inspected when delivered to their final destination. All products will be checked for temperature compliance, damage, leakage or other deviations. All products will be referenced against the invoice before the invoice is signed for at the school by an authorized representative of the District. In the event delivery is made during serving, the delivery person must be prepared to wait until an authorized representative is available to receive shipment. Please advise delivery person of such so that adequate time for delivery is scheduled. Delivery personnel must put product in cooler, stock room or freezer as directed by Cafeteria Manager or other authorized representative of the District.
Product Inspection. 1. Party B has the right to designate the person who accepts the goods to inspect the products at the production place or other relevant areas of Party A’s goods.
Product Inspection. The buyer is required to make appropriate inspection of the goods on delivery and is required to ensure that they are in such condition that no risk or hazard could arise from their use. In the event of any such possibility arising he is required to notify the Company, without delay.
Product Inspection. If Buyer and Seller agreed to arrange for the products go through a product inspection process, the parties may agree on the terms of the inspection, such as method, inspection institution, fees, and etc., by way of a supplemental agreement. If both Parties have agreed “Inspection & Logistics Service Trade Assurance”, Buyer shall also be entitled to have the Products inspected before shipping (and Seller shall provide all necessary assistance to complete the relevant inspection so that the shipping of Products remains unaffected), so that Buyer can benefit from information relating to the inspection and shipping of the Products.
Product Inspection. PURCHASER shall inspect all items immediately upon delivery to ensure checks are correctly printed.
Product Inspection. 12. The Supplier shall bear all costs incurred due to acceptance tests. Xxxxxx is responsible for the costs of the Patria repre- sentatives it has sent to an acceptance test.
Product Inspection. If required by MCK prior to putting previously installed product under support, VITAL will visit the Customer to ensure Product has been maintained in adherence to the maintenance procedures as detailed in the applicable user information (supplied with product upon initial sale/resale). Each Site visit will be charged at current Time and Material rates in effect or pre-agreed to price schedule.
Product Inspection. Retailer shall inspect the Products upon receipt and during storage for damage, defects, broken seals, evidence of tampering or other nonconformance (collectively, “Defects”). Retailer shall also inspect its inventory regularly for expired or soon-to-be expired Products and shall remove those Products from its inventory. Retailer shall not sell any Products that are expired. If any Defects are identified, Retailer must not offer the Product for sale and must promptly report the Defects to Beretta.
Product Inspection. Within ten (10) days of receiving the Products, Distributor shall inspect the Products for damage, defect, broken seals, or other nonconformance (collectively, “Defects”). If any Defects are identified, Distributor must not offer the Product for sale and must promptly report the Defects to H&C Animal Health at xxxxxxxxxxxxxxx@xxxxxxxxxxxxxx.xxx. Distributor shall inspect its inventory regularly for expired or soon-to-be expired Products and shall remove those Products from its inventory. Distributor shall not sell any Products that are expired.
Product Inspection. The delivered Products shall be inspected immediately upon delivery to the Customer. The Products are deemed accepted unless Impulse receives a complaint relating to apparent defects or other defects that would be recognized in an immediate, thorough inspection in writing and within three (3) working days after delivery of the goods, or otherwise within three working days after discovery of the defect or from the time in which the defect could be recognized by the Customer in normal usage without closer inspection. In case of defects, Impulse shall at its own discretion, either repair the defect or replace the defective Product. The same will be at Impulse’s cost and expenses, provided Impulse found the Product defective.
