Procedure for Filing Employee Discharge and Suspension Grievances. (a) A claim by an employee, who has completed his/her probationary period, that he/she has been unjustly suspended or discharged, shall be treated as a grievance if a written statement of such grievance is lodged with the Company within five (5) work days after the suspension or discharge is effected. Such grievance shall commence at Step 2 of the grievance procedure.

When a grievance which is filed under this article is not settled and duly comes before the arbitration board, the Board may make a ruling: confirming the Company's action; reinstating the employee with compensation for regular time lost (except for the amount of any remuneration or compensation the employee has received from any other source pending the disposition of case); or disposing of the grievance in any other manner which may be just and equitable. Procedure for Filing Union or Company Policy Grievances A grievance of general application by either the Company or the Union affecting either of the parties directly arising out of the interpretation or administration of the collective agreement, may be submitted at Step of the grievance procedure. Such grievance must be submitted within ten (10) work days after the incident giving rise to the grievance.

  • Term Termination and Suspension 18.1 This Agreement shall be effective from the Effective Date for the Term. The Service shall commence on the Commencement Date and continue until the Completion Date, whereupon this Agreement shall expire unless terminated earlier in accordance with its terms.
