Procedure For Dealing With Safety. Issues or Incidents The parties recognise the potentially hazardous nature of the construction industry. To this end, the parties to this Agreement are committed to continuous improvement in Workplace Health and Safety standards through the implementation of an organisational framework which involves all parties in protecting employees’ health and safety. In meeting these objectives, the parties have agreed to consider a broad agenda through the consultative processes established by this Agreement. Such an agenda will include: • Measures designed to include the safe operation of plant and equipment; • Training issues including specific hazards, health and safety systems, and site induction; • Management of Workplace Health and Safety through a comprehensive approach which aims to control hazards at source, reduce the incidence and costs of occupational injuries and illnesses. The company shall in addition to ensuring compliance with the Standards as mentioned in Appendix 7, endeavour to implement the best achievable level of health and safety. Particular emphasis will be placed on the establishment of mechanisms which may include the election of a workplace health and safety representative (who shall be an employee of the company and subject to this agreement) who may represent employees in discussions on health and safety matters. Nothing in this agreement shall reduce the duty of care held by th company to address these issues. The following procedure will be followed in good faith and without unreasonable delay. If an issue is not settled by observance of this procedure, or if the procedure is disregarded by either party, the matter may be submitted for resolution in accordance with section 2.1. Nothing in this Agreement shall take precedence over the Workplace Health & Safety Act (as amended) or other applicable O. H & S legislation.

  • ARTICLE GRIEVANCE PROCEDURE The parties to this Agreement are agreed that it is of the utmost importance to adjust complaints and grievances as quickly as possible. Unless agreed to by both the Company and the Union, no grievance shall be presented, the alleged circumstances of which originated or occurred, or should have come to the attention of the employee concerned, more than five (5) working days prior to its original presentation in writing at Step A grievance shall consist of a dispute concerning interpretation and/or application of any Article, Schedule or Clause in this Agreement. The Union or the Company may initiate a grievance beginning at Step of the Grievance Procedure. Competitive Supplier agrees to designate a service representative or representatives (the “Service Contacts”) who shall be available for these purposes, and shall identify the office address and telephone number of such representative(s). Whenever necessary to comply with this Article 5.3, the Service Contacts shall call upon other employees or agents of the Competitive Supplier to obtain such information or explanation as may be reasonably requested. Nothing in this Article 5.3 shall be interpreted as limiting the obligation of the Competitive Supplier to respond to complaints or inquiries from Participating Consumers, or to comply with any regulation of the Department or AG regarding customer service.
