Problem Solving Stage. 16.02.01 Employee(s), Employer representative(s) or Union representative(s) are encouraged to resolve any dispute through face-to-face discussion with the person(s) with whom there is a dispute. Problem solving must occur within ten (10) working days of the incident giving rise to the dispute. If either party intends to proceed to the consultation stage, the request for consultation must also be filed within the same ten (10) working days in accordance with Article 16.03.02.

Problem Solving Stage. 4.1 At the ‘Problem Solving Stage’ disclosures of factual events can be made by the Police Neighbourhood Beat Manager, Police Community Support Officers, Local Authorities Officers and/or registered Social Landlord Officers to determine if a joint approach to reported incidents is required. Such disclosures will only deal with incidents or offences that have occurred in the premises, or in the locality of the dwelling, and will be aimed at deciding on the course of any joint action, if required. Any disclosures should be recorded and comply with the principle that ‘the minimum disclosure required is the maximum disclosure permitted’.

  • Problem Solving Employees and supervisors are encouraged to attempt to resolve on an informal basis, at the earliest opportunity, a problem that could lead to a grievance. If the matter is not resolved by informal discussion, or a problem-solving meeting does not occur, it may be settled in accordance with the grievance procedure. Unless mutually agreed between the Employer and the Union problem-solving discussions shall not extend the deadlines for filing a grievance. At any STAGE of the Grievance Procedure, the time limits imposed upon either party may be extended, in writing, by mutual agreement. As an alternative to the procedures described at STAGE in Article the parties may choose to proceed with final disposition of a grievance by the use of Mediation/ Arbitration. This alternative shall be implemented within the provisions of Appendix of this Agreement and agreed as being in conformity with the provisions of Article of this Agreement.   • Recall When it is determined by the Agency to fill a vacancy or to recall employees in a classification where the layoff occurred, the following procedure shall be adhered to: The laid off employee with the most State seniority from the same, similar or related classification series for whom the position does not constitute a promotion as defined in Article 17, and who prior to his/her layoff, held a classification which carried with it the same or higher pay range as the vacancy, shall be recalled first (see Appendix I). All employees who are laid off or displaced out of their classification shall be placed on the recall list by the effective date of their layoff. Likewise, if the recalled employee does not actually return to work within thirty (30) days, recall rights shall be forfeited. Any employee accepting or declining recall to the same, similar or related classification series and the same appointment category (type) from which the employee was laid off or displaced shall be removed from the recall and reemployment list if recalled to his/her original classification and appointment category (type). Except that any employee declining recall to a different appointment category (type) than that from which he/she was laid off or displaced shall be removed from the recall list for that appointment category (type).
