Common use of Priorities Clause in Contracts

Priorities. If the Trustee collects any money pursuant to this Article, it shall pay out the money in the following order: FIRST: to the Trustee, its agents and attorneys for amounts due under Section 7.07 hereof, including payment of all compensation, expense and liabilities incurred, and all advances made, by the Trustee and the costs and expenses of collection;

Priorities. If the Trustee collects any money pursuant to this Article, it shall pay out the money in the following order: FIRST: to the Trustee, its agents and attorneys Trustee for amounts due under Section 7.07 hereof7.07; SECOND: to Holders of Securities in respect of which or for the benefit of which such money has been collected for amounts due and unpaid on such Securities for principal and interest, including payment ratably, without preference or priority of all compensationany kind, expense according to the amounts due and liabilities incurredpayable on such Securities for principal and interest, and all advances made, by the Trustee and the costs and expenses of collection;respectively; and

If the Trustee collects any money pursuant to this Article, it shall pay out the money in the following order: FIRST: to the Trustee, its agents and attorneys Trustee for amounts due under Section 7.07 hereof7.07; SECOND: as set forth in clauses FIRST, including SECOND, THIRD, FOURTH and FIFTH of Section 7.15, in such order of priority; THIRD: to the payment of all compensation, expense and liabilities incurred, and all advances made, by the Trustee and the costs and expenses of collection;any remaining Obligations; and

Priorities. If the Trustee collects any money pursuant to this Article, it shall shall, subject to the provisions of Article X hereof, pay out the money in the following order: FIRST: (a) First: to the Trustee, its agents and attorneys counsel for amounts due under Section 7.07 hereof7.7, including payment of all compensation, expense expenses and liabilities incurred, and all advances made, if any, by the Trustee and counsel and the costs and expenses of collection;

Priorities. If the Trustee collects any money pursuant to this Article, it shall pay out the money in the following order: FIRST: to the Trustee, its agents Agents and attorneys for amounts due under Section 7.07 hereof8.07, including payment of all compensation, expense expenses and liabilities incurred, and all advances made, by the Trustee and the costs and expenses of collection; SECOND: if the Holders are forced to proceed against the Company directly without the Trustee, to Holders for their collection costs;

If the Trustee collects any money pursuant to this Article, it shall pay out the money in the following order: FIRSTorder (subject to the provisions of Article 10): First: to the Trustee, its agents and attorneys for amounts due under Section 7.07 hereof, including payment of all compensation, expense and liabilities incurred, and all advances made, by the Trustee and the costs and expenses of collection;

Priorities. If the Trustee collects any money pursuant to this Article, it shall pay out the money in the following order: FIRSTFirst: to the Trustee (including any predecessor Trustee), its agents and attorneys for amounts due under Section 7.07 7.7 hereof, including payment of all compensation, expense fees, expenses and liabilities incurred, and all advances made, by the Trustee and the costs and expenses of collection;

Priorities. If the Trustee collects any money pursuant to this ArticleArticle or the Pledge and Escrow Agreement, it shall pay out the money in the following order: FIRSTFirst: to the Trustee, its agents and attorneys for amounts due under Section 7.07 hereof, including payment of all compensation, expense and liabilities incurred, and all advances made, by the Trustee and the costs and expenses of collection;

If the Trustee collects any money pursuant to this Article, it shall pay out the money in the following order: FIRSTFirst: to the Trustee, its agents and attorneys for amounts due under Section 7.07 hereof, including payment of all compensation, expense expense, and liabilities incurred, and all advances made, by the Trustee and the costs and expenses of collection;

If the Trustee collects any money pursuant to this Article, it shall pay out the money in the following order: FIRST: to the Trustee, its agents and attorneys for amounts due under Section 7.07 hereof7.07, including payment of all compensation, expense and liabilities incurred, and all advances made, by the Trustee and the costs and expenses of collection;

Priorities. If the Trustee collects any money or property pursuant to this ArticleArticle 7, it shall pay out the money or property in the following order: FIRST: to the Trustee, Trustee for its agents fees (excluding expenses and attorneys for amounts indemnities) due under Section 7.07 hereof, including payment of all compensation, expense and liabilities incurred, and all advances made, by 8.07; SECOND: to the Trustee and the costs and expenses of collection;for amounts (other than those set forth in clause FIRST) due under Section 8.07; -50-

If the Trustee collects any money pursuant to this Article, it shall pay out the money in the following order: FIRST: to the Trustee, its agents and attorneys for amounts due under Section 7.07 8.07 hereof, including payment of all reasonable compensation, expense and liabilities incurred, and all advances made, by the Trustee and the reasonable costs and expenses of collection;

Priorities. If the Trustee collects any money pursuant to this Article, it shall pay out the money in the following order: FIRST: to the Trustee, its agents and attorneys Trustee for amounts due under Section 7.07 hereof, including payment of all compensation, expense and liabilities incurred, and all advances made, by the Trustee and the costs and expenses of collection7.07;

Priorities. If the Trustee collects any money or other property pursuant to this Article, it shall pay out the money or other property in the following order: FIRSTFirst: to the Trustee, its agents and attorneys for amounts due under Section 7.07 hereof, including payment of all compensation, expense and liabilities incurred, and all advances made, by the Trustee and the costs and expenses of collection;

Priorities. If the Trustee collects any money pursuant to this ArticleARTICLE VIII, it shall pay out the money in the following order: FIRST: to the Trustee (including any predecessor Trustee), its agents and attorneys for amounts due under Section 7.07 9.7 hereof, including payment of all compensation, expense and liabilities incurred, and all advances made, by the Trustee and the costs and expenses of collection;

Priorities. If the Trustee collects any money pursuant to this Article, it shall shall, subject to the terms of the Intercreditor Agreement, pay out the money in the following order: FIRST: to the Trustee, its agents and attorneys for amounts due under Section 7.07 hereof, including payment of all compensation, expense and liabilities incurred, and all advances made, by the Trustee and the costs and expenses of collection;

If the Trustee collects any money pursuant to this Article, it shall pay out the money in the following order: FIRST: to the Trustee, its agents and attorneys for amounts due under Section 7.07 hereof, including payment of all compensation, expense and liabilities incurred, and all advances made, by the Trustee and the Trustee's costs and expenses of collection;

Priorities. If the Trustee collects any money pursuant to this Article, it shall pay out the money in the following order: FIRST: to the Trustee, its agents and attorneys for amounts due under Section 7.07 9.07 hereof, including payment of all compensation, expense and liabilities incurred, and all advances made, by the Trustee and the costs and expenses of collection;

Priorities. If the Trustee collects any money pursuant to this Article, it shall pay out the money in the following order: FIRST: to the Trustee, its agents and attorneys Trustee for amounts due under Section 7.07 hereof7.07; SECOND: as set forth in clauses FIRST, including SECOND, THIRD, FOURTH and FIFTH of Section 7.14, in such order of priority; THIRD: to the payment of all compensation, expense and liabilities incurred, and all advances made, by the Trustee and the costs and expenses of collection;any remaining Obligations; and

If the Trustee collects any money pursuant to this ArticleArticle with respect to a series of Notes, it shall pay out the money in the following order: FIRSTFirst: to the Trustee, its the Agents, their respective agents and attorneys for amounts due under Section 7.07 hereof, including payment of all compensation, expense and liabilities incurred, and all advances made, by the Trustee or Agents and the costs and expenses of collection;

Priorities. If The Trustee will pay or deliver in the Trustee collects following order any money or other property that it collects pursuant to this Article, it shall pay out the money in the following orderArticle 7: FIRSTFirst: to the Trustee, Trustee (acting in any capacity hereunder) and its agents and attorneys for amounts due under Section 7.07 hereof10.06, including payment of all fees, compensation, expense indemnity claims, expenses and liabilities incurred, and all advances made, by the Trustee and the costs and expenses of collection;

Priorities. If the Trustee collects any money pursuant to this Article, it shall pay out the money in the following order, subject to applicable law: FIRSTFirst: to the Trustee (including any predecessor Trustee), its agents and attorneys for amounts due under Section 7.07 7.7 hereof, including payment of all compensation, expense fees, expenses and liabilities incurred, and all advances made, by the Trustee and the costs and expenses of collection;

Priorities. If the Trustee collects any money pursuant to this Article, it shall pay out the money in the following order: FIRST: to the Trustee, its agents and attorneys for amounts due under Section 7.07 hereof, including payment of all compensation, expense and liabilities incurred, and all advances made, by the Trustee and the costs and expenses of collection, including the costs of its agents and counsel;

Priorities. If the Trustee collects any money pursuant to this Article, it shall pay out the money in the following order: FIRSTFirst: to the Trustee, its agents and attorneys Trustee for amounts due under Section 7.07 hereof7.07; Second: to Holders for amounts due and unpaid on the Notes for principal, including payment premium and interest, ratably, without preference or priority of all compensationany kind, expense according to the amounts due and liabilities incurredpayable on the Notes for principal, premium and all advances madeinterest, by the Trustee and the costs and expenses of collection;respectively; and

Priorities. If the Trustee collects any money pursuant to this Article, it shall pay out the money in the following order: FIRSTFirst: to the Trustee, its agents and attorneys for amounts due under Section 7.07 7.7 hereof, including payment of all compensation, expense and liabilities incurred, and all advances made, by the Trustee and the Trustee's costs and expenses of collection;

Priorities. If the Trustee collects any money pursuant to this Article, it shall pay out the money in the following order: FIRSTFirst: to the Trustee, its agents and attorneys Trustee for amounts due under Section 7.07 7.07; Second: to the holders of Senior Indebtedness to the extent required by Article 10 hereof, including payment of all compensation, expense and liabilities incurred, and all advances made, by the Trustee and the costs and expenses of collection;

Priorities. If the Trustee collects any money pursuant to this Article, it shall pay out the money in the following order: FIRST: to the Trustee, its agents and attorneys for amounts due under Section 7.07 hereof, including payment of all compensation, expense and liabilities incurred, and all advances made, by the Trustee and the costs and expenses of collection; SECOND: to the holders of Senior Debt to the extent required by Article 10 or 12 hereof;

Priorities. If the Trustee collects or receives any money or securities or other property pursuant to this Article, it shall pay out the money or securities or other property in the following order: FIRSTFirst: to the Trustee, its agents and attorneys for amounts due under Section 7.07 hereof7.07, including payment of all compensation, expense and liabilities incurred, and all advances made, by the Trustee and the costs and expenses of collection;

Priorities. If the Trustee collects any money pursuant to this Article, Article it shall pay out the money in the following order: FIRST: to the Trustee, its agents and attorneys for amounts due under Section 7.07 hereof, including payment of all compensation, expense and liabilities incurred, and all advances made, by the Trustee and the costs and expenses of collection;; SECOND: to the holders of Senior Indebtedness of the Company or the Guarantors, as the case may be, to the extent required by Article 10 or Article 11 hereof, as applicable.

Priorities. If the Trustee collects any money pursuant to this Article, it shall pay out the money in the following order, subject to applicable law: FIRST: to the Trustee (including any predecessor Trustee), its agents and attorneys for amounts due under Section 7.07 7.7 hereof, including payment of all compensation, expense fees, expenses and liabilities incurred, and all advances made, by the Trustee and the costs and expenses of collection;

If the Trustee collects any money pursuant to this Article, it shall pay out the money in the following order: FIRSTFirst: to the Trustee, its agents and attorneys for amounts due under Section 7.07 hereof, including payment of all compensation, expense and liabilities incurred, and all advances made, by the Trustee and the Trustee's reasonable costs and expenses of collection;

If the Trustee collects any money pursuant to this Article, it shall pay out the money in the following order: FIRST: to the Trustee (including any predecessor Trustee), its agents and attorneys for amounts due under Section 7.07 7.7 hereof, including payment of all compensation, expense fees, expenses and liabilities incurred, and all advances made, by the Trustee and the costs and expenses of collection;

If The Trustee will pay or deliver in the Trustee collects following order any money or other property that it collects pursuant to this Article, it shall pay out the money in the following orderArticle 7: FIRSTFirst: to the Trustee, Trustee and its agents and attorneys for amounts due under Section 7.07 hereof10.06, including payment of all fees, compensation, expense expenses, indemnities and liabilities incurred, and all advances made, by the Trustee and the costs and expenses of collection;

Priorities. If the Trustee collects any money pursuant to this Article, it shall pay out the money in the following order: FIRSTFirst: to the Trustee, its agents and attorneys Trustee for amounts due under Section 7.07 hereof3.08; Second: to Note Holders for amounts due and unpaid on the Notes for interest, including payment then principal, ratably, without preference or priority of all compensationany kind, expense according to the amounts due and liabilities incurred, payable on the Notes for principal and all advances made, by the Trustee and the costs and expenses of collection;interest; and

Priorities. If the Trustee collects any money pursuant to this Article, it shall pay out the money in the following order: FIRST: to the Trustee, its agents and attorneys for amounts due under Section 7.07 7.7 hereof, including payment of all compensation, expense and liabilities incurred, and all advances made, by the Trustee and the costs and expenses of collection;
