Common use of Priorities Clause in Contracts

Priorities. If the Trustee collects any money or property pursuant to this Article 6, it shall pay out the money or property in the following order: FIRST: to the Trustee for amounts due under Section 7.07; SECOND: to Securityholders for amounts due and unpaid on the Securities for principal and interest, ratably, without preference or priority of any kind, according to the amounts due and payable on the Securities for principal and interest, respectively; and

Priorities. If the Trustee collects any money or property pursuant to this Article 6, it shall pay out the money or property in the following order: FIRSTFirst: to the Trustee Trustee, its agents and attorneys for amounts due under Section 7.07; SECOND: to Securityholders for amounts due 7.07 hereof, including payment of all compensation, expenses and unpaid on liabilities incurred, and all advances made, by the Securities for principal Trustee and interest, ratably, without preference or priority the costs and expenses of any kind, according to the amounts due and payable on the Securities for principal and interest, respectively; andcollection;

Priorities. If the Trustee collects any money or property pursuant to this Article 6Article, it shall pay out the money or property in the following order: FIRST: to the Trustee for amounts due under Section 7.07; SECOND: to Securityholders Holders for amounts due and unpaid on the Securities Notes for principal principal, premium, if any, and interest, ratably, without preference or priority of any kind, according to the amounts due and payable on the Securities Notes for principal and interest, respectively; and

Priorities. If the Trustee collects any money or property pursuant to this Article 6, it shall pay out the money or property in the following order: FIRST: to the Trustee for amounts due under Section 7.077.07 hereof; SECOND: to Securityholders Noteholders for amounts due and unpaid on the Securities Notes for principal principal, premium, if any, and interestinterest as to each, ratably, without preference or priority of any kind, according to the amounts due and payable on the Securities for principal and interest, respectivelyNotes; and

Priorities. If the Trustee collects any money or property pursuant to this Article 6Six, it shall pay out the money or property in the following order: FIRSTFirst: to the Trustee for amounts due under Section 7.07; SECONDSecond: if the Holders are forced to Securityholders proceed against the Company directly without the Trustee, to Holders for amounts due and unpaid on the Securities for principal and interest, ratably, without preference or priority of any kind, according to the amounts due and payable on the Securities for principal and interest, respectively; andtheir collection costs;

Priorities. If the Trustee collects any money or property pursuant to this Article 6, it shall pay out the money or property in the following order: FIRST: (i) First: to the Trustee and any Paying Agent and their respective agents and attorneys for amounts due under Section 7.07; SECOND: to Securityholders for amounts due 7.06, including payment of all compensation, expenses and unpaid on liabilities incurred, and all advances made, by the Securities for principal Trustee and interest, ratably, without preference or priority any Paying Agent and the costs and expenses of any kind, according to the amounts due and payable on the Securities for principal and interest, respectively; andcollection;

Priorities. If the Trustee collects any money or property pursuant to this Article 6, it shall pay out the money or property in the following order: FIRST: to the Trustee for amounts due under Section 7.07; SECOND: to holders of Senior Indebtedness of the Company to the extent required by Article 10; THIRD: to Securityholders for amounts due and unpaid on the Securities for principal and interest, ratably, without preference or priority of any kind, according to the amounts due and payable on the Securities for principal and interest, respectively; and

Priorities. If the Trustee collects any money or property pursuant to this Article 68, it shall pay out the money or property in the following order: FIRST: First, to the Trustee for amounts due under Section 7.079.7; SECOND: Second, to Securityholders the holders of Senior Indebtedness to the extent required by Article 5; Third, to Holders for amounts due and unpaid on the Securities for principal and interest, ratably, without preference or priority of any kind, according to the amounts due and payable on the Securities for principal and interest, respectively; and

Priorities. If the Trustee collects any money or property pursuant to this Article 6, it shall pay out the money or property in the following order: FIRSTFirst: to the Trustee Trustee, the Agents, and their respective agents and attorneys for amounts due under Section 7.07; SECOND: to Securityholders for amounts due 7.08 hereof, including payment of all compensation, expenses and unpaid on liabilities incurred, and all advances made, by the Securities for principal Trustee or any Agent, and interest, ratably, without preference or priority the costs and expenses of any kind, according to the amounts due and payable on the Securities for principal and interest, respectively; andcollection;

Priorities. If the Trustee collects any money or property pursuant to this Article 6, it shall pay out the money or property in the following order: FIRST: to the Trustee for amounts due under Section 7.077.07 hereof; SECOND: to Securityholders Noteholders for amounts due and unpaid on the Securities Notes for principal principal, premium, if any, and interestinterest (including Additional Interest, if any) as to each, ratably, without preference or priority of any kind, according to the amounts due and payable on the Securities for principal and interest, respectivelyNotes; and

Priorities. If the Trustee collects any money or property pursuant to this Article 6, it shall pay out the money or property in the following order: FIRST: to the Trustee for amounts due under Section 7.07; SECOND: to Securityholders Holders for amounts due and unpaid on the Securities Notes for principal principal, premium, if any, and interest, ratably, without preference or priority of any kind, according to the amounts due and payable on the Securities Notes for principal and interest, respectively; and

Priorities. If the Trustee collects any money or property pursuant to this Article 6Six, it shall pay out the money or property in the following order: FIRSTFirst: to the Trustee for amounts due under Section 7.07; SECONDSecond: to Securityholders Holders for amounts due and unpaid interest accrued on the Securities for principal and interestNotes, ratably, without preference or priority of any kind, according to the amounts due and payable on the Securities Notes for interest; Third: to Holders for principal amounts due and interestunpaid on the Notes, respectivelyratably, without preference or priority of any kind, according to the amounts due and payable on the Notes for principal; and

Priorities. If the Trustee collects any money or property pursuant to this Article 6, Six it shall pay out the such money or property in the following order: FIRSTFirst: to the Trustee for amounts due under Section 7.07; SECONDSecond: to Securityholders Holders for amounts due and unpaid interest accrued on the Securities for principal and interestNotes, ratably, without preference or priority of any kind, according to the amounts due and payable on the Securities Notes for principal and interest, respectively; and;

Priorities. (a) If the Trustee collects any money or other property pursuant to this Article 6Six in respect of the Notes, it shall pay out the money or and other property in the following order: FIRSTFirst: to the Trustee Trustee, its agents and attorneys for amounts due under Section 7.07; SECOND: to Securityholders for amounts due , including payment of all compensation, expense and unpaid on liabilities incurred, and all advances made, by the Securities for principal Trustee and interest, ratably, without preference or priority the costs and expenses of any kind, according to the amounts due and payable on the Securities for principal and interest, respectively; andcollection;

Priorities. If the Trustee collects any money or property pursuant to this Article 6, it shall pay out the money or property in the following order: FIRST: to the Trustee for amounts due under Section 7.07; SECOND: to Securityholders Holders of the Notes for amounts due and unpaid on the Securities Notes for principal and interest, ratably, without preference or priority of any kind, according to the amounts due and payable on the Securities Notes for principal and interest, respectively; and

Priorities. If the Trustee collects any money or property pursuant to this Article 6, it shall pay out the money or property in the following order: FIRST: to the Trustee for amounts due under Section 7.07; SECOND: to Securityholders for amounts due and unpaid on the Securities for principal and interest, ratably, without preference or priority of any kind, according to the amounts due and payable on the Securities for principal and interest, respectively; and;

Priorities. If the Trustee collects any money or property pursuant to this Article 6Six, it shall pay out the money or property in the following order: FIRSTFirst: to the Trustee for amounts due under Section 7.07; SECONDSecond: to Securityholders Holders for amounts due and unpaid on the Securities for principal and interest, ratably, without preference or priority of any kind, according to the amounts due and payable on the Securities for principal and interest, respectively; and

If the Trustee collects any money or property pursuant to this Article 6, it shall pay out the money or property in the following order: FIRSTFirst: to the Trustee Trustee, its agents and attorneys for amounts due under Section 7.07; SECOND: to Securityholders for amounts due 7.06 hereof, including payment of all compensation, expenses and unpaid on liabilities incurred, and all advances made, by the Securities for principal Trustee and interest, ratably, without preference or priority the costs and expenses of any kind, according to the amounts due and payable on the Securities for principal and interest, respectively; andcollection;

Priorities. If the Trustee collects any money or property pursuant to this Article 6, including upon enforcement of any Liens, it shall pay out the money or property in the following order: FIRST: to the Trustee Trustee, the Registrar, the Transfer Agent and the Paying Agents for amounts due under Section 7.07; SECOND: to Securityholders Holders for amounts due and unpaid on the Securities Notes for principal and interest, ratably, without preference or priority of any kind, according to the amounts due and payable on the Securities Notes for principal and interest, respectively; and

Priorities. If the Trustee collects any money or property pursuant to this Article 6Six, it shall pay out the money or property in the following order: FIRST: to the Trustee for amounts due under Section 7.07; SECOND: to Securityholders Holders for amounts due and unpaid on the Securities Notes for principal principal, premium, if any, and interestinterest (including Additional Interest, if any) as to each, ratably, without preference or priority of any kind, according to the amounts due and payable on the Securities for principal and interest, respectivelyNotes; and

Priorities. If the Trustee collects any money or property pursuant to this Article 6, it shall pay out the money or property in the following order: FIRST: to the Trustee for amounts due under Section 7.07; SECOND: to Securityholders the Holders for amounts due and unpaid on the Securities Notes for principal principal, premium, if any, and interest, ratably, without preference or priority of any kind, according to the amounts due and payable on the Securities Notes for principal and interest, respectively; and

Priorities. If the Trustee collects any money or property pursuant to this Article 6, it shall pay out the money or property in the following order: FIRST: to the Trustee for amounts due under Section 7.07; SECOND: to holders of Senior Indebtedness to the extent required by Article 10; THIRD: to Securityholders for amounts due and unpaid on the Securities for principal and interest, ratably, without preference or priority of any kind, according to the amounts due and payable on the Securities for principal and interest, respectively; and

Priorities. If the Trustee collects any money or property pursuant to this Article 6, it shall pay out the money or property in the following order: FIRST: to the Trustee for amounts due under Section 7.077.07 hereof; SECOND: if the Holders are forced to Securityholders proceed against the Company or any Guarantor directly without the Trustee, to Holders for amounts due and unpaid on the Securities for principal and interest, ratably, without preference or priority of any kind, according to the amounts due and payable on the Securities for principal and interest, respectively; andtheir collection costs;

Priorities. If the Trustee collects any money or property pursuant to this Article 6, it shall pay out the money or property in the following order: FIRST: to the Trustee for amounts due under Section 7.07; SECOND: if the Holders are forced to Securityholders proceed against the Company or any Guarantor directly without the Trustee, to Holders for amounts due and unpaid on the Securities for principal and interest, ratably, without preference or priority of any kind, according to the amounts due and payable on the Securities for principal and interest, respectively; andtheir collection costs;

Priorities. If the Trustee collects any money or property pursuant to this Article 6Six with respect to the Securities of a Series, it shall pay out the money or property in the following order: FIRST: to the Trustee for amounts due under Section 7.07; SECOND: to Securityholders for amounts due and unpaid on the Securities for principal and interest, ratably, without preference or priority of any kind, according to the amounts due and payable on the Securities for principal and interest, respectively; and:

Priorities. If the Trustee collects any money or property pursuant to this Article 6, it shall pay out the money or property in the following order: FIRST: to the Trustee for amounts due under Section 7.07; SECOND: to Securityholders Holders for amounts due and unpaid on the Securities Notes for principal principal, premium, if any, and interest, ratably, without preference or priority of any kind, according to the amounts due and payable on the Securities Notes for principal principal, premium, if any, and interest, respectively; and

Priorities. If the Trustee collects any money or property pursuant to this Article 6, it shall pay out the money or property in the following order: FIRST: to the Trustee for amounts due under Section 7.07; SECOND: to Securityholders Holders for amounts due and unpaid on the Securities for principal and interest, ratably, without preference or priority of any kind, according to the amounts due and payable on the Securities for principal and interest, respectively; and

Priorities. If the Trustee collects any money or property pursuant to this Article 6, it shall pay out the money or property in the following order: FIRST: to the Trustee for amounts due under Section 7.077.7; SECOND: to Securityholders Holders for amounts due and unpaid on the Securities Notes for principal and interest, ratably, without preference or priority of any kind, according to the amounts due and payable on the Securities Notes for principal and interest, respectively; and

Priorities. If the Trustee collects any money or property pursuant to this Article 6, it shall pay out the money or property in the following order: FIRST: to the Trustee for amounts due under Section 7.07; SECOND: to Securityholders for amounts due and unpaid on the Securities for principal and interest, ratably, without preference or priority of any kind, according to the amounts due and payable on the Securities for principal and interest, respectively; and7.06;

Priorities. If the Trustee collects any money or property pursuant to this Article 6Six, it shall pay out the money or property in the following order: FIRSTFirst: to the Trustee for amounts due under Section 7.07; SECONDSecond: to Securityholders Holders for amounts due and unpaid interest accrued on the Securities for principal and interestNotes, ratably, without preference or priority of any kind, according to the amounts due and payable on the Securities Notes for principal and interest, respectively; and;

Priorities. If the Trustee collects any money or property pursuant to this Article 6, it shall pay out the money or property in the following order: FIRST: to the Trustee for amounts due under Section 7.077.07 hereof; SECOND: to Securityholders for amounts due and unpaid on the Securities for principal principal, premium, if any, and interestinterest as to each, ratably, without preference or priority of any kind, according to the amounts due and payable on the Securities Securities; and THIRD: to the Company. The Trustee may fix a record date and payment date for principal and interest, respectively; andany payment to Securityholders pursuant to this Section 6.10.

Priorities. If the Trustee collects any money or property pursuant to this Article 6, it shall pay be held in trust by the Trustee and paid out the money or property in the following order: FIRSTFirst: to the Trustee Trustee, its agents and attorneys for amounts due under Section 7.07; SECOND: to Securityholders for amounts due 7.06 hereof, including payment of all compensation, expenses and unpaid on liabilities Incurred, and all advances made, by the Securities for principal Trustee and interest, ratably, without preference or priority the costs and expenses of any kind, according to the amounts due and payable on the Securities for principal and interest, respectively; andcollection;

Priorities. If the Trustee collects any money or property pursuant to this Article 6, it shall pay out the money or property in the following order: FIRSTFirst: to the Trustee (acting in any capacity hereunder or in connection herewith, including, without limitation, in its capacity as Collateral Agent), its agents and attorneys for amounts due under Section 7.07; SECOND: to Securityholders for amounts due 7.06 hereof, including payment of all compensation, expenses and unpaid on liabilities incurred, and all advances made, by the Securities for principal Trustee and interest, ratably, without preference or priority the costs and expenses of any kind, according to the amounts due and payable on the Securities for principal and interest, respectively; andcollection;

Priorities. If the Trustee collects any money or property pursuant to this Article 6, it shall pay out the money or property in the following order: FIRST: to the Trustee for amounts due under Section 7.077.7; SECOND: to Securityholders for amounts due and unpaid on the Securities for principal and interest, ratably, without preference or priority of any kind, according to the amounts due and payable on the Securities for principal and interest, respectively; and

Priorities. If the Trustee collects any money or property pursuant to this Article 6, it shall pay out the money or property in the following order: FIRST: to the Trustee and the Agents for amounts due under Section 7.02 and Section 7.07; SECOND: to Securityholders for amounts due and unpaid on the Securities for principal and interest, ratably, without preference or priority of any kind, according to the amounts due and payable on the Securities for principal and interest, respectively; and;

Priorities. If the Trustee collects any money or property pursuant to this Article 6, it shall pay out the money or property in the following order: FIRST: to the Trustee for amounts due under Section 7.07; SECOND: to Securityholders Holders for amounts due and unpaid on the Securities for principal and interest, ratably, and any additional interest without preference or priority of any kind, according to the amounts due and payable on the Securities for principal principal, interest and any additional interest, respectively; and

Priorities. If the Trustee collects any money or property pursuant to this Article 6, it shall pay out the money or property in the following order: FIRST: to the Trustee for amounts due under Section 7.07; SECOND: to Securityholders for amounts due and unpaid on holders of Senior Indebtedness of the Securities for principal and interest, ratably, without preference or priority of any kind, according Issuers to the amounts due extent required by Article 10 and payable on to holders of Senior Indebtedness of the Securities for principal and interest, respectively; andSubsidiary Guarantors to the extent required by Article 12;

Priorities. If the Trustee collects any money or property pursuant to this Article 6VII, it shall pay out the money or property in the following order: FIRSTFirst: to the Trustee for amounts due hereunder, including under Section 7.078.07; SECONDSecond: to Securityholders the Agents for amounts due and unpaid to them for services rendered hereunder; Third: to Holders for interest accrued on the Securities for principal and interestNotes, ratably, without preference or priority of any kind, according to the amounts due and payable on the Securities Notes for principal and interest, respectively; and;

Priorities. If the Trustee collects any money or property pursuant to this Article 6, including upon enforcement of any Liens, it shall pay out the money or property in the following order: FIRST: to the Trustee Trustee, the Registrar, the Transfer Agent and the Paying Agents for amounts due under Section 7.07; SECOND: to Securityholders Holders for amounts due and unpaid on the Securities Notes for principal and interestinterest (including Additional Interest, if any), ratably, without preference or priority of any kind, according to the amounts due and payable on the Securities Notes for principal and interest, respectively; and

Priorities. If the Trustee collects any money or property pursuant to this Article 6, it shall pay out the money or property in the following order: FIRSTFirst: to the Trustee Trustee, its agents and attorneys for amounts due under Section 7.07; SECOND: to Securityholders for amounts due 7.07 hereof, including payment of all compensation, expenses and unpaid on liabilities incurred, and all advances made, by the Securities for principal Trustee and interest, ratably, without preference or priority the costs and expenses of any kind, according to the amounts due and payable on the Securities for principal and interest, respectively; andcollection;

Priorities. If the Trustee collects any money or property pursuant to this Article 6, it shall pay out the money or property in the following order: FIRST: to the Trustee for amounts due under Section 7.07; SECOND: to Securityholders for amounts due and unpaid on the Securities for principal and interest, ratably, without preference or priority of any kind, according to the amounts due and payable on the Securities for principal and interest, respectively, in accordance with Article 2; and

Priorities. If the Trustee collects any money or property pursuant to this Article 6, it shall pay out the money or property in the following order: FIRST: to the Trustee for amounts due under Section 7.077.7; SECOND: to Securityholders for amounts due and unpaid on holders of senior indebtedness of the Securities for principal and interest, ratably, without preference or priority of any kind, according Company as certified to the amounts due and payable on Trustee by the Securities for principal and interest, respectively; andCompany;

Priorities. If Subject to Article 5, if the Trustee collects any money or property pursuant to this Article 68, it shall pay out the money or property in the following order: FIRST: First, to the Trustee for amounts due under Section 7.079.7; SECOND: Second, to Securityholders for amounts due and unpaid on the Securities for principal and interest, ratably, without preference or priority of any kind, according to the amounts due and payable on the Securities for principal and interest, respectively; and

Priorities. If the Trustee collects any money or property pursuant to this Article 6Six, it shall pay out the money or property in the following order: FIRSTFirst: to the Trustee for amounts due under Section 7.077.7, including the reasonable compensation, expenses, disbursements and advances of the Trustee, its agents and its counsel; SECONDSecond: if the Holders are forced to Securityholders proceed against the Company directly without the Trustee, to Holders for amounts due and unpaid on the Securities for principal and interest, ratably, without preference or priority of any kind, according to the amounts due and payable on the Securities for principal and interest, respectively; andtheir collection costs;

Priorities. If the Trustee collects any money or property pursuant to this Article 6, it shall pay out the money or property in the following order: FIRSTFirst: to the Trustee Trustee, the Collateral Agent, the Paying Agent and the Registrar for amounts due under Section 7.07; SECOND: to Securityholders for amounts due 7.07 hereof, including payment of all compensation, expenses and unpaid on liabilities incurred, and all advances made, by the Securities for principal Trustee or the Collateral Agent, as the case may be, and interest, ratably, without preference or priority the costs and expenses of any kind, according to the amounts due and payable on the Securities for principal and interest, respectively; andcollection;

Priorities. If the Trustee collects any money or ----------- property pursuant to this Article 6, it shall pay out the money or property in the following order: FIRST: to the Trustee for amounts due under Section 7.07; SECOND: to holders of Senior Indebtedness of the Company to the extent required by Article 10; THIRD: to Securityholders for amounts due and unpaid on the Securities for principal and interest, ratably, without preference or priority of any kind, according to the amounts due and payable on the Securities for principal and interest, respectively; and

Priorities. If the Trustee collects any money or property pursuant to this Article 6Five, it shall pay out the money or property in the following order: FIRSTFirst: to the Trustee for amounts due under Section 7.07; SECONDSecond: to Securityholders for amounts due and unpaid on the Securities for principal and interest, ratably, without preference or priority of any kind, according to the amounts due and payable on the Securities for principal and interest, respectively; andand Third: to the Company. The Trustee may fix a record date and payment date for any payment to Securityholders pursuant to this Section 6.10.

Priorities. If the Trustee collects any money or property pursuant to this Article 66 with respect to Securities of a Series, it shall pay out the money or property in the following order: FIRST: to the Trustee for amounts due under Section 7.07; SECOND: to Securityholders for amounts due and unpaid on the Securities for principal and interest, ratably, without preference or priority of any kind, according to the amounts due and payable on the Securities for principal and interest, respectively; and:

Priorities. If the Trustee collects any money or ---------- property pursuant to this Article 6, it shall pay out the money or property in the following order: FIRST: to the Trustee for amounts due under Section 7.07; SECOND: to Securityholders for amounts due and unpaid on holders of Senior Indebtedness of the Securities for principal and interestCompany and, ratablyif such money or property has been collected from a Guarantor, without preference or priority to holders of any kindSenior Indebtedness of such Guarantor, according in each case to the amounts due extent required by Article 10 and payable on the Securities for principal and interest, respectively; and12;

Priorities. If the Trustee collects any money or property pursuant to this Article 6, it shall pay out the money or property in the following order: FIRST: to the Trustee for amounts due under Section 7.07; SECOND: to Securityholders for amounts due and unpaid on holders of Senior Indebtedness of the Securities for principal and interestCompany and, ratablyif such money or property has been collected from a Guarantor, without preference or priority to holders of any kindSenior Indebtedness of such Guarantor, according in each case to the amounts due extent required by Article 10 and payable on the Securities for principal and interest, respectively; and12;

Priorities. If the Trustee collects any money or property pursuant to this Article 6Article, it shall pay out the money or property in the following order: FIRSTFirst: to the Trustee for amounts due under Section 7.07; SECONDSecond: to Securityholders Holders of Securities in respect of which or for the benefit of which such money has been collected for amounts due and unpaid on the such Securities for principal and interest, ratably, without preference or priority of any kind, according to the amounts due and payable on the such Securities for principal and interest, respectively; and

Priorities. If the Trustee collects any money or property pursuant to this Article 6Six, it shall pay out the money or property in the following order: FIRST: to the Trustee for amounts due under Section 7.07; SECOND: to Securityholders for the payment of the amounts then due and unpaid on upon the Securities Notes for principal (and premium, if any) and interest, in respect of which or for the benefit of which such money has been collected, ratably, without preference or priority of any kind, according to the amounts due and payable on the Securities such Notes for principal (and premium, if any) and interest, respectively; andand THIRD: to the Issuer.

Priorities. If the Trustee collects any money or property pursuant to this Article 6, it shall pay out the money or property in the following order: FIRST: to the Trustee Trustee, the Agents for amounts due under Section 7.02 and Section 7.07; SECOND: to Securityholders for amounts due and unpaid on the Securities for principal and interest, ratably, without preference or priority of any kind, according to the amounts due and payable on the Securities for principal and interest, respectively; and;

Priorities. If the Trustee collects any money or property pursuant to this Article 6, it shall pay out the money or property in the following order: FIRST: to the Trustee Trustee, its agents and attorneys, for amounts due under Section 7.07; SECOND: to Securityholders for amounts due and unpaid on the Securities for principal and interest, ratably, without preference or priority of any kind, according to the amounts due and payable on the Securities for principal and interest, respectively; and7.6;

Priorities. If the Trustee collects any money or property pursuant to this Article 6, it shall pay out the money or property in the following order: FIRST: to the Trustee for amounts due under Section 7.077.7 hereof; SECOND: to Securityholders for amounts due and unpaid on the Securities for principal principal, premium and interest, ratably, without preference or priority of any kind, according to the amounts due and payable on the Securities for principal principal, payment and interest, respectively; and

Priorities. If the Trustee collects any money or property pursuant to this Article 6, it shall pay out the money or property in the following order: FIRST: to the Trustee for amounts due under Section 7.077.7; SECOND: to holders of Senior Indebtedness to the extent required by Article 10; THIRD: to Securityholders for amounts due and unpaid on the Securities for principal and interest, ratably, without preference or priority of any kind, according to the amounts due and payable on the Securities for principal and interest, respectively; and

Priorities. If the Trustee collects any money or property pursuant to this Article 6Article, it shall pay out the money or property in the following order: FIRST: to the Trustee for amounts due under Section 7.07; SECOND: to Securityholders for amounts due and unpaid on the Securities for principal and interest, ratably, without preference or priority of any kind, according to the amounts due and payable on the Securities for principal and interest, respectively; and

If the Trustee collects any money or property pursuant to this Article 67, it shall pay out the money or property in the following order: FIRSTFirst: to the Trustee for amounts due under Section 7.078.07; SECONDSecond: to Securityholders Holders for amounts due and unpaid interest accrued on the Securities for principal and interestNotes, ratably, without preference or priority of any kind, according to the amounts due and payable on the Securities Notes for principal and interest, respectively; and;

If the either Trustee collects any money or property pursuant to this Article 6, it shall pay out the money or property in the following order: FIRST: to each of the Trustee Trustees for amounts due under Section 7.077.7; SECOND: to Securityholders Holders for amounts due and unpaid on the Securities Notes for principal and interest, ratably, and Applicable Premium (if any), ratably, without preference or priority of any kind, according to the amounts due and payable on the Securities Notes for principal and interestinterest and Applicable Premium (if any), respectively; and

Priorities. If the Trustee collects any money or property pursuant to this Article 6, it shall pay out the money or property in the following order: FIRST: to the Trustee for amounts due under Section 7.07; SECOND: to Securityholders Holders for amounts due and unpaid on the Securities of such series in respect of which or for the benefit of which such money has been collected for principal and interest, ratably, without preference or priority of any kind, according to the amounts due and payable on the such Securities for principal and interest, respectively; and

Priorities. If the Trustee collects any money or property pursuant to this Article 6, it shall pay out the money or property in the following order: FIRST: to the Trustee for amounts due under Section 7.07; SECOND: to Securityholders the Holders for amounts due and unpaid on the Securities for principal principal, premium, if any, and interest, ratably, without preference or priority of any kind, according to the amounts due and payable on the Securities for principal and interest, respectively; and

If the Trustee collects any money or property pursuant to this Article 6, it shall pay out the money or property in the following order: FIRST: : (1) to the Trustee and its agents and attorneys for amounts due under Section 7.07; SECOND: to Securityholders for amounts due 7.06, including payment of all reasonable compensation, expenses and unpaid on liabilities incurred, and all advances made, by the Securities for principal Trustee and interest, ratably, without preference or priority the costs and expenses of any kind, according to the amounts due and payable on the Securities for principal and interest, respectively; andcollection;

If the Trustee collects any money or property pursuant to this Article 6, it shall pay out the money or property in the following order: FIRST: to the Trustee for amounts due under Section 7.07; SECOND: to Securityholders for amounts due and unpaid on the Securities for principal and interest, ratably, without preference or priority holders of any kind, according Senior Debt to the amounts due and payable on the Securities for principal and interest, respectively; andextent required pursuant to Article 10;

Priorities. If the Trustee collects any money or property pursuant to this Article 6Seven, it shall pay out the money or property in the following order: FIRSTFirst: to the Trustee for amounts due hereunder, including under Section 7.078.07; SECONDSecond: to Securityholders the Agents for amounts due and unpaid to them for services rendered hereunder; Third: to Holders for interest accrued on the Securities for principal and interestNotes, ratably, without preference or priority of any kind, according to the amounts due and payable on the Securities Notes for principal and interest, respectively; and;

Priorities. If the Trustee collects any money or property pursuant to this Article 6, it shall hold such money as mandatary in trust and pay out the such money or property in the following order: FIRSTFirst: to the Trustee Trustee, its agents and attorneys for amounts due under Section 7.07; SECOND: to Securityholders for amounts due 7.06 hereof, including payment of all compensation, expenses and unpaid on liabilities incurred, and all advances made, by the Securities for principal Trustee and interest, ratably, without preference or priority the costs and expenses of any kind, according to the amounts due and payable on the Securities for principal and interest, respectively; andcollection;

If the Trustee collects any money or property pursuant to this Article 6, it shall pay out the money or property in the following order: FIRSTFirst: to the Trustee for amounts due under Section 7.07; SECONDSecond: to Securityholders Holders for amounts due and unpaid interest accrued on the Securities for principal and interestNotes, ratably, without preference or priority of any kind, according to the amounts due and payable on the Securities Notes for interest; Third: to Holders for principal amounts due and interestunpaid on the Notes, respectivelyratably, without preference or priority of any kind, according to the amounts due and payable on the Notes for principal; and

If the Trustee collects any money or property pursuant to this Article 6Six, it shall pay out the money or property in the following order: FIRST: to the Trustee for amounts due under Section 7.07; SECOND: to Securityholders Holders for amounts due and unpaid on the Securities Notes for principal principal, premium, if any, and interestinterest (including Additional Interest, if any) as to each, ratably, without preference or priority of any kind, according to the amounts due and payable on the Securities for principal and interest, respectivelyNotes; and

If the Trustee collects any money or property pursuant to this Article 6Six, it shall pay out the money or property in the following order: FIRSTFirst: to the Trustee for amounts due under Section 7.07; SECONDSecond: subject to Securityholders Articles Eight and Twelve, to Holders for amounts due and unpaid on the Securities for principal and interest, ratably, without preference or priority of any kind, according to the amounts due and payable on the Securities for principal and interest, respectively; and

Priorities. If the Trustee collects any money or property pursuant to this Article 6Six, it shall pay out the money or property in the following order: FIRST: to the Trustee for amounts due under Section 7.077.08 of this Indenture; SECOND: to Securityholders for amounts due and unpaid on holders of Senior Indebtedness of the Securities for principal and interestCompany and, ratablyif such money or property has been collected from a Subsidiary Guarantor, without preference or priority to holders of any kindSenior Indebtedness of such Subsidiary Guarantor, according in each case to the amounts due extent required by Articles Ten and payable on the Securities for principal and interest, respectively; andTwelve of this Indenture;

Priorities. If the Trustee collects any money or property pursuant to this Article 6, it shall pay out the money or property in the following order: FIRST: to the Trustee for amounts due under Section 7.07; SECOND: to Securityholders Holders for amounts due and unpaid on the Securities Notes for principal and interest, interest ratably, without preference or priority of any kind, according to the amounts due and payable on the Securities Notes for principal and interest, interest respectively; and

Priorities. If the Trustee collects any money or property pursuant to this Article 6Article, it shall pay out the money or property in the following order: FIRSTFirst: to the Trustee for amounts due under Section 7.07; SECONDSecond: to Securityholders of the Series for amounts due and unpaid on the Securities Series for principal and interest, ratably, without preference or priority of any kind, according to the amounts due and payable on the Securities Series for principal and interest, respectively; andand Third: to the Company or the Guarantors as their interests may appear. The Trustee may fix a record date and payment date for any payment to Securityholders pursuant to this Section 6.10.

If the Trustee collects any money or property pursuant to this Article 6, it shall pay out the money or property in the following order: FIRST: , subject to the Trustee for amounts due under Section 7.07; SECOND: to Securityholders for amounts due and unpaid on the Securities for principal and interest, ratably, without preference or priority of any kind, according to the amounts due and payable on the Securities for principal and interest, respectively; andapplicable law:

(a) If the Trustee collects any money or other property pursuant to this Article 6Six in respect of the Notes, it shall pay out the money or and other property in the following order: FIRSTFirst: to the Trustee Trustee, its agents and attorneys for amounts due under Section 7.07; SECOND: to Securityholders for amounts due 7.06, including payment of all compensation, expense and unpaid on liabilities incurred, and all advances made, by the Securities for principal Trustee and interest, ratably, without preference or priority the costs and expenses of any kind, according to the amounts due and payable on the Securities for principal and interest, respectively; andcollection;

If the Trustee collects any money or property pursuant to this Article 6Six, it shall pay out the money or property in the following order: FIRSTFirst: to the Trustee for all amounts due under Section 7.07; SECONDSecond: to Securityholders Holders for amounts then due and unpaid for principal of, premium, if any, and interest on the Securities Notes in respect of which or for principal and interestthe benefit of which such money has been collected, ratably, without preference or priority of any kind, according to the amounts due and payable on the Securities such Notes for principal principal, premium, if any, and interest, respectively; and

If the Trustee collects any money or property pursuant to this Article 6, it shall pay out the money or property in the following order: FIRST: to the Trustee for amounts due under Section 7.077.7; SECOND: to Securityholders for amounts due and unpaid on the Securities for principal and principal, interest, ratably, without preference or priority of any kind, according to the amounts due and payable on the Securities for principal principal, interest and interestLiquidated Damages (if any), respectively; and

If the Trustee collects any money or property pursuant to this Article 65, it shall pay out the money or property in the following order: FIRST: (i) First: to the Trustee and any Paying Agent and their respective agents and attorneys for amounts due under Section 7.07; SECOND: to Securityholders for amounts due underSection 6.06, including payment of all compensation, expenses and unpaid on liabilities incurred, and all advances made, by the Securities for principal Trustee and interest, ratably, without preference or priority any Paying Agent and the costs and expenses of any kind, according to the amounts due and payable on the Securities for principal and interest, respectively; andcollection;

Priorities. If the Trustee collects any money or property pursuant to this Article 6, it shall pay out the money or property in the following order: FIRST: to the Trustee and the Agents for amounts due under Section 7.07; SECOND: to Securityholders for amounts due 7.02 and unpaid on the Securities for principal and interest, ratably, without preference or priority of any kind, according to the amounts due and payable on the Securities for principal and interest, respectively; andSection 7.07 ;

Priorities. If the Trustee collects any money or property pursuant to this Article 6, it shall pay out the money or property in the following order: FIRST: to the Trustee for amounts due under Section 7.07; SECOND: to Securityholders holders of Senior Indebtedness to the extent required by Article 10; THIRD: to Holders for amounts due and unpaid on the Securities for principal and interest, ratably, without preference or priority of any kind, according to the amounts due and payable on the Securities for principal and interest, respectively; and

Priorities. If the Trustee collects any money or property pursuant to this Article 6, including upon enforcement of any Liens, it shall shall, subject to Section 4 of the Collateral Agency Agreement, pay out the money or property in the following order: FIRST: to the Trustee for amounts due under Section 7.07; SECOND: to Securityholders Holders for amounts due and unpaid on the Securities Notes for principal and interest, ratably, without preference or priority of any kind, according to the amounts due and payable on the Securities Notes for principal and interest, respectively; and

If the Trustee collects any money or property pursuant to this Article 65, it shall pay out the money or property in the following order: FIRST: to the Trustee for amounts due under Section 7.076.07; SECOND: to Securityholders for amounts due and unpaid on the Securities for principal and interest, ratably, without preference or priority of any kind, according to the amounts due and payable on the Securities for principal and interest, respectively; and

If the Trustee collects any money or property pursuant to this Article 66 with respect to any Series of Securities, it shall pay out the money or property in the following order: FIRST: to the Trustee for amounts due under Section 7.077.07 with respect to such Series of Securities; SECOND: to Securityholders Holders for amounts due and unpaid on the Securities of that Series for principal and interest, if any, ratably, without preference or priority of any kind, according to the amounts due and payable on the Securities of that Series for principal and interest, if any, respectively; and

If the Trustee collects any money or property property, with respect to Securities of any series, pursuant to this Article 6Six, it shall pay out the money or property in the following order: FIRST: to the Trustee for amounts due under Section 7.07; SECOND: to Securityholders for amounts due and unpaid on the Securities for principal and interest, ratably, without preference or priority of any kind, according to the amounts due and payable on the Securities for principal and interest, respectively; and:

If the Trustee collects any money or property pursuant to this Article 6, it shall pay out the money or property in the following order, subject to applicable law: FIRST: to the Trustee for amounts due under Section 7.077.7; SECOND: to Securityholders for amounts due and unpaid on the Securities for principal and interest, ratably, without preference or priority of any kind, according to the amounts due and payable on the Securities for principal and interest, respectively; and

Priorities. If the Trustee collects any money or property pursuant to this Article 6, it shall pay out the money or property in the following order: FIRST: to the Trustee for amounts due under Section 7.07; SECOND: to Securityholders for amounts due and unpaid on the Securities for principal and interest, ratably, and any liquidated damages without preference or priority of any kind, according to the amounts due and payable on the Securities for principal principal, any liquidated damages and interest, respectively; and

If the Trustee collects any money or property pursuant to this Article 6, it shall pay out the money or property in the following order: FIRST: to the Trustee for all amounts due under Section 7.07this Indenture; SECOND: to Securityholders Noteholders for amounts due and unpaid on the Securities Notes for principal and interest, ratably, without preference or priority of any kind, according to the amounts due and payable on the Securities Notes for principal and interest, respectively; and

If the Trustee collects any money or property pursuant to this Article 6, it shall pay out the money or property in the following order: FIRST: to the Trustee for amounts due under Section 7.07; SECOND: to Securityholders Noteholders for amounts due and unpaid on the Securities Notes for principal principal, premium, if any, and interest, ratably, without preference or priority of any kind, according to the amounts due and payable on the Securities Notes for principal principal, premium, if any, and interest, respectively; and

If the Trustee collects any money or property pursuant to this Article 6, it shall pay out the money or property in the following order: FIRST: to the Trustee for amounts due under Section 7.07; SECOND: to Securityholders Holders for amounts due and unpaid on the Securities Notes for principal and interest, ratably, and any Additional Interest, without preference or priority of any kind, according to the amounts due and payable on the Securities Notes for principal and interest, including any Additional Interest, respectively; and

If the Trustee collects any money or property pursuant to this Article 6, it shall pay out the money or property in the following order: FIRST: to the Trustee for amounts due under Section 7.07; SECOND: to Securityholders for amounts due and unpaid on the Securities for principal and interest, ratably, without preference or priority of any kind, according to the amounts due and payable on the Securities for principal and interest, respectively; andand THIRD: to the Company. The Trustee may fix a record date and payment date for any payment to Securityholders pursuant to this Section.
