Common use of Prior to Commercial Operation Clause in Contracts

Prior to Commercial Operation. If termination for a Generator Event of Default occurs prior to commercial operation of the facility, Generator will pay, as liquidated damages, a sum equal to the completion and performance security (i.e. $50,000 per MW of Contract Capacity) and AESO’s remedies are limited to such amount. 
