Common use of Prior Contracts Clause in Contracts

Prior Contracts. This Contract supersedes and terminates, as of the date hereof, all prior contracts between the Company and the Custodian relating to the custody of each Fund's assets. This Contract shall not be assignable by any party hereto; provided however, that any entity into which the Company or the Custodian, as the case may be, may be merged or converted or with which it may be consolidated, or any entity succeeding to all or substantially all of the business of the Company or the custody business of the Custodian, shall succeed to the respective rights and shall assume the respective duties of the Company or the Custodian, as the case may be, hereunder.
