Pricing and Charges. 9.1. Customer agrees to the pricing for, and to pay all charges incurred for use of, the Services in accordance with the Marketplace Order, Marketplace Listing and this XXXX (collectively, “Charges”).
Pricing and Charges. Charges for DIA Service include monthly recurring charges (MRC(s)”) and non-recurring charges (“NRC(s)”) as set forth in applicable Service Order. MRCs and NRCs contained in a Service Order are firm for the Service Term reflected on the related Service Order. Notwithstanding the foregoing, if Customer requests additional DIA Service or a change to an existing Service Order including but not limited to a Service Order change, supplement or tech assist which could incur additional NRCs, such NRCs are subject to change upon thirty (30) calendar days written or electronic notice. Upon expiration of the Service Term and until a new Service Order is placed, Customer charges for Lackawanna County Services, as set forth in the Service Order shall continue to apply throughout any Extension Period. Notwithstanding the foregoing, promotional pricing is subject to change at the end of the Service Term, or anytime thereafter, upon thirty (30) calendar day’s prior written or electronic notice. At the end of a Service Term or Extension Period, Customer may place a new Service Order specifying a new Service Term, and such Service Order shall set forth the charges for the new Service Term.

Gas trading that takes place within the framework of the Agreement is normally priced according to the terms and conditions set forth in Annex 6 and in case of National Balancing priced according to the terms and conditions set forth in Annex 5. The Balance Administrator is hereby obliged to pay for purchased Natural Gas in accordance with the rules set forth in Annexes 5 and 6. Accordingly, the Balance Administrator is entitled to receive payment for Natural Gas sold according to the rules set forth in Annexes 5 and 6. The Balance Administrator shall – in addition to the provisions regarding gas trading set forth in the preceding paragraph - pay Swedegas’ at each time prevailing charges which are set forth in the, at each time, prevailing version of Annex 5.

Authorized Customer personnel shall have 24/7/365 access to the Space. Customer shall not have access to space until it is contractually obligated to obtain Colocation Services relating to such Space through the provisions of the Agreement or DataBank acceptance of a Service Order Form for that Space. Customer will designate an individual(s) responsible for maintaining an access list of approved customer personnel and contractors who are authorized to have access to Space on behalf of customer. Each authorized individual will be issued an access card prior to gaining access to the facility. DataBank may revoke the access of any individual to a site or Space for reasonable cause. Such revocation shall be effective immediately. 4. Delay of Service. If DataBank fails to make Colocation Services available within thirty (30) calendar days after the Colocation Effective Date set forth in the Service Order due to any reason other than the acts or omissions of Customer, Customer’s sole remedy shall be to cancel the Service Order which pertains to such Colocation Service by written notice to DataBank. DataBank shall not be liable to Customer in any way as a result of such delay or failure to tender possession and Customer shall not be liable for any charges accruing as a result of the canceled Service Order. DataBank shall promptly refund any charges attributable to such Service Order that Customer has paid. 5. Removal of Customer Equipment. All fixtures, excluding customer equipment, alterations, additions, repairs, improvements and/or appurtenances attached to or built into, on or about the Space or any conduit and/or pole prior to or during the Service Term, or Extension Period, if any, whether ...

Pricing and Charges. Charges for DIA Service and/or MPLS IPVPN Service include monthly recurring charges (“MRC(s)”) and non-recurring charges (“NRC(s)”) as set forth in applicable Service Order and/or quote (“Quote”) referenced in such Service Order, and are further subject to the terms and conditions of the applicable DIA and/or MPLS IPVPN Service Schedules.

The Customer shall be liable for and upon the placement of each order for the production or supply of Products, including any Products held by Sydney Packaging in their warehouses, being shipped or under manufacture, for the Price of the Products ordered, plus any other fees and charges provided in any applicable Quotation, any taxes (including GST) or duties payable by for the production, supply or delivery of the Products, the applicable freight and carrier charges, and any other fees or charges payable under these Terms; in full, without set-off or deduction. In the event that Sydney Packaging is only able to supply part of the Products in any order, then the Customer shall be liable for the Price for those goods supplied under a separate contract of sale. The Customer shall not be relieved of any obligation to accept any Products or to pay for them, by reason of any delay in their delivery or dispatch.
