Preservation and Maintenance. Borrower shall, and shall cause Owner to, (i) not permit or commit waste, impairment, or deterioration of the Collateral Property or abandon the Collateral Property, (ii) not remove, demolish or structurally alter or permit or suffer the removal, demolition or alteration of any Building except with the prior written consent of Lender, which consent shall not be unreasonably withheld, delayed or conditioned, (iii) restore or repair promptly and in a good and workmanlike manner all or any part of the Collateral Property in the event of any damage, injury or loss thereto, to the equivalent of its condition prior to such damage, injury or loss, or such other condition as Lender may approve in writing, (iv) keep the Collateral Property, including the improvements thereon and any fixtures, equipment, machinery and personal property, in good order, repair and tenantable condition (subject to ordinary wear and tear, casualty and condemnation) and shall replace fixtures, equipment, machinery and personal property on the Collateral Property when necessary to keep such items in good order, repair, and tenantable condition, and (v) keep all trademarks, tradenames, servicemarks and licenses and permits necessary for the use and occupancy of the Collateral Property in good standing and in full force and effect and free and clear of all liens and encumbrances other than Permitted Liens. None of Borrower, Owner or any tenant or other Person shall remove, demolish or alter any Building now existing or hereafter erected on the Collateral Property or any other fixtures, equipment, machinery or personal property in or on the Collateral Property except when incident to the replacement of fixtures, equipment, machinery or other personal property with items of like kind and value. Borrower shall, and shall cause Owner to, comply with the asbestos operations and maintenance program in effect as of the date hereof (if any) or adopted hereafter with respect to the Collateral Property, and shall, and shall cause Owner to, not discontinue or materially modify such program without Lender’s prior written consent. In the event that Borrower or Owner shall remove any asbestos or asbestos-containing materials after the date hereof, such removal shall be performed in accordance with all applicable laws and, upon the request of Lender, Borrower shall provide evidence of such compliance to Lender.

Preservation and Maintenance. (i) Trustor will preserve and maintain the Trust Property in accordance with the applicable provisions of the Indenture. Further, Trustor shall keep all of the Trust Property in good condition and repair and expressly agrees that it will neither permit nor commit any waste upon the Trust Property, nor do any other act or suffer or permit any act to be done, whereby the Lien hereof may be impaired. Trustor shall comply in all material respects with all zoning laws, building codes, subdivision laws, gaming and liquor laws (including without limitation the Colorado Liquor Code and the Colorado Limited Gaming Act and their respective regulations), and other applicable laws, and Trustor shall not become involved in conduct that would cause either the Gaming or Liquor Licenses relating to the Trust Property to be suspended or revoked. Trustor agrees not to initiate or acquiesce in any zoning variance or reclassification which would prohibit the use of the Trust Property for its intended purposes. Trustor shall at all times comply in all material respects with applicable restrictive covenants and the terms and conditions of all other Permitted Liens relating to the Trust Property. Notwithstanding anything above to the contrary, to the extent expressly permitted by the Indenture, Trustor may remove or sell any fixture, equipment, machinery or appliance in or on the Trust Property incident to the replacement of such items with replacements leased or purchased by Trustor with the proceeds of FF&E Financing.

Should any material require any l preservation till its final installation/fitment, the detailed procedure (Long term & short term) for the same as also the time of interval after which the state of preservation needs to be reviewed is to be stated by the Xxxxxx/Xxxxxxxx/Xxxxxxxxxx. X00. Further the de-preservation prior to the material/equipment being commissioned and the maintenance procedure together with its periodicity is also to be indicated by the Bidder / Supplier / Contractor.
Preservation and Maintenance. The leased equipment shall only be used by LEASEE and its personnel, which agrees, on its own account and risk, to assume all expenses required to preserve the leased property and keep it in perfect conditions, except for the normal wear due to appropriate usage. The leased equipment shall be used according to its original purpose and kept in good condition. Supplier/manufacturer shall establish the normal use of the equipment, and LEASEE accepts to enter into maintenance contracts with such supplier or manufacturer or person authorized by them, to contribute to the preservation and proper performance of the equipment. Additionally, LEASEE agrees to comply with all laws, pacts, decrees, resolutions, regulations, or any other regulatory disposition, or a disposition related to the equipment's usage and maintenance, even if these standards are international, national or municipal, or if they are issued by the country in which the equipment is located.

Preservation and Maintenance. Mortgagor (a) shall not permit or commit waste, impairment, or deterioration of the Property or abandon the Property, (b) shall restore or repair promptly and in a good and workmanlike manner all or any part of the Property in the event of any damage, injury or loss thereto, to the equivalent of its condition prior to such damage, injury or loss, or such other condition as the Collateral Agent may approve in writing, (c) shall keep the Property, including the Improvements, in good order, repair and tenantable condition and shall replace fixtures, equipment, machinery and appliances on the Property when necessary to keep such items in good order, repair, and tenantable condition, and (d) shall comply with all laws, ordinances, regulations and requirements of any governmental body, as well as any reciprocal easement agreements or covenants of record, applicable to the Property, subject to the Mortgagor's right to contest, provided such contest complies with terms of Section 5.5
