Preliminary Findings. The Court has conducted a preliminary assessment 16 of the fairness, reasonableness, and adequacy of the Settlement. Based on this evaluation, the Court finds that (a) the Settlement falls within the range of reasonableness meriting further proceedings; (b) the Settlement has been negotiated 20 in good faith and at arm's length between experienced attorneys familiar with the legal 21 and factual issues of this case and with the assistance of the Xxx. Xxxxxx X. Infante 22 (Xxx.), a well-respected and experienced private mediator; and (c) dissemination of 23 the notice of the material terms of the Settlement to Settlement Class Members is warranted. Preliminary Findings. There will be timely interim discussions of preliminary findings with the goal of reaching agreement on each potential issue at the earliest point in the review. An exit meeting will be held for each site reviewed. The primary purpose of these meetings is to verify facts related to the audits or attestation engagements or other documentation. At the completion of the fieldwork, the review team will hold an exit briefing. The purpose of this exit briefing is to discuss the preliminary results of the peer review, the opinion to be expressed, and any areas of noncompliance.

Preliminary Findings. Where the information revealed early in the investigation suggests a reasonable possibility of resolution, the Executive Director may decide to propose an early settlement prior to conducting the entire investigation. Where this situation arises, the Executive Director will convene a meeting with the parties involved to discuss preliminary findings of the investigation and inform participants of the possibility and nature of an early settlement and give reasons. This stage allows all parties to become aware of the tentative findings and presents an opportunity, based on the information, to resolve the matters upon agreement of all parties without further investigation
