Common use of Preliminary Approval Order Clause in Contracts

Preliminary Approval Order. “Preliminary Approval Order” means an Order of the Court preliminarily approving the Settlement, conditionally or preliminarily certifying a class for settlement purposes, directing the issuance of a class notice and scheduling a settlement hearing in accordance with Fed.R.Civ.P. 23, in a form substantially similar to that attached hereto as Exhibit B.

Preliminary Approval Order. “Preliminary Approval Order” means an Order of the order entered and filed by the Court that preliminarily approving approves the Settlementterms and conditions of this Agreement, conditionally or preliminarily certifying a class for settlement purposes, directing including without limitation the issuance manner and content of a class providing notice and scheduling a settlement hearing in accordance with Fedto the Class.R.Civ.P. 23, in a form substantially similar to that attached hereto as Exhibit B.

Preliminary Approval Order. “Preliminary Approval Order” means an the Order of entered by the Court preliminarily approving the Settlementterms and conditions of this Agreement, conditionally or preliminarily certifying a class for settlement purposes, and directing the issuance manner and timing of a class notice and scheduling a settlement hearing in accordance with Fedproviding Notices to the Class Members.R.Civ.P. 23, in a form substantially similar to that attached hereto as Exhibit B.

Preliminary Approval Order. The term “Preliminary Approval Order” means shall mean an Order of order entered by the Court preliminarily approving the SettlementSettlement Agreement, conditionally or preliminarily certifying a class setting the manner and form of the Class Notice, setting the date for settlement purposesthe Fairness Hearing, directing and identical in all material respects to the issuance of a class notice and scheduling a settlement hearing in accordance with Fed.R.Civ.P. 23, in a form substantially similar to that proposed Preliminary Approval Order attached hereto as Exhibit B.4.

Preliminary Approval Order. “Preliminary Approval Order” means an the Order of entered by the Court preliminarily approving the Settlement, conditionally or preliminarily certifying a class for settlement purposes, terms and conditions of this Agreement and directing the issuance manner and timing of a class notice and scheduling a settlement hearing in accordance with Fedproviding Notices to the Class Members.R.Civ.P. 23, in a form substantially similar to that attached hereto as Exhibit B.

Preliminary Approval Order. “Preliminary Approval Order” means an Order of the order entered by the Court preliminarily approving the Settlement, conditionally or preliminarily certifying a class for settlement purposes, terms and conditions of this Agreement and directing the issuance manner and timing of a class notice providing the Notices and scheduling a settlement hearing Claim Forms to the Settlement Class Members. A proposed version of the Preliminary Approval Order shall be submitted to the Court in accordance with Fed.R.Civ.P. 23, in a the form substantially similar to that attached hereto as Exhibit B.C.

Preliminary Approval Order. “Preliminary Approval Order” means an the Order of entered by the Court preliminarily approving the Settlementterms and conditions of this Agreement, conditionally or preliminarily certifying a class for settlement purposes, and directing the issuance manner and timing of a class notice and scheduling a settlement hearing in accordance with Fedproviding Notices to the Class Member.R.Civ.P. 23, in a form substantially similar to that attached hereto as Exhibit B.

Preliminary Approval Order. “Preliminary Approval Order” means an the Order of entered by the Court in substantially the form attached to Plaintiffs’ prospective motion for preliminary approval, preliminarily approving the Settlementterms and conditions of this Agreement, conditionally or preliminarily certifying a class for settlement purposes, and directing the issuance manner and timing of a class notice and scheduling a settlement hearing in accordance with Fedproviding Notices to the Class Members.R.Civ.P. 23, in a form substantially similar to that attached hereto as Exhibit B.

Preliminary Approval Order. “Preliminary Approval Order” means an Order the order signed by the Court conditionally approving this Settlement Agreement, approving the Class Notice, setting a date for a Settlement Hearing to determine the fairness of the Court preliminarily approving Settlement and setting deadlines for Class Members to opt-out and to object to the Settlementsettlement, conditionally or preliminarily certifying a class for settlement purposes, directing the issuance as provided in paragraphs 48 and 49 of a class notice and scheduling a settlement hearing in accordance with Fed.R.Civ.P. 23this Settlement Agreement, in a form substantially similar to that of which is attached hereto and incorporated herein as “Exhibit B.”

Preliminary Approval Order. As used herein, the terms “Preliminary Approval Order” means an the order provisionally certifying the Class for settlement purposes only, approving and directing notice, and setting the Fairness Hearing. The proposed Preliminary Approval Order of that Plaintiff submits to the Court preliminarily approving the Settlement, conditionally or preliminarily certifying a class for settlement purposes, directing the issuance of a class notice and scheduling a settlement hearing in accordance with Fed.R.Civ.P. 23, in a form its approval must be substantially similar to that the form attached hereto as Exhibit B.A.

Preliminary Approval Order. “Preliminary Approval Order” means an Order of the Court preliminarily approving the Settlement, conditionally or preliminarily certifying a class for settlement purposes, directing the issuance of a class notice and scheduling a settlement hearing in accordance with Fed.R.Civ.P. 23Mo. Rule 52.08, in a form substantially similar to that attached hereto as Exhibit B.

Preliminary Approval Order. “Preliminary Approval Order” means an the Order of entered by the Court preliminarily approving the Settlementterms and conditions of this Agreement, conditionally or preliminarily certifying a class including the manner and timing of providing notice to the Class, the time period for settlement purposesobjections and the date, directing time and location for the issuance of a class notice and scheduling a settlement hearing Fairness Hearing, substantially in accordance with Fed.R.Civ.P. 23, in a the form substantially similar to that attached hereto as Exhibit B.3.

Preliminary Approval Order. “Preliminary Approval Order” means an Order of the Court consistent with Paragraph 8, preliminarily approving the Settlement, conditionally or preliminarily certifying a Settlement and modifying the class definition in the Class-Certification Order for settlement purposespurposes of the settlement, directing the issuance of a class notice notice, and scheduling a settlement hearing in accordance with Fedunder Missouri Supreme Court Rule 52.08.R.Civ.P. 23, in a form substantially similar to that attached hereto as Exhibit B.

Preliminary Approval Order. “Preliminary Approval Order” means an the Order of entered by the Court in the form attached as Exhibit D, preliminarily approving the Settlementterms and conditions of this Agreement, conditionally or preliminarily certifying a class for settlement purposes, and directing the issuance manner and timing of a class notice providing Notices to the Class Members, and scheduling a settlement hearing in accordance with Fedthe Fairness Hearing.R.Civ.P. 23, in a form substantially similar to that attached hereto as Exhibit B.

Preliminary Approval Order. “Preliminary Approval Order” means an Order of the Court consistent with Paragraph 7, preliminarily approving the Settlement, conditionally or preliminarily certifying a class for settlement purposessettlement, directing the issuance of a class notice and scheduling a settlement hearing in accordance with Fedunder Missouri Supreme Court Rule 52.08.R.Civ.P. 23, in a form substantially similar to that attached hereto as Exhibit B.

Preliminary Approval Order. “Preliminary Approval Order” means an Order of the Court preliminarily approving the Settlement, conditionally or preliminarily certifying a class for settlement purposes, directing the issuance of a class notice and scheduling a settlement hearing in accordance with Fed.R.Civ.P. Federal Rule 23, in a form substantially similar to that attached hereto as Exhibit B.

Preliminary Approval Order. “Preliminary Approval Order” means an Order of the Court preliminarily approving the Settlement, conditionally or preliminarily certifying a class for settlement purposes, directing the issuance of a class notice and scheduling a settlement hearing Settlement Hearing (as defined herein) in accordance with Fed.R.Civ.P. 23, in a form substantially similar to that attached hereto as Exhibit B.

Preliminary Approval Order. “Preliminary Approval Order” " means an Order executed version of the Court preliminarily approving the Settlement, conditionally or preliminarily certifying a class for settlement purposes, directing the issuance of a class notice and scheduling a settlement hearing in accordance with Fed.R.Civ.P. 23, in a form substantially similar to that Proposed Preliminary Approval Order attached hereto as Exhibit B.A, or a version substantially the same in material respects, to be entered by the Court granting, among other things, preliminary approval of the Agreement. Further revisions, if any, to Exhibit A are subject to final approval by the Parties and the Court, if necessary.

Preliminary Approval Order. “Preliminary Approval Order” means an the Order entered by the Arbitrator (i) conditionally certifying the Class under Federal Rule of Civil Procedure 23(b)(2) and 23(b)(3) solely for the Court preliminarily approving the Settlement, conditionally or preliminarily certifying a class for settlement purposes, directing the issuance purpose of a class notice and scheduling a settlement hearing in accordance with Fed.R.Civ.P. 23, in a form substantially similar to that attached hereto as Exhibit B.effectuating this Agreement;

Preliminary Approval Order. “Preliminary Approval Order” means shall mean an Order of the Court preliminarily or conditionally approving this Agreement and the Settlementsettlement provided herein, conditionally or preliminarily certifying a class for settlement purposesunder Rule 23 of the Federal Rules of Civil Procedure, directing substantially in the issuance of a class notice and scheduling a settlement hearing in accordance with Fed.R.Civ.P. 23, in a form substantially similar to that attached hereto as Exhibit B.D and made a part hereof.

Preliminary Approval Order. “Preliminary Approval Order” means an shall mean the Order of entered by the Court preliminarily approving approving, among other things, the Settlementterms and conditions of this Agreement, conditionally or preliminarily certifying a class the manner and timing of providing Notices to the Class Members, and the time period for settlement purposes, directing opt-outs and objections with respect to the issuance of a class notice and scheduling a settlement hearing in accordance with Fedsettlement.R.Civ.P. 23, in a form substantially similar to that attached hereto as Exhibit B.

Preliminary Approval Order. “Preliminary Approval Order” means an Order of entered by the Court preliminarily approving the Settlementterms and conditions of this Agreement, conditionally or preliminarily certifying a class for settlement purposes, and directing the issuance manner and timing of a class notice and scheduling a settlement hearing in accordance with Fedproviding Notices to the Class Members.R.Civ.P. 23, in a form substantially similar to that attached hereto as Exhibit B.

Preliminary Approval Order. “Preliminary Approval Order” means an the Order of entered by the Court Court: Class; (i) preliminarily approving the Settlement, conditionally or preliminarily certifying a class for settlement purposes, terms and conditions of this Agreement; (ii) directing the issuance manner and timing of a class notice providing Notice to the Class Members; and scheduling a settlement hearing in accordance with Fed.R.Civ.P. 23(iii) setting the dates and deadlines for effectuating settlement, in a form substantially similar including the Bar Date, date of the publication of Notice, and the Fairness Hearing date.
