Pre-Released Software. Should the applicable Quotation indicate that the licenses granted are for Software not yet commercially available ("Pre-Released Software"), then Beyond Identity grants Company a temporary, non-exclusive, non- transferable, revocable license to use the Pre-Released Software and the associated Documentation, if any, as provided to Company by Beyond Identity solely for internal evaluation purposes. Beyond Identity may terminate Company’s right to use the Pre-Released Software at any time at Beyond Identity’s sole discretion. Company’s use of the Pre-Released Software is limited to thirty (30) calendar days unless otherwise set forth in the applicable Quotation. Company acknowledges and agrees that (i) Beyond Identity has not promised or guaranteed to Company that the Pre-Released Software will be announced or made available to anyone in the future; (ii) Beyond Identity has no express or implied obligation to Company to announce or introduce the Pre-Released Software; (iii) Beyond Identity may not introduce Software similar to or compatible with the Pre-Released Software; and (iv) any use of the Pre-Released Software or any Software associated with the Pre-Released Software is entirely at Company’s own risk. During the term of this SaaS Agreement, if requested by Beyond Identity, Company will provide feedback to Beyond Identity regarding use of the Pre-Released Software. Company will not disclose any features or functions of any Pre- Released Software until Beyond Identity makes the Pre-Released Software publicly available.

  • Client Software You may only use the client software with the ERP solution. You may install an unlimited number of copies of the client software to access your ERP solution.

  • Embedded Software To the extent any goods contain Embedded Software (defined below) that is not Buyer’s Property, no title to such Embedded Software shall pass to Buyer, and Supplier shall grant Buyer, its customers and all other users a non-exclusive worldwide, irrevocable, perpetual, royalty-free right to use, load, install, execute, demonstrate, market, test, resell, sublicense and distribute such Embedded Software as an integral part of such goods or for servicing the goods (the “Buyer-Required License”).   • Supplemental JBoss Software Conditions Software Access and Software Maintenance for Supplemental JBoss Software is intended and available for Development Purposes only and for up to 25 users for each 16 Core Band Subscription of Red Hat JBoss Middleware Software that you purchased. If you deploy or use the Supplemental JBoss Software for Production Purposes or for more than 25 users, you agree to purchase the appropriate Software Subscriptions for each Unit that you deploy or use. Red Hat’s Open Source Assurance Program applies only to the Red Hat JBoss Middleware Software Subscription that you purchased (such as Red Hat JBoss Enterprise Application Platform in the example above) and does not apply to Supplemental JBoss Software. JBoss xPaaS Subscriptions (defined below) are not considered Supplemental JBoss Software. Each installation and use of JBoss xPaaS Subscriptions Software for either Development Purposes or Production Purposes is a Unit and requires a paid Software Subscription.

  • Limited Software Warranty MyECheck represents, warrants, and covenants that: MyECheck warrants to the original end user (“Customer”), and not to subsequent end users, of the Extreme Networks software product (“Software”) that for ninety (90) days from the date of installation of the Software from MyECheck, the Software shall substantially conform with the specification for the Software at the (“Documentation”). MyECheck does not warrant (i) that the Software is error free, (ii) that Customer will be able to operate the Software without problems or interruptions or (iii) that the Software will be free of vulnerability to intrusion or attack. Except for the limited warranty set forth in this section, the Software is provided “AS IS.”

  • Licensed Software Computer program(s) provided by Contractor in connection with the Deliverables, subject to Section 14 of this Contract.

Red Hat Enterprise Virtualization is designed to run and manage virtual instances and does not support user-space applications. Red Hat Enterprise Virtualization may be used as a virtual desktop infrastructure solution, however, the Subscription does not come with any software or support for the desktop operating system. You must purchase the operating system for each instance of a desktop or server separately.

  • Software Warranty We warrant that the Tyler Software will perform without Defects during the term of this Agreement. If the Tyler Software does not perform as warranted, we will use all reasonable efforts, consistent with industry standards, to cure the Defect in accordance with the maintenance and support process set forth in Section C(9), below, the SLA and our then current Support Call Process.
