Common use of Pre-Ordering Clause in Contracts

Pre-Ordering. In accordance with FCC and Commission rules and orders, BellSouth will provide electronic access to the following pre-ordering functions: service address validation, telephone number selection, service and feature availability, due date information and customer record information. Access is provided through the Local Exchange Navigation System (LENS) interface and the Telecommunications Access Gateway (TAG) interface. Customer record information includes customer specific information in XXXX and RSAG. SPARDI shall provide to BellSouth access to customer record information including circuit numbers associated with each telephone number where applicable. SPARDI shall provide such information within four (4) hours after request via electronic access where available. If electronic access is not available, SPARDI shall provide to BellSouth paper copies of customer record information including circuit numbers associated with each telephone number where applicable within twenty-four (24) hours of request. The Parties agree not to view, copy, or otherwise obtain access to the customer record information of any customer without that customer's permission. SPARDI will obtain access to customer record information only in strict compliance with applicable laws, rules, or regulations of the State in which the service is provided. BellSouth reserves the right to audit SPARDI‘s access to customer record information. If a BellSouth audit of SPARDI‘s access to customer record information reveals that SPARDI is accessing customer record information without having obtained the proper End User authorization, BellSouth upon reasonable notice toSPARDI may take corrective action, including but not limited to suspending or terminating SPARDI‘s electronic access to BellSouth’s OSS functionality. All such information obtained through an audit shall be deemed Information covered by the Proprietary and Confidential Information section in the General Terms and Conditions of this Agreement.

If electronic access is not availableOtherwise, SPARDI World Satellite Network America, Inc. shall provide to BellSouth paper copies of customer record information including circuit numbers associated with each telephone number where applicable within twenty-four (24) hours of request. the same intervals that BellSouth provides paper copies to World Satellite Network America, Inc.. The Parties agree not to view, copy, or otherwise obtain access to the customer record information of any customer without that customer's permission. SPARDI World Satellite Network America, Inc. will obtain access to customer record information only in strict compliance with applicable laws, rules, or regulations of the State in which the service is provided. BellSouth reserves the right to audit SPARDI‘s World Satellite Network America, Inc.’s access to customer record information. If a BellSouth audit of SPARDI‘s World Satellite Network America, Inc.’s access to customer record information reveals that SPARDI World Satellite Network America, Inc. is accessing customer record information without having obtained the proper End User authorization, BellSouth upon reasonable notice toSPARDI to World Satellite Network America, Inc. may take corrective action, including but not limited to suspending or terminating SPARDI‘s World Satellite Network America, Inc.’s electronic access to BellSouth’s OSS functionality. All such information obtained through an audit shall be deemed Information covered by the Proprietary and Confidential Information section in the General Terms and Conditions of this Agreement.
