Pre-Kindergarten Criteria. Pursuant to Texas Education Code Section 29.153, a student eligible to be served by the Provider under this Contract, is a child assigned to the Provider by ISD who is at least three years of age and: (1) is unable to speak and comprehend the English language; (2) is educationally disadvantaged as defined by Texas Education Code Section 5.001(4); (3) is a homeless child, as defined by 42 U.S.C. Section 11434a, regardless of the residence of the child, of either parent of the child, or of the child’s guardian or other person having lawful control of the child; (4) is the child of an active duty member of the armed forces of the United States of America, including the state military forces or a reserve component of the armed forces, who is ordered to active duty by proper authority; (5) is the child of a member of the armed forces of the Unites States of America, including the state military forces or a reserve component of the armed forces, who was injured or killed while serving on active duty; or (6) is or ever has been in the conservatorship of the Department of Family and Protective Services following an adversary hearing held as provided by Texas Family Code Section 262.201.

  • STATEWIDE ACHIEVEMENT TESTING When CONTRACTOR is an NPS, per implementation of Senate Bill 484, CONTRACTOR shall administer all Statewide assessments within the California Assessment of Student Performance and Progress (“CAASP”), Desired Results Developmental Profile (“DRDP”), California Alternative Assessment (“CAA”), achievement and abilities tests (using LEA-authorized assessment instruments), the Fitness Gram with the exception of the English Language Proficiency Assessments for California (“ELPAC”) to be completed by the LEA, and as appropriate to the student, and mandated by XXX xxxxxxxx to LEA and state and federal guidelines. CONTRACTOR is subject to the alternative accountability system developed pursuant to Education Code section 52052, in the same manner as public schools. Each LEA student placed with CONTRACTOR by the LEA shall be tested by qualified staff of CONTRACTOR in accordance with that accountability program. XXX shall provide test administration training to CONTRACTOR’S qualified staff. CONTRACTOR shall attend LEA test training and comply with completion of all coding requirements as required by XXX.

  • Human Leukocyte Antigen Testing This plan covers human leukocyte antigen testing for A, B, and DR antigens once per member per lifetime to establish a member’s bone marrow transplantation donor suitability in accordance with R.I. General Law §27-20-36. The testing must be performed in a facility that is: • accredited by the American Association of Blood Banks or its successors; and • licensed under the Clinical Laboratory Improvement Act as it may be amended from time to time. At the time of testing, the person being tested must complete and sign an informed consent form that also authorizes the results of the test to be used for participation in the National Marrow Donor program.

  • Selection Criteria Each Contract is secured by a new or used Motorcycle. No Contract has a Contract Rate less than 1.00%. Each Contract amortizes the amount financed over an original term no greater than 84 months (excluding periods of deferral of first payment). Each Contract has a Principal Balance of at least $500.00 as of the Cutoff Date.

  • Promotional Criteria Subject to the utilisation of the skills, as required by the Employer, an employee remains at this level until he/she has developed the skills to allow the employee to effectively perform the tasks required of this function and is assessed to be competent to perform effectively at a higher level or has successfully completed appropriate training to ASF level 1 and has the demonstrated skills to perform at a higher level. An employee must be prepared to undertake appropriate training. LEVEL 3

  • Exclusion Criteria Subjects fulfilling any of the following criteria are not eligible for participation in this study.

  • Drug Testing (A) The state and the PBA agree to drug testing of employees in accordance with section 112.0455, F.S., the Drug-Free Workplace Act.

  • Treatment Program Testing The Employer may request or require an employee to undergo drug and alcohol testing if the employee has been referred by the employer for chemical dependency treatment or evaluation or is participating in a chemical dependency treatment program under an employee benefit plan, in which case the employee may be requested or required to undergo drug or alcohol testing without prior notice during the evaluation or treatment period and for a period of up to two years following completion of any prescribed chemical dependency treatment program.
