Posting of Calls, Performance Schedules and Casting. ‌ The rehearsal call for the next day must be posted before the end of the rehearsal day, or when the company is also performing, before the half-hour call. It is the Artist's responsibility to find out when the Artist’s next call will be. If the Artist’s next scheduled call is changed, it is the responsibility of the Engager to notify the Artist no later than the night before the call. Failure to do so shall mean that an Artist appearing for the call as previously scheduled shall be deemed to be working. The complete cast list for an opera, operetta or musical theatre, with performance dates for each Artist, shall be posted on the call board, at least, six (6) days in advance of the first public performance and, in any event, before this information is released to the box office or news media.

It shall be the responsibility of the Engager to notify the Artist (including Stage Management) by telephone of changes in the Artist's call which are made at or after 11:00 p.m. If the Engager does not reach the Artist personally and the Artist does not receive the message (by phone or email) in time to reasonably make the revised call, the Artist shall not be responsible for missing the call. The Engager shall use its best efforts to avoid changing any Artist’s call for the day following the Free Day after 11:00 p.m. on the day prior to the Free Day. The rehearsal call for the next day must be provided to the Artist no later than one (1) hour after the end of the last rehearsal block of the rehearsal day, or when the company is also performing, before the half-hour call. The rehearsal call shall be provided to each Artist. It is the Artist's responsibility to provide the Engager with up to date contact information and in cases where the notice is not received to contact the Engager to find out when the Artist's next call will be. Rehearsal Hours Artists may be required to rehearse up to a maximum of six (6) hours out of a span of twelve (12) hours per day to a maximum of thirty (30) hours per engagement week.

  • Software Performance HP warrants that its branded software products will conform materially to their specifications and be free of malware at the time of delivery. HP warranties for software products will begin on the date of delivery and unless otherwise specified in Supporting Material, will last for ninety (90) days.   • Ongoing Performance Measures The Department intends to use performance-reporting tools in order to measure the performance of Contractor(s). These tools will include the Contractor Performance Survey (Exhibit H), to be completed by Customers on a quarterly basis. Such measures will allow the Department to better track Vendor performance through the term of the Contract(s) and ensure that Contractor(s) consistently provide quality services to the State and its Customers. The Department reserves the right to modify the Contractor Performance Survey document and introduce additional performance-reporting tools as they are developed, including online tools (e.g. tools within MFMP or on the Department's website).

  • Excuse for Nonperformance or Delayed Performance Except with respect to defaults of subcontractors, Contractor/Vendor shall not be in default by reason of any failure in performance of this contract in accordance with its terms (including any failure by Contractor/Vendor to make progress in the prosecution of the work hereunder which endangers such performance) if Contractor/Vendor has notified the Commission or designee within 15 days after the cause of the delay and the failure arises out of causes such as: acts of God; acts of the public enemy; acts of the State and any other governmental entity in its sovereign or contractual capacity; fires; floods; epidemics; quarantine restrictions; strikes or other labor disputes; freight embargoes; or unusually severe weather. If the failure to perform is caused by the failure of a subcontractor to perform or to make progress, and if such failure arises out of causes similar to those set forth above, Contractor/Vendor shall not be deemed to be in default, unless the services to be furnished by the subcontractor were reasonably obtainable from other sources in sufficient time to permit Contractor to meet the contract requirements. Upon request of Contractor, the Commission or designee shall ascertain the facts and extent of such failure, and, if such officer determines that any failure to perform was occasioned by any one or more of the excusable causes, and that, but for the excusable cause, Contractor’s progress and performance would have met the terms of the contract, the delivery schedule shall be revised accordingly, subject to the rights of the State under the clause entitled (in fixed-price contracts, “Termination for Convenience,” in cost-reimbursement contracts, “Termination”). (As used in this Paragraph of this clause, the term “subcontractor” means subcontractor at any tier).

  • F2 Monitoring of Contract Performance F2.1 The Contractor shall immediately inform the Authority if any aspect of the Contract is not being or is unable to be performed, the reasons for non-performance, any corrective action and the date by which that action will be completed.

  • Service Performance All Services provided by the Agency shall be performed in a diligent, safe, courteous, and timely manner in accordance with this Contract and the Associated federal requirements.

  • Time for Performance 1.1. The term of this SOW Agreement shall begin on and end on (the “Initial Term”). The Initial Term may be extended as the parties may agree. The State may terminate this SOW for convenience upon thirty days prior written notice to the Contractor. If the Master Agreement should expire or otherwise terminate prior to the end of the term of this SOW Agreement, this SOW Agreement shall continue to the end of its existing term, unless or until terminated in accordance with the terms of this SOW Agreement, and the Parties acknowledge and agree that the terms of the Master Agreement shall survive and apply to this SOW Agreement.
