Postcard Notice. The summary notice of the settlement that is mailed to Settlement Class Members pursuant to Section 4, providing the URL of the Settlement Website and contact information for the Settlement Administrator. The Postcard Notice submitted to the Court for approval must be substantially in the form attached as Exhibit 3.

Postcard Notice. No later than thirty days before the Claim Deadline, the Administrator shall mail a reminder in the form attached as Exhibit D (the “Postcard Notice”) with information regarding the Claim Form Submission Deadline, the Settlement Website address, and how to request a copy of the Claim Form. The Postcard Notice will be mailed to each Class Member who has not submitted a Claim Form and who has not timely and properly excluded themselves.
Postcard Notice. The Settlement Administrator will send a Postcard Notice to any Settlement Class Member for whom Email Notice it is not reasonable or available and for whom it has a postal address. The Postcard Notice shall be substantially similar to the form attached as Exhibit D, and will provide the web address of the Settlement Website and an email and mailing address to contact the Settlement Administrator. The Settlement Administrator, will provide the Postcard Notice on or before sixty (60) calendar days after entry of the Preliminary Approval Order.
Postcard Notice. As soon as practicable, but starting no later than thirty (30) days from the date of the Preliminary Approval Order, the Settlement Administrator shall disseminate the Postcard Notice via First Class Mail to all Settlement Class Members whose email addresses are not known or available. Before mailing the Postcard Notice, the Settlement Administrator will update the addresses provided by Centerstone with the National Change of Address database. It shall be conclusively presumed that the intended recipients received the Postcard Notice if the mailed Postcard Notices have not been returned to the Settlement Administrator as undeliverable within fifteen (15) days of mailing.
Postcard Notice. Unless otherwise ordered by the Court, on or before thirty (30) calendar days after entry of the Preliminary Approval Order, the Settlement Administrator shall send Postcard Notice to Settlement Class Members on the Closed Sales List for whom (a) an email address is unavailable, or (b) emails to all available email addresses bounce back or are rejected. Prior to mailing the Postcard Notice, the Settlement Administrator shall attempt to update the last known addresses of the Class Members through the National Change of Address database.
Postcard Notice. For members of the Settlement Class for whom Apple has a physical address, but not email address, the Settlement Administrator will mail to each such member of the Settlement Class the postcard notice substantially in the form attached hereto as Exhibit C. Before mailing the postcard notice, the Settlement Administrator shall update the addresses provided by Apple with the National Change of Address database=. All postcard notices returned by the U.S. Postal Service with a forwarding address will be re-mailed to that address. In the event that the email and postcard notice described above reaches less than 90% of the Class, the Settlement Administrator will provide supplemental notice in the form of direct mail postcard notice to those members of the Settlement Class whose emails returned a hard bounce back and for whom a mailing address can be located. Any such supplemental notice shall be completed no later than thirty (30) days prior to the Objection and Exclusion Deadline.
Postcard Notice. For any Settlement Class Member who does not have an email address available, the Settlement Administrator will provide Class Notice to the Settlement Class Members via U.S. mail. Before mailing under this Paragraph, the Settlement Administrator shall run the last known postal addresses of the Settlement Class Members through the United States Postal Service (“USPS”) National Change of Address database to update any change of address on file with the USPS. The Postcard Notice will be provided by a postcard sent via United States mail containing text and a tear-off Claim Form substantially in the form of Exhibit D and will direct recipients to the website referred to in Paragraph 3.03.02 above. The Settlement Administrator shall be obliged to re-mail any Postcard Notice returned by the USPS with updated address information, and shall be obliged to run returned postcard notices without updated address information through a skip tracing process before re–mailing. The Settlement Administrator will send a Reminder Postcard Notice, substantially in the form of Exhibit E, to any Settlement Class Members that have not filed a claim thirty (30) calendar days before the deadline for Settlement Class Members to file a claim. The Settlement Administrator will send a subsequent Reminder Postcard Notice to Settlement Class Members who have not filed a claim fourteen (14) calendar days before the deadline for Settlement Class Members to file a claim. All postcard notices, including reminder notices, shall include a unique claims code associated with the notice recipient.

Postcard Notice. As soon as practicable, but starting no later than 40 days from the entry of the Preliminary Approval Order, the Settlement Administrator shall disseminate Postcard Notice via First Class Mail to all Class Members for whom the Settlement Administrator does not have a valid email address (i.e., either a valid email address was not provided to the Settlement Administrator by Volusion or the Settlement Administrator received a hard bounce-back message after an attempt to provide Email Notice). Before mailing the Postcard Notice, the Settlement Administrator will update the addresses provided by Volusion with the National Change of Address database. It shall be conclusively presumed that the intended recipients received the Postcard Notice if the mailed Postcard Notices have not been returned to the Settlement Administrator as undeliverable within fifteen (15) days of mailing. If the Postcard Notice is returned as undeliverable, the Settlement Administrator will conduct a skip trace to attempt to locate the Class Members’ current address and resend the Postcard Notice.

Before mailing under this section, the class administrator shall run the last known postal addresses of any known class members, as provided to class administrator by defendant or other third party, through the United States Postal Service (USPS) National Change of Address, or NCOA, database to update any change of address on file with the USPS. Mailed notice will be provided by a postcard sent via United States mail containing text substantially in the form attached to the declaration of the class administrator. The class administrator shall be obliged to re- mail any postcard notice returned by the USPS with updated address information, and shall be obliged to run returned postcard notices without updated address information through a skip tracing process before re-mailing. Defendant shall not be obliged to direct class administrator to take any further steps with respect to re- mailing returned postcard notices. The postcard notice will direct recipients to the website and telephone number referred to below.
