Pole Attachment Fee. A pre-paid fee which is charged for the occupancy, including during any make-ready period, of one (1) foot of pole space (except for antenna attachment which requires two (2) feet). This fee shall be annual unless CLEC requests that it be semi-annual.

Pole Attachment Fee. In consideration of the license described in paragraph 1 above and the other covenants, terms and conditions contained in this Agreement, LICENSEE agrees to pay an annual pole attachment fee to LICENSOR for each Structure utilized by LICENSEE along the Route as identified in an Exhibit A. LICENSEE may, at any time, remove its attachments from any Structure of LICENSOR, but no refund of any current year rental will be due LICENSEE on account of such removal. The annual per pole fee will be as established in Ames Municipal Code and shall be paid by LICENSEE within thirty (30) days of receipt of an invoice from LICENSOR. Failure to pay the annual per pole fee timely shall be cause for termination as set forth herein.

Pole Attachment Fee. Attacher shall pay to Pole Owner the Pole Attachment License Fee for each Attached Pole to which any Attachment is made pursuant to this Agreement. Current year license fees will be based on the number of Attached Poles as of December 31st of the previous year. Pole Owner will invoice Attacher in January of the given calendar year. Subject to Section 13.1, the Parties agree to a Permitted Attachment and Attached Pole count as of the Inventory Date.

Pole Attachment Fee. Licensee shall pay an annual pole attachment fee equal to the product of $19.51 per attachment (the Rate) and the number of pole attachments associated with the Nixa Facilities, provided, that the foregoing shall not diminish Licensee’s responsibilities for costs otherwise provided in this Agreement. The Rate shall apply to any future rights or permissions that may be granted by the Company to Licensee after the Closing with respect to any additional attachments to any Company Facilities.
