POD Account. A single or joint multiple party account that is payable on request to the owners during their lifetimes and, upon the death of all owners, is payable to the surviving named POD beneficiaries. If there is more than one (1) surviving POD beneficiary, the beneficiaries shall own the account jointly without rights of survivorship. Any POD designation shall not apply to Individual Retirement Accounts (IRAs). We are not obligated to notify any beneficiary of the existence of any account nor the vesting of the beneficiary's interest in any account, except as provided by law.

POD Account. A Payable on Death (POD) Account is an account payable to the Account Owner (or Account Xxxxxx) during his or her lifetime, then payable to one or more designated beneficiaries upon the Account Owner’s death. This allows the Account to be transferred to one or more designated beneficiaries without having to go through probate, subject to certain exceptions set forth below. As the owner of the Account, you may withdraw money from the Account and may, by written direction to us, change the POD beneficiary(ies) under the Account. If the POD Account is held by more than one person, it is owned as a multiple-party account with right of survivorship. When the last surviving Account Owner dies, or if there is only one Account Owner to begin with when the sole Account Owner dies, the Account is owned by the surviving POD beneficiary(ies) so designated by the sole Account Owner or last surviving Account Owner. If there is more than one surviving POD beneficiary, the Account shall be paid in accordance with the percentage amount selected by the sole Account Owner or last surviving Account Owner. If no percentage amount is selected, then the Account shall be paid in equal shares to the surviving POD beneficiaries. If a POD beneficiary survives the sole Account Owner or last surviving Account Owner, but subsequently dies before receiving his or her share of the Account, such share shall belong to the estate of that POD beneficiary. If a POD beneficiary fails to survive the sole Account Owner or last surviving Account Owner, his or her share shall lapse, and the Account shall be distributed pro rata to or among the remaining surviving POD beneficiary(ies) relative to the percentage amount selected by the sole Account Owner or last surviving Account Owner, or equally to or among the remaining surviving POD beneficiary(ies) if no percentage amount is selected. If there is no surviving POD beneficiary upon the death of the sole Account Owner or last surviving Account Owner, the funds shall belong to the estate of the sole Account Owner or last surviving Account Owner, as the case may be.

  • Settlement Account 4.1 The Scheduling Coordinator shall maintain at all times an account with a bank capable of Fed-Wire transfer to which credits or debits shall be made in accordance with the billing and Settlement provisions of Section 11 of the CAISO Tariff.   • Custodial Account Funds in any custodial accounts established by the Servicer and maintained in respect of the REMIC may be invested and, if invested, shall be invested in Eligible Investments selected by the Servicer which shall mature not later than the Business Day immediately preceding the next Remittance Date, and any such Eligible Investment shall not be sold or disposed of prior to its maturity. All such Eligible Investments shall be made in the name of the REMIC or its nominee. All income and gain realized from any such investment shall be, as long as the Servicer is servicing the Mortgage Loans held by the REMIC, for the benefit of the Servicer as additional compensation and shall be subject to its withdrawal or order from time to time. The amount of any losses incurred in respect of any such investments shall be deposited in the relevant account by the Servicer out of its own funds immediately as realized. The foregoing requirements for deposit in such account are exclusive, it being understood and agreed that, without limiting the generality of the foregoing, payments of interest on funds in such account and, as long as the Servicer is servicing the Mortgage Loans held by the REMIC, payments in the nature of prepayment fees, late payment charges, assumption fees or any similar fees customarily associated with the servicing mortgage loans paid by any mortgagor need not be deposited by the Servicer in such account and may be retained by the Servicer as additional servicing compensation. If the Servicer deposits in such account any amount not required to be deposited therein, it may at any time withdraw such amount, any provision herein to the contrary notwithstanding.

  • Debiting your account 1.1 By signing a Direct Debit Request or by providing us with a valid instruction, you have authorised us to arrange for funds to be debited from your account. You should refer to the Direct Debit Request and this agreement for the terms of the arrangement between us and you.

  • Reserve Account (a) On the Closing Date, the Seller shall deposit the Specified Reserve Balance into the Reserve Account. Amounts held from time to time in the Reserve Account shall be held by the Trust Collateral Agent for the benefit of the Noteholders.

  • Separate Accounts The trustee shall maintain within the trust fund a separate account for each Agricultural Contractor that signs the trust agreement to hold deposits made pursuant to this article.

  • CUSTODIAL ACCOUNTS It is agreed that all accounts opened under the Uniform Gift to Minors Act (UGMA), the Uniform Transfers to Minors Act (UTMA), or similar state statutes will be properly created and that all property so transferred will be done in compliance with such applicable statutes. There will be good faith reliance upon the instructions given, representations made and actions taken by a transferor or custodian. Further, the custodian represents and warrants that the assets in the account belong to the minor and that all such assets, whether or not transferred out of the UGMA or UTMA account, will only be used for the benefit of the minor.
