Plant Maintenance. (a) The Parties agree to coordinate planned maintenance schedules for the temporary operational removal of the Facility from service to perform work on specific components in accordance with a pre-planned operations schedule, such as for a planned annual overhaul, inspections, or testing of specific equipment of the Facility. Seller agrees to provide its proposed planned maintenance schedule for the next Calendar Year by October 1st of each Calendar Year. By October 31 of such Calendar Year, Buyer shall notify Seller in writing whether Seller’s planned maintenance schedule is acceptable. If Buyer does not accept a particular planned maintenance period scheduled by Seller, Buyer shall advise Seller of the time period closest to the planned period when the outage can be scheduled. Seller shall schedule outages only during periods approved by Buyer, and such approval shall not be unreasonably withheld (each a “Scheduled Outage”). Once the schedule for the maintenance plan has been established and approved, either Party requesting a subsequent change in such schedule, except when the change is due to Force Majeure, must obtain approval for such change from the other Party, such approval not to be unreasonably withheld. Seller shall plan Scheduled Outages for the Facility in accordance with Good Utility Practice, and the Parties acknowledge that Good Utility Practice shall dictate when Scheduled Outages occur. Seller shall use its reasonable commercial efforts in accordance with Good Utility Practice to not plan Scheduled Outages during the following periods: June 1 through September 30. Scheduled Outages, in aggregate, shall not exceed seven (7) days during any Contract Year.
Plant Maintenance. The normal work week shall consist of forty (40) hours per week, comprising of five (5) eight (8) hour days, Monday to Friday inclusive, between the hours of seven (7) a.m. and five (5) p.m., excluding lunch break.
Plant Maintenance. A. All plant material shall be maintained as needed to prevent obstruction as well as possible safety concerns to vehicles, pedestrians and/or the general public. Shrubs shall be maintained to create adequate line-of-sight vision for vehicles where applicable. All vegetation shall be maintained in such a manner as to eliminate over growth beyond its designated parameter and/or encroachment onto sidewalks or curbs. Keep plants located adjacent to sidewalks at a maximum height of three (3) feet and pruned back one (1) foot from edge of sidewalk.
Plant Maintenance. As defined in Section 3.2 of the General Terms and Conditions.
Plant Maintenance. Gatherer shall perform all inspections, maintenance, testing, alterations, modifications, expansions, connections, repairs or replacements to its Plants and Plant-related facilities as Gatherer deems necessary to perform its obligations under the Agreement (“Plant Maintenance”). No less than thirty (30) Days prior to the beginning of each Contract Year, Gatherer shall provide Shipper in writing with an estimated schedule of the Plant Maintenance to be performed during the succeeding Contract Year. Gatherer anticipates annual Plant Maintenance activities up to the following approximate durations (the “Maximum Maintenance”): (i) up to ten (10) Days per year of partial or full capacity curtailment for preventative maintenance and safety adjustments with respect to the Plants; and, (ii) up to twenty (20) Days partial or full capacity curtailment with respect to each Plant every four (4) years for Plant overhaul. Plants will be rotated over the four (4) year cycle to minimize volume impact. Gatherer shall be entitled, without liability, to interrupt its performance hereunder to perform Maximum Maintenance, except in cases of emergency where Plant Maintenance is immediately required in the reasonable judgment and opinion of Gatherer.
Plant Maintenance. Due to the outdoor nature and external influences on the Cable System, no system is 100% compliant with applicable maintenance requirements all of the time. Accordingly, Comcast has invested and continues to invest millions of dollars in its cable system in Maryland annually to ensure a safe and reliable experience for our customers. In addition, as part of its normal business operations Comcast has taken the following maintenance measures: Comprehensive power supply review, including battery replacement and system status monitoring to ensure correct response in the case of a power outage; Signal leakage identification and repair program that has reduced customer service calls and increased system reliability; and, Quality control program that checks on installs and service work completed by Comcast employees and contractors. Based on our maintenance efforts, during the second quarter of 2018, Comcast’s plant was 99.9% reliable. Xxxxxxx County’s Franchise Agreement requires Comcast to meet or exceed the technical performance standards of the FCC and comply with all current applicable codes including the National Electrical Safety Code, the National Electrical Code and any other applicable federal laws and regulations, the laws, ordinances and construction standards of the State of Maryland, and the generally applicable laws, ordinances and construction standards of the County. Comcast is also responsible for ensuring that its Cable System is designed, installed, and operated in a manner that fully complies with 47 C.F.R. §76.640 and other applicable FCC standards as amended. In addition to the requirements referenced in the Franchise Agreement that comprise a comprehensive commitment to test, maintain, and repair the Cable System to ensure a consistent and reliable customer experience, Comcast also engages in routine Cable System maintenance of its facilities to insure the following: Proper attachment of drops to utility poles; Burial of underground drops; Proper attachment of distribution cable to poles; Xxxxxxx County Administrator October 12, 2018 Proper protection of distribution cables; Proper installation and maintenance of guy wires; Locking of power supplies; Proper securing, repair and replacement of pedestals; Proper grounding and bonding throughout the system; and Proper clearances of aerial cables. Plant Maintenance. No teacher or student shall be required to remain in a building for more than three (3) 27 hours due to lack of electricity, water, or extreme temperatures that fall below fifty-five (55) degrees or over 28 ninety (90) degrees, or if the health of persons are endangered. 29
Plant Maintenance. The Manager shall monitor and review practices and procedures of the maintenance, engineering, security, housekeeping and related services and shall implement, maintain and supervise inspections (interior and exterior) and preventative maintenance programs with respect to the Hotels.

Overtime at the rate of time and one-half the employee’s regular hourly rate shall be paid for all work performed on Saturdays, Sundays or over eight hours per day, or over forty (40) hours per week, provided where an employee has worked in excess of the employee‘s regularly assigned hours in any day or night of any one week, but is prevented from working a full working week by the intervention of a holiday or by the failure of the Employer to provide the employee with work, or by illness of the employee verified to the Employer’s satisfaction, then in such case the employee shall receive overtime for such week calculated on a daily basis. To the extent practical, overtime shall be distributed equitably among the employees in each job classification and department who normally perform the work required. Overtime premiums shall not be paid more than once for any hour worked, and there shall be no pyramiding of overtime. The hours and days of work of each employee assigned to a scheduled week shall be posted at least seven (7) calendar days in advance. The Employer may schedule a work week consisting of five (5) consecutive eight-hour (8-hour) days, other than the normal work week. In this case the regular rate of pay shall apply except for Saturdays, Sundays and holidays. Employees shall not be required to lay off during regular hours to offset any overtime worked. The Parties agree that split shifts are not desirable, but the Employer may schedule a work weekconsisting of five (5) consecutive days made up of broken eight-hour (8-hour) shifts, when this provides full-time employment. Split shift shall be defined as those shifts in which the two portions of the eight hours worked occur within a period of consecutive hours and no portion is of less than three hours duration. Employees required to work a split shift shall receive cents per hour additional compensation for each hour worked.
Plant Maintenance. 6.1 The Operator shall ensure that arrangements are in place for the day to day operation and routine maintenance of plant, which description includes without limitation heating and hot water systems, and internal and external lighting. The Operator shall immediately inform the Authorised Officer of any plant failure, breakdown or other fault that makes the Facilities unavailable for use (pre-booked or otherwise) and of the Facilities return to use once the problem is resolved.
