PLANNING ACT CONDITION. This offer is conditional upon the Vendor obtaining, prior to Closing, compliance with the subdivision control provisions (Section 50) of the Planning Act (Ontario), which compliance shall be obtained by the Vendor at its sole expense, on or before Closing.

PLANNING ACT CONDITION. This Agreement shall be effective to create an interest in the Property for the Purchaser only if Section 50 of the Planning Act, R.S.O. 1990 c. P.13, as may be amended, is complied with by the Vendor, at the Vendor's expense, on or prior to Closing.
