PHYSICAL ASSAULTS. If a bargaining unit employee is physically assaulted during working hours and on the Employer's premises, the incident shall be reported promptly to the Employer. In any case of physical assault upon a bargaining unit employee the Employer and the Union at their discretion will render all reasonable assistance to the employee. The Employer will reimburse bargaining unit employees for loss of clothing or personal property (not covered by insurance) less depreciation or repair the same when caused through physical assault while on duty. This provision does not apply if employee is involved in criminal activity.

PHYSICAL ASSAULTS. Principals and teachers shall be required to report any alleged case of physical abuse on a teacher occurring while the teachers are on duty to the Superintendent of Schools. The alleged assault will be promptly investigated by the principal and/or the Superintendent. At the conclusion of the investigation, the teacher will be promptly informed of the results of the investigation and of any action to be taken against an individual involved in an assault of a teacher. Assaults on staff will be handled according to School Committee policy. Nothing in this agreement shall preclude the reporting of such assault to the police and/or the court by the administration and/or the teacher assaulted. If criminal or civil proceedings are brought against a teacher alleging that a physical assault was committed while acting within the scope of official duties or employment, the Committee will furnish and select legal counsel to defend the teacher in such physical assault proceedings, if so requested. If the teacher desires to bring criminal or civil proceedings in connection with an alleged assault suffered while acting within the scope of official duties or employment, such teacher may request the Committee to furnish and select legal counsel to represent the teacher in such proceedings. If the Committee does not provide such counsel and the teacher, after having so requested in writing, prevails in the proceedings, then the Committee will reimburse the teacher for reasonable counsel fees incurred.   • Physical Exams The Employer agrees to provide without cost to employees, physical examinations and/or other appropriate tests when such tests are deemed necessary by management to determine whether the health of employees is being or has been adversely affected by exposure to potentially harmful physical agents, toxic materials, or infectious agents, or by attacks and assaults. The Employer agrees to provide to each affected employee who requests it a complete and accurate written report of any such medical examination or other appropriate tests related to occupational exposure. Additionally, written results of an industrial hygiene measurements or investigations related to an employee's occupational exposure will also be provided, upon request, to the employee or the employee's authorized representative. The Union and/or members of the applicable Health and Safety Committee will be provided copies of summary reports, but such reports will not contain personally identifying information.

  • Physical Fitness New Employees. New employees are required to file a medical examination report with the Director of Health Services before reporting for duty in the Des Moines schools. The employee must pay the cost of this examination given by a physician of his/her choice and reported on the form provided by the Employer.

  • Physical Architecture 59.2.1 CenturyLink's network architecture in any given local exchange area and/or LATA can vary markedly from another local exchange area/LATA.   • Physical Safeguards USAC and the Department agree to maintain all automated matching records in a secured computer environment that includes the use of authorized access codes to restrict access. Those records will be maintained under conditions that restrict access to persons who need them for official duties related to the matching process. The user’s supervisor will ensure that USAC or the Department are notified when a user has departed or duties have changed so the user no longer needs access to the system, to ensure timely deletion of the user’s account and password.
