Phase I and Phase. II Environmental Assessments of Community Bank's Primary Banking Facility. CBES hereby agrees that NASB Holding may cause to be performed a Phase I and Phase II environmental assessment of the real property on which Community Bank's primary banking facility is located (1001 North Xxxxx Xxxxx Road, Excelsior Springs, Missouri 64024). If as a result of such assessment it is determined that environmental clean-up costs would exceed $500,000, then NASB Holding may elect to terminate this Agreement pursuant to Section 7.1(h).
Phase I and Phase. II Environmental Assessment Reports with respect to Accura, each dated reasonably near the date of such Borrowing, and the Borrower and/or Accura shall have obtained Environmental Permits necessary to operate the business of Accura and Accura shall maintain its operations in compliance with such permits;
Phase I and Phase. 2 PREMISES The Landlord hereby leases to the Tenant the Phase 1 and Phase 2 Premises comprised of approximately 30,400 square feet of the total space, and more specifically as shown on Schedule "A", as adjusted and verified in accordance with paragraph 1(h) of this Lease Amendment ("Leased Premises") on the terms and conditions as follows:

Phase I and Phase. II Environmental Assessment Reports prepared by Applied Geosciences, Inc., dated February 7, 1995, and February 13, 1995, respectively.
Phase I and Phase. II environmental assessments of the Real Property of E.P. Plastics and Goodyear Composites acquired pursuant to the Acquisitions, from Xxxxxxx Environmental Consultants, the results of which shall be in form and substance satisfactory to the Agent and the Required Banks; and
Phase I and Phase. II Engineering. Owner has entered into that certain Phase I and Phase II Engineering Services Agreement dated December 1, 2005 between Owner and Xxxxx Engineering, LLC (“Xxxxx Engineering”) and attached hereto as Exhibit L (“Phase I and Phase II Engineering Services Agreement”). The Phase I and Phase II Engineering Services Agreement provides for Xxxxx Engineering to commence work on the Phase I and Phase II engineering for the Project as set forth therein. Owner has agreed to pay Xxxxx Engineering Ninety-two Thousand Five Hundred Dollars ($92,500.00) for such engineering services pursuant to the terms of that agreement, the full amount of which shall be included in and credited to the Contract Price. Notwithstanding the foregoing sentence, if a Notice to Proceed is not issued pursuant to Section 6.2, or Financial Closing is not obtained pursuant to Section 4.3, then no amount paid under the Phase I and Phase II Engineering Services Agreement shall be refunded to Owner.
Phase I and Phase. II environmental site assessments were performed at the former Xxxxxxx and Xxxxx facilitiy in Merrill, WI using WPRI Assessment Monies. The site is part of the City of Xxxxxxx’x waterfront redevelopment efforts (photo courtesy: Xxxxx , Xxxxxx and Xxxxxxxxxxx, Inc.).
