Phase 2B – 2006-2009. Based on the Phase 1 research, consistent with the decision made pursuant to paragraph (b)(2) above, and in consultation pursuant to paragraph (c) below, the licensee shall implement the work and research as outlined below for further enhancements of the downstream fish passage facilities. Under Phase 2B the licensee shall: (i) continue to implement operational changes commenced in 2005 to enhance downstream passage of shortnose xxxxxxxx; (ii) continue studies and research to determine the appropriate alternative exclusion and passage device(s), including an angled bar rack; (iii) design/permit measures and modifications in 2007 for: (A) an alternative exclusion device, and (B) an alternative passage device (in the vicinity of Rubber Dam Section No. 5) to safely and successfully pass fish without injury or significant impairment to essential behavioral patterns and avoid any potential flow interference problems with the spillway fishway, construct these facilities in 2008, and start effectiveness testing of these facilities in 2009; (iv) undertake additional research and additional measures from 2006 to 2009 to ensure that the downstream passage facilities are effective for exclusion and guidance as described below; and (v) implement a long-term monitoring program for shortnose xxxxxxxx from 2010 to the end of the Project License.   • Phase 2 Phase 2 is expected to consist of Member Nodes and a select number of Nodes operated by non-Members. The non-Member Nodes will be required to comply with Node hosting terms as set forth by the Council, which may be amended from time to time (the “General Node Terms”).

  • Stage 1 (a) An aggrieved Employee shall first submit her representation in writing to her Supervisor or designate either directly or through her Union Xxxxxxx.   • Treatment of Unallowable Costs Previously Submitted for Payment Defendants further agree that within 90 days of the Effective Date of this Agreement they shall identify to applicable Medicare and TRICARE fiscal intermediaries, carriers, and/or contractors, and Medicaid and FEHBP fiscal agents, any Unallowable Costs (as defined in this Paragraph) included in payments previously sought from the United States, or any State Medicaid program, including, but not limited to, payments sought in any cost reports, cost statements, information reports, or payment requests already submitted by Defendants or any of their subsidiaries or affiliates, and shall request, and agree, that such cost reports, cost statements, information reports, or payment requests, even if already settled, be adjusted to account for the effect of the inclusion of the Unallowable Costs. Defendants agree that the United States, at a minimum, shall be entitled to recoup from Defendants any overpayment plus applicable interest and penalties as a result of the inclusion of such Unallowable Costs on previously-submitted cost reports, information reports, cost statements, or requests for payment. Any payments due after the adjustments have been made shall be paid to the United States pursuant to the direction of the Department of Justice and/or the affected agencies. The United States reserves its rights to disagree with any calculations submitted by Defendants or any of their subsidiaries or affiliates on the effect of inclusion of Unallowable Costs (as defined in this Paragraph) on Defendants or any of their subsidiaries or affiliates’ cost reports, cost statements, or information reports.

  • December 2016  Unless differently stated in forthcoming revisions of the current Voluntary Agreement, the following reports shall be established by 30 April every year covering products placed on the market during the previous full calendar year, e.g. by 30 April 2018 for products placed on the market between 1 January 2017 and 31 December 2017. Within two weeks following the end of a reporting period, the Independent Inspector shall send a request to the Signatories to file their Reports. These shall be submitted no later than two months and two weeks after the end of the reporting period. The Reports shall be compiled by the Independent Inspector into a draft annual progress report (the “Annual Progress Report”) that will be submitted to the European Commission and the Signatories by the 12 April of the calendar year following the end of the reporting period for the purpose of checking inconsistencies and quality. The Independent Inspector will submit the Final Annual Progress Report to the Steering Committee no later than 30 April of the calendar year following the end of the reporting period. This Annual Progress Report will only show anonymous results. Signatories will not be named although individual achievements shall be disclosed (company A, company B, etc.). In case a company is found to be non-compliant, the Annual Progress Report shall provide the identity of the Signatory and detail the reasons for such non-compliance. The Independent Inspector shall be responsible for ensuring that confidentiality of the Signatory’s identity and any data or information provided to it under or in relation to this agreement is maintained. This shall include entering into a non-disclosure agreement with each Signatory if requested by the Signatory.
