Common use of Pest Control Clause in Contracts

Pest Control. All Residents are required to assist Fourth Street in pest control procedures. All Residents’ participation in Fourth Street’s pest control treatment program is MANDATORY. If the Residents’ Apartment is not ready when Fourth Street’s pest control vendor is scheduled to treat the Apartment, the Residents may be required to pay for extermination re-treatment (s) or a second exterminator visit fee as additional Rent. Residents are required to comply with all requests by Fourth Street for readying their Apartment unit for pest control treatments which may include emptying cupboards, removing materials from under sinks or vanities, and other requests. Residents also are required to follow any recommendations or treatment control requests of Fourth Street’s pest control vendor. Some pests, such as bedbugs, may require Residents to dispose of or professionally clean (at high temperatures or with chemical treatments) personal property and fabrics. Residents are responsible for all costs of treating or removing their personal property, furniture, mattresses, and fabrics needed, in the opinion of Fourth Street’s pest control vendor, to achieve effective pest control. Fourth Street will not reimburse or replace personal property that must be treated or eliminated. Failure to follow the requirements of Fourth Street’s pest control vendor is a breach of this Agreement and constitutes a Default. A Resident’s failure to promptly notify Fourth Street of pests in the Resident’s Apartment is a serious violation of and Default under this Agreement. Prompt notification to Fourth Street is necessary to prevent pest infestation and to keep pests from spreading. In the event of a routine inspection that discloses that the Apartment has had an ongoing pest problem that has not been reported by the Residents, this Agreement may be terminated or non-renewed. In ordinary circumstances of pest control, Fourth Street will pay for the pest control treatment. In circumstances where Fourth Street’s professional pest control provider determines that the pests have been brought into the apartment by a Resident or Resident’s guests, where the Resident has failed to notify Fourth Street of a pest problem, or where the unit has been treated in the past and there is a re-infestation or a failure to take all steps required to eliminate the infestation, then Fourth Street shall be entitled to charge Resident for the cost of the initial service, or repeat service to the apartment, common areas or other units where an unreported problem has spread, in accordance with paragraph 29 herein.

Pest Control. All Residents If Resident fails to report any pest infestation and/or problems with the Premises within seven (7) days of move-in, Resident acknowledges that the Premises are required acceptable, in good condition, and pest free. After this period, Resident shall immediately report to assist Fourth Street Owner’s onsite agent any signs or indications of pests. Resident agrees that Resident’s violation of this provision constitutes a material breach of this Lease, and Owner shall have all remedies for breach set forth in pest control proceduresthis Lease, and as set forth in this provision and at law, including eviction. All Residents’ participation Resident is at all times responsible for the conduct of Resident’s occupants, guests, invitees and all others (“other Persons”) who are present on or in Fourth Streetany portion of the Community due to or because of Resident. A violation by any other Person of this Lease is a violation by Resident. Resident agrees that it is in Resident’s best interest and the best interest of the Community to fully cooperate with Owner’s pest control treatment program is MANDATORYefforts. If the Residents’ Apartment is not ready when Fourth StreetResident agrees to fully cooperate with Owner or Owner’s pest control vendor company employed to eradicate pests, including all written instructions distributed to Resident. Resident’s full cooperation includes, but is scheduled not limited to, immediately reporting in writing pest infestation to treat the ApartmentOwner, making the Residents may be Premises available for entry to complete pest inspection and eradication treatment(s), completing all required to pay for extermination repre-treatment (s) or a second exterminator visit fee as additional Rent. Resident shall keep the Premises clutter free, clean, and sanitary, including regularly vacuuming. Resident shall cover mattresses and box springs with zippered, vinyl coverings, to prevent bed bugs from getting inside of mattresses. Residents shall arrange furniture to minimize pest hiding places. If possible, keep furniture several inches away from walls. Resident shall inspect clothing, luggage, and other personal property for signs of bed bugs when Resident stays overnight away from the Premises, or otherwise is exposed to areas that likely contain bed bugs. In addition to regularly scheduled pest control services, if any, provided by the Community, Resident may request reasonable extermination services at any time. All requests must be in writing. Owner may enter Resident’s unit to inspect for pests or for pest control related matters. If practical, Owner will notify Resident in advance of each pest inspection, including providing a preparation sheet. Notification is presumed received if Owner hands the notice and instructions directly to Resident or if Owner posts the notice and instructions to Resident’s unit. Resident acknowledges that under some circumstances immediate action may be necessary to control pests, such as bedbugsand Owner is not required to provide Resident advance notice if circumstances require immediate action. If Resident promptly notifies Owner and cooperates with Owner and/or Owner’s pest control company and the unit is either re- infested or the initial treatment is ineffective, may require Residents Owner will promptly schedule re-inspection and re-treatment at no cost to dispose Resident. If Resident is not fully prepared for the treatment, Resident agrees to pay $50.00. (If no amount is filled in, Resident shall be billed for the actual cost of service.) If Resident fails to cooperate fully with any pest treatment plan and the unit is either re-infested or professionally clean (at high temperatures or with chemical treatments) personal property and fabrics. Resident’s full cooperation includes, but is scheduled not limited to, immediately reporting in writing pest infestation to treat the ApartmentOwner, making the Residents may be Premises available for entry to complete pest inspection and eradication treatment(s), completing all required to pay for extermination repre-treatment (s) or a second exterminator visit fee as additional Rent. Residents are activities, evacuating the premises during and after treatment for the required to comply with time frame, if any, completing all requests by Fourth Street for readying their Apartment unit for pest control treatments which may include emptying cupboards, removing materials from under sinks or vanitiesrequired post-treatment activities, and other requestsimmediately reporting in writing ineffective treatment or re- infestations to the Owner. Residents Resident shall also are required to follow immediately dispose of any recommendations property or treatment control requests furniture that has been infested and that is not salvageable in the sole discretion of Fourth StreetOwner’s pest control vendor. Resident shall keep the Premises clutter free, clean, and sanitary, including regularly vacuuming. Resident shall cover mattresses and box springs with zippered, vinyl coverings, to prevent bed bugs from getting inside of mattresses. Residents shall arrange furniture to minimize pest hiding places. If possible, keep furniture several inches away from walls. Resident shall inspect clothing, luggage, and other personal property for signs of bed bugs when Resident stays overnight away from the Premises, or otherwise is exposed to areas that likely contain bed bugs. In addition to regularly scheduled pest control services, if any, provided by the Community, Resident may request reasonable extermination services at any time. All requests must be in writing. Owner may enter Resident’s unit to inspect for pests or for pest control related matters. If practical, Owner will notify Resident in advance of each pest inspection, including providing a preparation sheet. Notification is presumed received if Owner hands the notice and instructions directly to Resident or if Owner posts the notice and instructions to Resident’s unit. Resident acknowledges that under some circumstances immediate action may be necessary to control pests, such as bedbugsand Owner is not required to provide Resident advance notice if circumstances require immediate action. If Resident promptly notifies Owner and cooperates with Owner and/or Owner’s pest control company and the unit is either re- infested or the initial treatment is ineffective, may require Residents Owner will promptly schedule re-inspection and re-treatment at no cost to dispose Resident. If Resident is not fully prepared for the treatment, Resident agrees to pay $50.00. (If no amount is filled in, Resident shall be billed for the actual cost of service.) A surge in global travel and mobility, combined with changes in pesticide use, including the banning of pests in the Resident’s Apartment is a serious violation of and Default under this Agreement. Prompt notification to Fourth Street is necessary to prevent pest infestation and to keep pests from spreading. In the event of a routine inspection that discloses that the Apartment has had an ongoing pest problem that has not been reported by the Residents, this Agreement may be terminated or non-renewed. In ordinary circumstances of pest control, Fourth Street will pay DDT created optimal conditions for the pest control treatment.
