Common use of Personal Release Clause in Contracts

Personal Release. Xxxxxx (and/or others on behalf of Xxxxxx) may be photographing, recording (both audio and video), webcasting and podcasting (“Recordings”) at the Event and the Venues, events or activities. By agreeing to these Terms and attending the Event: • You agree that your image, likeness, voice, statements and other identifying characteristics (your “Image”) may be Recorded, and you consent to the use of your Image in connection with the use of the Recordings. • You irrevocably grant Apollo and its agents, contractors, licensees and designees and their respective successors and assigns (the “Apollo Parties”) a non- exclusive, worldwide, royalty-free and fully paid-up, perpetual license to use, reproduce, distribute, prepare derivative works of, translate, display, perform and otherwise exploit the Recordings and your Image therein, in whole or in part, in any and all media formats and through any and all media channels, in any manner and for any purpose in connection with Apollo, its business and/or the Event (including any future reoccurrence of the Event or a similar event), and for any other lawful purpose. • You waive any right you may have to inspect and/or approve the use of the Recordings or any reproductions thereof, and you agree that Xxxxxx is not obligated to make any use of your Image or exercise any of the rights granted to it. • You understand that your Image may appear in Recordings made available to you, other attendees, or the public, and that third-parties may retain and distribute those Recordings. • You agree that Xxxxxx exclusively owns all rights (including without limitation, intellectual property rights) in the Recordings and all results and proceeds derived from the use of the Recordings and your Image therein, and that no portion of such proceeds will be shared with you. • You waive and release any and all rights of privacy and publicity, and any and all claims to compensation or damages or of violation of intellectual property rights, in connection with the use of the Recordings and your Image therein and/or any advertising or publicity relating thereto. • You represent that you are of full legal age and have read this release and fully understand its contents.

Xxxxxx Slack (and/or others on behalf of XxxxxxSlack) may be photographing, recording (both audio and video), webcasting and webcasting, podcasting or otherwise transmitting during any or all of an Event (“Recordings”) including at the Event and the Venuesvenue during an Event session, events breakout, keynote or activitiesother activity). By agreeing to these Terms and attending the Event: • You agree that your Your image, likeness, voice, statements and other identifying characteristics (your each, an “Image”) may be Recordedcaptured in photographs, recordings (both audio and you consent to the use of your Image in connection with the use video), webcasts, podcasts, or other transmissions of the RecordingsEvent (each, a “Recording”). • You irrevocably hereby grant Apollo and its agents, contractors, licensees and designees and their respective successors and assigns (the “Apollo Parties”) to Slack a non- exclusive, worldwide, royalty-free and free, fully paid-up, perpetual license non-exclusive, perpetual, irrevocable, transferable and fully sublicensable (through multiple tiers) license, without additional consideration to useyou or any third party, to reproduce, distribute, prepare perform and display (publicly or otherwise, create derivative works of, translateadapt, display, perform modify and otherwise use, analyze and exploit the Recordings and (including your Image Images therein), in whole or in part, in any and all format or media formats and through any and all media channelsnow known or hereafter developed, in any manner and for any purpose in connection with Apollo, its business and/or the Event (including any future reoccurrence for promotional purposes, such as testimonials). Slack exclusively owns all right, title and interest (including intellectual property rights) in and to the Recordings, all modifications and derivatives of the Event or a similar event)Recordings, and for all proceeds derived therefrom. Slack has no obligation to share any other lawful purposesuch proceeds with you. • You hereby irrevocably waive any right you may have to inspect and/or or approve the use or other exploitation of the Recordings any Recording or any reproductions thereof, and you agree that Xxxxxx is not obligated Slack has no obligation to make use any use Recording (including any of your Image Images) or otherwise exercise any of the rights granted to itSlack with respect to your Images. • You understand that your Image Your Images may appear in Recordings made available to you, other attendees, or the public, and that third-third parties may retain and retain, use or distribute those such Recordings. • You agree that Xxxxxx exclusively owns all rights Once made available to the public, Slack has no control over, and is not responsible for, any use or misuse (including without limitation, intellectual property rightsany distribution) in the Recordings and all results and proceeds derived from by any third party of Recordings. In connection with the use or other exploitation of the Recordings and (including your Image thereinImages), and that no portion of such proceeds will be shared with you. • You you hereby irrevocably waive and release any and all claims with respect to intellectual property, rights of privacy and publicity, rights of privacy, and any and all other claims to compensation or damages with respect to such use or of violation of intellectual property rights, in connection with the use of the Recordings and your Image therein and/or any advertising or publicity relating theretoother exploitation. • You represent affirm that you are of full legal age and have read this the foregoing release and fully understand its contents.

Personal Release. Xxxxxx Community Group Meeting leaders and attendees, and/or Salesforce (and/or others on behalf of Xxxxxx) Salesforce), may be photographing, recording (both audio and video), webcasting and webcasting, podcasting or otherwise transmitting during any or all of any Community meeting or event (“Recordings”) including at the Event and the Venuesa Community Group Meeting venue, events during a Community Group Meeting session, or activitiesduring other Community Group activity). By agreeing to these Terms and attending the Event: • You agree that your Your image, likeness, voice, statements and other identifying characteristics (your each, an “Image”) may be Recordedcaptured in photographs, recordings (both audio and you consent video), webcasts, podcasts, or other transmissions of such Community meeting or event (each, a “Recording”). You hereby grant to the use of your Image in connection Salesforce, with the use of the Recordings. • You irrevocably grant Apollo respect to all Recordings (and its agents, contractors, licensees and designees and their respective successors and assigns (the “Apollo Parties”to each Community Group Meeting leader or attendee with respect to any Recordings captured by such leader or attendee) a non- exclusive, worldwide, royalty-free and free, fully paid-up, perpetual license non-exclusive, perpetual, transferable and fully sublicensable (through multiple tiers) license, without additional consideration to useyou or any third party, to reproduce, distribute, prepare perform and display (publicly or otherwise), create derivative works of, translateadapt, display, perform modify and otherwise use, analyze and exploit the such Recordings and (including your Image Images therein), in whole or in part, in any and all format or media formats and through any and all media channelsnow known or hereafter developed, in any manner and for any purpose in connection with Apollo, its business and/or the Event (including for promotional purposes, such as testimonials). The foregoing license also applies to any future reoccurrence Recordings you make available to Salesforce or any Community Group Meeting leader or attendee. Salesforce exclusively owns all right, title and interest (including intellectual property rights) in and to the Recordings captured by Salesforce (and/or by others on behalf of the Event or a similar eventSalesforce) (“Salesforce Recordings”), all modifications and for derivatives of Salesforce Recordings, and all proceeds derived from Salesforce Recordings or such modifications or derivatives. Salesforce has no obligation to share any other lawful purposesuch proceeds with you. • You hereby irrevocably waive any right you may have to inspect and/or or approve the use or other exploitation of the Recordings any Recording or any reproductions thereof, and you agree that Xxxxxx is not obligated Salesforce has no obligation to make use any use Recording (including any of your Image Images) or otherwise exercise any of the rights granted to itSalesforce with respect to your Images. • You understand that your Image Your Images may appear in Recordings made available to you, other attendees, or the public, and that third-third parties may retain and retain, use or distribute those such Recordings. • You agree that Xxxxxx exclusively owns all rights Salesforce has no control over, and is not responsible for, any use or misuse (including without limitation, intellectual property rightsany distribution) in the Recordings and all results and proceeds derived from by any third party of any Recordings. In addition, you hereby represent that all individuals whose Images are captured in any Recordings you make available to Salesforce or to any third party have consented to the inclusion of their Images in such Recordings and have authorized you to grant on their behalf the license, waiver and release granted by you to such Images and Recordings in these Program Terms.

IN CONNECTION WITH THE USE OR OTHER EXPLOITATION OF RECORDINGS (INCLUDING YOUR IMAGES), intellectual property rights) in the Recordings and all results and proceeds derived from the use of the Recordings and your Image thereinYOU HEREBY IRREVOCABLY WAIVE AND RELEASE ANY AND ALL CLAIMS WITH RESPECT TO INTELLECTUAL PROPERTY, and that no portion of such proceeds will be shared with youRIGHTS OF PUBLICITY, RIGHTS OF PRIVACY, AND ANY OTHER CLAIMS OR DAMAGES WITH RESPECT TO SUCH USE OR OTHER EXPLOITATION. • You waive and release any and all rights of privacy and publicity, and any and all claims to compensation or damages or of violation of intellectual property rights, in connection with the use of the Recordings and your Image therein and/or any advertising or publicity relating thereto. • You represent that you are of full legal age and have read this release and fully understand its contentsYOU AFFIRM THAT YOU ARE OF LEGAL AGE AND HAVE READ THE FOREGOING RELEASE AND FULLY UNDERSTAND ITS CONTENTS.
