Common use of Personal Property Damage Clause in Contracts

Personal Property Damage. ‌ Upon submission of reasonable proof the Employer will repair or indemnify with respect to damage to the chattels of an employee while on duty caused by the actions of a patient, or client, provided that such personal property is an article of use or wear of a type suitable for use while on duty. Where an employee’s vehicle is damaged by a person in the care or custody of the Employer, or by any other person/event where the employee is using their vehicle while working, the Employer shall reimburse the lesser of the actual vehicle damage repair costs, or the cost of any deductible portion of insurance coverage on that vehicle up to a maximum of $500.00. No reimbursement shall be paid in those cases where the damage was sustained as a result of the employee’s actions.
