Personal Information Security. Acquirer may transfer personal information to Planet Payment for processing under this Agreement. Planet Payment shall ensure that it, its Affiliates, and their employees, agents, and subcontractors shall comply with the Rules and the requirements of any applicable statute, law or regulation relating to protection of personal information, in the Designated Territory or elsewhere and shall not do or permit anything to be done, with respect to personal information, which might contravene the Acquirer’s obligations under applicable privacy, data and/or information protection laws in the Designated Territory or elsewhere, and shall comply with any reasonable request made by Acquirer in connection with any of the foregoing. Planet Payment shall process, store and transmit personal information, which is transferred to it by the Acquirer and/or the Acquirer Merchants only pursuant to this Agreement or at the Acquirer’s written request.

Personal Information Security. Acquirer may transfer personal information to Planet Payment for processing under this Agreement. Acquirer acknowledges and consents to the transfer of such information outside of the Designated Territory. Planet Payment shall ensure that it, its employees agents, and its sub-contractors shall comply with any reasonable request made by Acquirer in connection with the requirements of any applicable statute, law or regulation relating to protection of personal information, in any Designated Territory or elsewhere and shall not do or permit anything to be done, with respect to personal information while such information is under Planet Payment’s control, which might contravene the Acquirer’s obligations under applicable privacy, data and/or information protection laws in any Designated Territory or elsewhere except to the extent that this is outside Planet Payment’s reasonable control. Planet Payment shall process, store and transmit personal information, which is transferred to it by the Acquirer and/or the Acquirer Merchants only pursuant to this Agreement or at the Acquirer’s written request.
Personal Information Security. To the extent AFFILIATE receives Personal Information as defined by and in accordance with Kentucky’s Personal Information Security and Breach Investigation Procedures and Practices Act, KRS 61.931, 61.932 and 61.933 (the “Act”), AFFILIATE shall secure and protect Personal Information by, without limitation: (i) complying with all requirements applicable to non-affiliated third parties set forth in the Act; (ii) utilizing security and breach investigation procedures that are appropriate to the nature of the Personal Information disclosed, at least as stringent as UNIVERSITY’s and reasonably designed to protect the Personal Information from unauthorized access, use, modification, disclosure, manipulation or destruction; (iii) notifying UNIVERSITY of a security breach relating to Personal Information in the possession of AFFILIATE or its agents or subcontractors within seventy-two (72) hours of discovery of an actual or suspected breach unless the exception set forth in KRS 61.932(2)(b)2 applies and AFFILIATE abides by the requirements set forth in that exception; (iv) cooperating with UNIVERSITY in complying with the response, mitigation, correction, investigation and notification requirements of the ACT, (v) paying all costs of notification, investigation and mitigation in the event of a security breach of Personal Information suffered by AFFILIATE; and (vi) at UNIVERSITY’s discretion and direction, handling all administrative functions associated with notification, investigation and mitigation.

Personal Information Security. The Traveler provides personal information of his/her own free will. Personal information is required for processing requested services. The same information shall be used for inter-communication. The Agency is under obligation that the personal information of the Traveler will not be taken out of the country or given to a third party except for the purpose of carrying out requested services. Should the Traveler request insurance, the personal information of the Traveler will be passed on to the insurance company. The personal information will be kept in the Agency's database. Personal Information Security. Contractor shall comply with the provisions of the New York State Information Security Breach and Notification Act (General Business Law Section 889-aa; State Technology Law Section 208). Contractor shall be liable for the costs associated with such breach if caused by Contractor's negligent or willful acts or omissions, or the negligent or willful acts or omissions of Contractor's agents, officers, employees or subcontractors.
