Personal Information. Each party shall comply with their respective obligations under applicable data protection legislation. HPE does not intend to have access to personally identifiable information (“PII”) of Customer in providing services. To the extent HPE has access to Customer PII stored on a system or device of Customer, such access will likely be incidental and Customer will remain the data controller of Customer PII at all times. HPE will use any PII to which it has access strictly for purposes of delivering the services ordered.
Personal Information. Your installation and/or use of Your BlackBerry Solution (or any portion thereof), the RIM Services or associated Airtime Services may result in the Processing of personal information as defined under applicable law about You and Your Authorised Users (collectively, “Users”) by RIM Group of Companies and its service providers, Your Airtime Service Providers, and third parties with products or services used with Your BlackBerry Solution. Depending on the services used, personal information may include information such as name, email address, telephone number, BlackBerry ID, account credentials and settings, Handheld Product information (for example, Handheld Product PIN or other device identifiers), Handheld Product location information (as described below), Airtime Service Provider information, and information about the use of Your BlackBerry Solution functionality and the RIM Services or software and hardware utilized in conjunction with Your BlackBerry Solution). You consent that the RIM Group of Companies may collect such personal information from You directly, or obtain it from Airtime Service Providers or third parties with products or services used with Your BlackBerry Solution.

Except as otherwise stated in this Privacy Policy, we do not sell, trade, rent or otherwise share for marketing purposes your Personal Information with third parties without your consent. We do share Personal Information with vendors who are performing services for the Company, such as the servers for our email communications who are provided access to user’s email address for purposes of sending emails from us. Those vendors use your Personal Information only at our direction and in accordance with our Privacy Policy. In general, the Personal Information you provide to us is used to help us communicate with you. For example, we use Personal Information to contact users in response to questions, solicit feedback from users, provide technical support, and inform users about promotional offers. We may share Personal Information with outside parties if we have a good-faith belief that access, use, preservation or disclosure of the information is reasonably necessary to meet any applicable legal process or enforceable governmental request; to enforce applicable Terms of Service, including investigation of potential violations; address fraud, security or technical concerns; or to protect against harm to the rights, property, or safety of our users or the public as required or permitted by law.
Personal Information. Desjardins will open a file under the cardholder’s name so that the cardholder may receive financial services as they relate to the various credit and payment services. The personal information contained in this file is kept at the offices of Desjardins or its agents, and is consulted by their employees when warranted in the performance of their duties. Desjardins may also create nominative lists of its cardholders and share them with third parties for business prospecting purposes. The cardholder may exclude his name from nominative lists constituted by Desjardins. Moreover, the cardholder has a right to access the contents of his file and to correct any erroneous information by making a written request to that effect to the privacy officer. The cardholder may address these requests to: Customer Service Department (PRP), P.O. Box 8600, Station Centre-ville, Montreal, Quebec, H3C 3P4. The cardholder agrees that Desjardins may obtain and update, from any credit reporting agency, financial institution, employer or credit card issuer (“Third Parties”), only information required for the subject matter of its file, i.e., the provision of financial services as they relate to the various credit and payment services, in order to assess the cardholder’s creditworthiness, to administer the cardholder’s account and to review his financial commitments to Desjardins within the context of this Agreement or the cardholder’s other financial dealings with it. The cardholder authorizes Third Parties to disclose such information to Desjardins, even though said information may be in an inactive or closed file. The cardholder agrees that Desjardins may disclose to any personal information agent, financial institution and credit card issuer any information regarding the cardholder’s financial commitments to Desjardins arising from the use of the card. The above consents shall remain in effect as long as the cardholder has carried on business with Desjardins, failing which Desjardins shall terminate this Agreement. In the event our service provider is located outside of Canada, the service provider is bound by, and the information may be disclosed in accordance with, the laws of the jurisdiction in which the service provider is located.

In the course of opening your Account and providing services to you under this Client Agreement, it will be necessary for us to obtain and hold personal information that we will obtain from you in accordance with data protection and anti-money laundering legislation. You agree that we can rely on, hold and process personal information for the purpose of performing our services and obligations under this Client Agreement and for the purpose of improving those services. If you do not provide the information requested by us or agree to our information handling practices detailed in this Client Agreement, we may not be able to provide our services to you.
